Proposal

The Governor in Council, considering that it is in the public interest to do so, on the recommendation of the Treasury Board and the Minister of Citizenship and Immigration, pursuant to subsection 23(2.1) of the Financial Administration Act, has made the Fee Paid or Payable for the Acquisition of Permanent Resident Status (Sudan) Remission Order (the Remission Order).

Objective

The objective of the Remission Order is to remit the fee for the acquisition of permanent resident status (the right of permanent residence fee) that was not collected from foreign nationals whose application for permanent residence was approved under

Background

As part of the Government of Canada’s response to the conflict in Sudan, the Minister of Citizenship and Immigration introduced the Family-based permanent residence pathway for people affected by the conflict in Sudan to help reunite people affected by the conflict with their family members in Canada.

Immigration, Refugees and Citizenship Canada (IRCC) did not collect the right of permanent residence fee for all principal applicants and their eligible accompanying family members approved for permanent residence or a permanent residence visa under this pathway. This fee is normally payable for the rights and privileges associated with becoming a permanent resident in Canada, with some persons exempted from paying this fee, including dependent children of a principal applicant. Not collecting this fee for all applicants approved under this pathway was determined to be in the public interest in recognition of the potential financial vulnerability of these individuals and the additional undue financial and administrative burden the fee would have imposed in reuniting them with their family members in Canada.

The total estimated foregone revenues from remitting these fees is $3,666,200, including $695,750 for individuals admitted to Canada under this pathway up to August 31, 2025, and up to $2,970,450 for estimated admissions after August 31, 2025.

The Minister of Citizenship and Immigration does not have the legal authority to waive the right of permanent residence fee in a public policy; therefore, the fee is still legally payable under the Immigration and Refugee Protection Regulations. An Order in Council is needed to allow for the remission of this fee.

Implications

The remission of fees incurred from not collecting the right of permanent residence fee for eligible applicants under the family-based permanent resident pathway for people affected by the conflict in Sudan results in foregone revenues to the Government of Canada, as these fees will not be collected.
