FARM PRODUCTS AGENCIES ACT

Whereas the Governor in Council has, by the Chicken Farmers of Canada Proclamation footnote a, established Chicken Farmers of Canada (“CFC”) under subsection 16(1)footnote b of the Farm Products Agencies Act footnote c;

And whereas CFC has been empowered to implement a marketing plan under that Proclamation;

Therefore, Chicken Farmers of Canada makes the annexed Regulations Amending the Canadian Chicken Licensing Regulations under paragraph 22(1)(f) of the Farm Products Agencies Act footnote c and section 11footnote d of the schedule to the Chicken Farmers of Canada Proclamation footnote a.

Regulations Amending the Canadian Chicken Licensing Regulations

Amendments

1 (1) Subsection 5(3) of the Canadian Chicken Licensing Regulations footnote 1 is amended by adding the following after paragraph (e):

(2) Paragraph 5(3)(i) of the Regulations is amended by striking out “and” at the end of subparagraph (vii) and by adding the following after that subparagraph:

(3) Paragraph 5(3)(i.01) of the Regulations is amended by striking out “and” at the end of subparagraph (vi), by adding “and” at the end of subparagraph (vii) and by adding the following after subparagraph (vii):

(4) Section 5 of the Regulations is amended by adding the following after subsection (3):

(3.1) If the market development licensee establishes, before marketing chicken under the licence, that they cannot comply with the conditions set out in paragraphs (3)(e.1) and (e.2) and subparagraphs (3)(i)(vii.1) and (vii.2) because doing so would render it impossible for them to comply with the regulatory requirements of the jurisdiction in which the chicken is to be marketed, CFC must

2 Paragraph 2(b) of Schedule 1 to the Regulations is replaced by the following:

(b) as one of the product categories set out in column 1 of the table to section 1 of Schedule 2 to the Canadian Chicken Licensing Regulations, that is not derived from mature chicken or spent fowl and whose outer shipping packaging and accompanying documentation bear the word “broiler” or any other word allowed by CFC under paragraph 5(3.1)(a) of those Regulations, unless CFC provided an exemption under paragraph 5(3.1)(b); and

3 Schedule 2 to the Regulations is amended by replacing the references after the heading “SCHEDULE 2” with the following:

(Paragraphs 5(3)(d) and (e), subparagraph 5(3)(i.01)(vii) and section 1 and paragraphs 2(b) and (c) of Schedule 1)

Coming into Force

4 These Regulations come into force on the day on which they are registered.

EXPLANATORY NOTE

(This note is not part of the Regulations.)

This amendment is to implement a requirement that all chicken marketed under the market development program be identified as “broiler,” except specialty chicken, and to allow Chicken Farmers of Canada (CFC) to approve alternative terminology, or where necessary grant an exemption, when compliance with the requirement would conflict with the regulatory requirements of the jurisdiction in which the chicken is marketed.
