Her Excellency the Governor General in Council, on the recommendation of the Minister of Finance, makes the annexed Order Amending the United States Surtax Remission Order (2025) under section 115footnote a of the Customs Tariff footnote b.

Order Amending the United States Surtax Remission Order (2025)

Amendments

1 The United States Surtax Remission Order (2025) footnote 1 are amended by adding the following after section 4.3:

Remission — goods referred to in Schedule 6

4.4 Subject to section 5, remission is granted of surtaxes paid or payable under the United States Surtax Order (Steel and Aluminum 2025) in respect of the goods that are classified under a tariff classification number set out in Schedule 6.

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the orders.)

Issues

The Government of Canada has imposed tariffs on certain U.S.-made goods and indicated it would consider remission requests related to these surtaxes. Time-limited, horizontal surtax remission or exemption has also been implemented to provide targeted relief for certain categories of products subject to tariffs imposed on certain U.S.-made goods or steel derivative goods, which are subject to expiry in the near term.

Background

U.S. surtax and remission

On March 4, 2025, the United States (U.S.) imposed tariffs of 25% on U.S. imports from Canada, with energy products subject to a 10% tariff (since amended to include potash), under the International Emergency Economic Powers Act (IEEPA), further to alleged concerns about border security and the flow of fentanyl. On March 7, the U.S. provided an exemption under the IEEPA tariffs for imports from Canada that qualify for preferential treatment under the Canada-United States-Mexico Agreement (CUSMA) [i.e. are “CUSMA-compliant”]. On March 12, 2025, the United States imposed further tariffs of 25% on certain Canadian steel and aluminum products. On April 3, 2025, the United States imposed global tariffs of 25% on imports of passenger vehicles and light trucks. In the case of Canada (and Mexico), these auto tariffs apply in full to non-CUSMA compliant vehicles but apply only to the value of non-U.S. content of CUSMA compliant vehicles.

Canada has responded to these tariffs by introducing a suite of countermeasures. On March 4, 2025, the Government of Canada imposed 25% tariffs on $30 billion in goods imported from the United States. On March 13, 2025, the Government of Canada imposed 25% tariffs on an additional $29.8 billion in steel, aluminum, and other products imported from the United States in response to U.S. tariffs against Canadian steel and aluminum products. In addition, on April 9, 2025, the Government of Canada imposed 25% tariffs on non-CUSMA compliant U.S.-made light vehicles, and on the non-Canadian and non-Mexican content of CUSMA compliant U.S.-made light vehicles.

These surtaxes are implemented through three separate regulations the United States Surtax Order (2025-1), the United States Surtax Order (Steel and Aluminum 2025), and the United States Surtax Order (Motor Vehicles 2025), made pursuant to section 53 of the Customs Tariff.

Public consultations held in the context of these surtaxes confirmed stakeholder support for these countermeasures as a necessary response to U.S. tariffs. However, some stakeholders noted concerns with their ability to shift supply chains due to factors such as no or limited alternative sources of supply (short supply), or the requirement for certain products to comply with certification requirements, product specifications or contractual requirements, requiring Canadian businesses to purchase U.S. products.

On March 4, 2025, the Government announced a framework and process for how it will consider remission requests for the tariffs on products from the United States. Under specific circumstances, remission allows for relief from the payment of surtaxes, or the refund of surtaxes already paid. Remission represents an exception to the rules by providing for relief of otherwise applicable duties. Therefore, the Government only considers remission where it is required to address exceptional and compelling circumstances that, from a public policy perspective, are found to outweigh the primary rationale behind the application of the tariffs.

On April 16, 2025, Canada implemented the United States Surtax Remission Order (2025), which provides temporary, horizontal relief for any goods imported by or on behalf of public health, public safety, or national-security entities, as well as certain goods deemed necessary for public health and health care. The Order also provides relief for any goods used as inputs in Canadian manufacturing, processing, or food and beverage packaging. Horizontal remission under this Order was initially set to expire on October 15, 2025, but was subsequently extended to December 15, 2025, and was expanded to cover goods used in agricultural production.

The United States Surtax Remission Order (2025) was also amended on June 26, 2025, October 15, 2025, and February 5, 2026, to provide additional relief from tariffs for certain goods found to be in short supply and for companies facing exceptional circumstances.

On August 22, 2025, Canada announced that it would remove its counter tariffs on U.S. goods, with the exception of those on steel, aluminum and autos, as of September 1, 2025. Further to this announcement, counter tariffs put in place in March 2025 were removed for most U.S. imports, via the Order Amending and Repealing Certain Orders Made Under the Customs Tariff (United States Surtax).

On December 11, 2025, the Order Amending the United States Surtax Remission Order (2025) implemented decisions on horizontal remission announced by the Prime Minister on November 26, 2025, as part of a package of measures to support the steel industry. It extended the temporary horizontal remission of counter-tariffs on U.S. steel goods used for manufacturing, processing, food and beverage packaging and agricultural production in Canada to January 31, 2026, for steel, and to June 30, 2026, for aluminum. Horizontal remission for all goods used for the manufacturing of motor vehicles, aerospace goods, and their parts was extended to June 30, 2026, as was the remission of goods used for public health, health care, public safety and national security purposes.

