Her Excellency the Governor General in Council, on the recommendation of the Minister of Fisheries and Oceans, makes the annexed Regulations Amending the Fishing and Recreational Harbours Regulations (Miscellaneous Program) under paragraph 9(a) of the Fishing and Recreational Harbours Actfootnote a.

Coming into Force
5 These Regulations come into force on the day on which they are registered.
REGULATORY IMPACT ANALYSIS STATEMENT
(This statement is not part of the Regulations.)
Issues
As a result of the divestiture of 62 harbours by Fisheries and Oceans Canada (DFO) and the acquisition of 3 harbours in Canada, the list of harbours identified in Schedule I of the Fishing and Recreational Harbours Regulations (FRHR) is being updated.
Objective
The amendments will ensure that the FRHR continue to accurately reflect the harbours that are owned and managed by DFO and are subject to the FRHR.
They meet the requirements of the miscellaneous programs, as they
- repeal obsolete or spent regulatory provisions that have no current application; and
- update references to names of companies, locations, titles of office holders or similar items.
Description and rationale
The amendments remove 62 harbours from various provinces in Schedule I as follows:
Ontario (9), Quebec (11), Nova Scotia (8), New Brunswick (2), Manitoba (1), British Columbia (2), Prince Edward Island (3), Alberta (2), Newfoundland and Labrador (24).
The amendments add three harbours to various provinces in Schedule I as follows:
Manitoba (1), Saskatchewan (1), Nunavut (1).
The amendments also make the following corrections to the name or location of five harbours already in Schedule I:
- British Columbia
- Item 1455: the name is changed from “Opitsat” to “Opisaht” to be consistent with the spelling commonly used in that area.
- Prince Edward Island
- Item 1560: the name is changed from “French River” to “French River - North Landing” to differentiate from other areas.
- Saskatchewan
- Item 1632: the name is changed from “Wollaston Lake” to “Wollaston Lake (Hidden Bay)” to differentiate from other areas.
- Newfoundland and Labrador
- Item 1672: the name is changed from “Bauline East” to “Bauline South” to be consistent with the official name of the community.
- Northwest Territories
- Item 2125: the name is changed from “Hay River” to “Hay River (East Channel)” to differentiate from other areas.
All of the above-described amendments are administrative in nature. They serve to update Schedule I of the FRHR to reflect harbour divestitures and acquisitions that have already happened and correct names or locations of currently listed harbours. They do not impose any costs on the Government or stakeholders.
One-for-one rule and small business lens
The one-for-one rule does not apply to these amendments, as there is no change in administrative costs or burden to businesses.
Analysis under the small business lens determined that the amendments will not impact small businesses in Canada.