Steel derivative goods surtax

On December 26, 2025, the Steel Derivative Goods Surtax Order implemented a global surtax of 25% on certain steel derivative products that fall under a tariff classification set out in Schedule 1 to the Order. The Order includes exemptions for several categories of goods, including goods for use in the manufacturing of motor vehicles or aerospace goods, and their related parts, when imported before July 1, 2026. This exemption is consistent with the relief from U.S. surtaxes provided to these sectors under the United States Surtax Remission Order (2025) and serves to support the competitiveness of these sectors.

The automotive and aerospace sectors operate within highly integrated, certification-driven supply chains that limit the ability of firms to adjust sourcing in response to surtaxes. These factors significantly limit the ability of firms to rapidly adjust sourcing decisions in response to surtaxes.

In addition, the application of surtaxes to derivative goods may, in certain circumstances, result in surtaxes being imposed on goods that originate in Canada but are temporarily exported, such as for minor processing, and subsequently reimported. Certain stakeholders have noted the importance of ensuring that Canadian-origin goods are not subject to surtaxes when reimported into Canada.

Regulatory development

Consultation

On March 4, 2025, Canada announced a public comment period with respect to the potential application of tariffs on a wide range of imports from the United States, including auto imports. From March 4 to April 2, 2025, Canada’s public comment period resulted in extensive stakeholder input and feedback, with nearly 7 000 written submissions.

Canadian businesses, stakeholders, and partners generally confirmed their support for Canada’s surtaxes on certain U.S. goods. However, some stakeholders noted concerns about their ability to shift supply chains away from the United States due to limited alternative sources of supply (short supply), the requirement for certain inputs complies with certification requirements, product specifications or contractual obligations.

On March 4, 2025, the Government of Canada also published on the Department of Finance’s website a notice explaining the remissions framework and process under which remission could be provided for surtaxes imposed on imports from the U.S. Since that time, the Department has received a very high volume of requests from businesses seeking relief from the surtaxes on U.S. imports.

Further, Canadian producers were consulted on supply conditions in Canada in respect of the goods claimed to be in short supply by the remission requestors. Their views informed the short supply determinations made with respect to surtax remission being granted for goods in Schedule 2 and Schedule 3. Consultations with Canadian stakeholders were also undertaken in respect of relief extended in Schedule 6.

From March 22 to April 21, 2025, the Government of Canada held public consultations on possible trade measures to protect against the threat of diversion of steel products from third countries into the Canadian market. The implementation of the steel derivative surtax was informed by comments received from Canadian manufacturers of those products, either as part of the steel trade diversion consultations or submissions sent by stakeholders to the Government on a proactive basis. Canadian steel mill producers support the surtax on certain steel derivative products given the use of Canadian steel by Canadian manufacturers of derivative products.

Indigenous engagement, consultation and modern treaty obligations

Following an assessment of modern treaty implications, no adverse impacts on potential or established Indigenous or treaty rights, which are recognized and affirmed in section 35 of the Constitution Act, 1982, were identified in the orders.

Instrument choice

The Order Amending the United States Surtax Remission Order (2025) is implemented under section 115 of the Customs Tariff, which provides the authority for the Governor in Council to remit surtaxes on the recommendation of the Minister of Finance.

The Steel Derivative Goods Surtax Order is implemented under subsection 53(2) of the Customs Tariff, which provides the authority for the Governor in Council, on the recommendation of the Minister of Finance and the Minister of Foreign Affairs, by order, to make goods that originate in any country subject to a surtax for the purpose of responding to acts, policies or practices of a country that adversely affect, or lead directly or indirectly to adverse effects on, trade in goods or services of Canada.

Benefits and costs

Order Amending the United States Surtax Remission Order (2025)

This Order is a relieving mechanism to the benefit of industry impacted by the U.S. surtaxes.

Remission granted through Schedules 2, 3, 4 and 4.1 follows the assessment of remission requests received from Canadian importers seeking surtax relief on goods imported from the United States. These remission requests have been assessed in accordance with the published remission framework, and remission is provided where warranted due to conditions of short supply, preexisting contractual obligations, and exceptional circumstances requiring lead time for Canadian businesses to adjust their supply chains to the surtaxes. Items listed in Schedules 2 and 3 of the United States Surtax Remission Order (2025) are goods that are used as inputs for further manufacturing and processing in Canada and are not reasonably available from any other alternative sources globally. In the absence of remission, Canadian businesses that use these goods would have to pay for the surtax, which would increase production costs and harm their competitiveness. Depending on the product, these costs could ultimately be passed on to Canadian consumers or downstream producers. These Schedules mitigate this issue by providing remission for such goods, regardless of the importer or the company using them.

Goods listed in Schedule 4 and 4.1 of the United States Surtax Remission Order (2025) have been identified as items for which company-specific relief is warranted, for example, where a contract is in place requiring Canadian businesses to purchase U.S. inputs, or companies are facing exceptional circumstances, and more time is required to switch suppliers to avoid significant adverse impacts on the Canadian economy. In these cases, remission allows additional time for companies to fulfill original contracts or switch suppliers without being unduly burdened by surtaxes.

Goods listed in Schedule 6 are steel mill products that have been confirmed as not being produced in Canada. The extension of remission to these goods will further reduce the unintended cost burden of the steel surtaxes for downstream producers, while maintaining the protective effect of the surtax on steel goods that are produced domestically.

Extending horizontal remission for a one-year period will support businesses operating in the context of ongoing trade disruptions and address challenges in respect of investment decision-making and supply chain planning. The extension of the duration of remission provided under the horizontal elements of the United States Surtax Remission Order (2025) will provide continued surtax relief for stakeholders in the public health, public safety, and national security sectors as well as aluminum importers with Canadian operations in manufacturing, processing, food and beverage packaging or agricultural production. Extending the duration of relief will also support the operations of Canadian businesses in the automobile and aerospace sectors that rely on U.S. imports.

For importations made after the date of entry into force of this amending Order, the administrative costs for Canadian businesses to claim remission of the surtaxes are expected to be limited. Remission claims can be made for each applicable importation as part of the process of filling existing customs documentation requirements. The importer will be required to include one extra code on their usual import document. As in all cases, the importer must maintain records supporting their importation (e.g. related to tariff classification, entitlement to a tariff preference, and entitlement to the remission). There would be minimal incremental costs for the Government to process the claims.

Importers requesting a refund for goods imported prior to the entry into force of this amending Order will submit forms to the Canada Border Services Agency (CBSA), accompanied by supporting documentation, establishing that the imported goods qualify for remission. There would be minimal incremental costs for industry to supply the documentation and for the Government to process the claims.

Order Amending the Steel Derivative Goods Surtax Order (2025)

This Order is a relieving mechanism to the benefit of certain companies and sectors impacted by the steel derivative goods surtaxes.

The change to extend the horizontal exemption for a one-year period under the Steel Derivative Goods Surtax Order will provide continued relief to businesses in the automobile and aerospace sectors, while also ensuring that horizontal relief under the U.S. steel surtax and global steel derivative surtax remains consistent and aligned.

Exempting goods originating in Canada from the steel derivatives surtaxes ensures that surtaxes do not apply to domestic production that may be temporarily exported and reimported. This reduces unintended cost burdens on Canadian producers and enhances the competitiveness of Canadian manufacturing.

Goods eligible for these exemptions will incur no surtax liability upon importation, meaning that importers will not be required to claim remission. If surtaxes were paid on goods previously imported, which are now eligible for an exemption, importers can seek a refund by filing a correction or an adjustment with the CBSA.

Small business lens

Analysis under the small business lens concluded that the Order Amending the United States Surtax Remission Order (2025) will impact small businesses. Some of the importers meet the definition of “small business” in the Policy on Limiting Regulatory Burden on Business (the Policy), and the process to claim remission of duties paid meets the definition of “administrative burden” set out in the Policy. No additional flexibility is necessary for small businesses claiming remission, as all eligible importers already possess the original customs forms required to justify remission and will benefit from the remitted funds.

Analysis under the small business lens concluded that the Order Amending the Steel Derivative Goods Surtax Order will not impact small businesses, since these exemptions fully waive the surtax liability and do not require companies to claim remission.

One-for-one rule

These orders relate to tax administration and are exempt from the requirement to offset administrative burden and regulatory titles under the one-for-one rule. The requirement for Canadian importers to submit claims for remission meets the Red Tape Reduction Act definition of administrative burden on businesses. However, duties are considered to be “taxes” for the purpose of the one-for-one rule and the associated administration has been exempted from the offset requirement.

Regulatory cooperation and alignment

The amending orders are not related to a work plan or commitment under a formal regulatory cooperation forum.

Effects on the environment

In accordance with the Cabinet Directive on Strategic Environmental and Economic Assessment, a preliminary scan concluded that these orders would not result in positive or negative environmental effects; therefore, a strategic environmental and economic assessment is not required.

Gender-based analysis plus (GBA+)

No impacts based on gender and other identity factors have been identified for these orders.

Implementation, compliance and enforcement, and service standards

The CBSA will assess any claims for remission made pursuant to the United States Surtax Remission Order (2025) and will ensure compliance with their terms and conditions in the normal course of its administration of customs and tariff-related legislation and regulations. In doing so, the existing administrative framework will be leveraged to ensure that costs can be managed within existing resources. Any refund issued pursuant to this amending Order will be administered by the CBSA. Depending on the volumes and complexity of refund submissions, the CBSA strives to achieve a 90-day processing standard.

Goods eligible for an exemption from the Steel Derivative Goods Surtax Order will not incur a surtax liability, so the CBSA will not be required to administer remission claims for importers of these goods. Nonetheless, importers may seek reimbursement of surtaxes paid on goods imported prior to entry into force of this Order. Where reimbursements are required, the CBSA will leverage its existing administrative framework.
