Whereas the Governor in Council is of the opinion that the actions of the Russian Federation constitute a grave breach of international peace and security that has resulted in a serious international crisis;
Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Foreign Affairs, makes the annexed Regulations Amending the Special Economic Measures (Russia) Regulations under paragraph 4(1)(a)footnote a and subsections 4(1.1)footnote b, (2)footnote c and (3) of the Special Economic Measures Act footnote d.
Regulations Amending the Special Economic Measures (Russia) Regulations
Amendments
1 The Special Economic Measures (Russia) Regulations footnote 1 are amended by adding the following after section 3.05:
Coal
3.051 (1) It is prohibited for any person in Canada and any Canadian outside Canada to import, purchase or acquire any good referred to in column 1 of Schedule 5.01, wherever situated, from Russia or from any person in Russia.
Non-application
(2) Subsection (1) does not apply in respect of goods exported from Russia at least 60 days before the day on which this section comes into force.
Non-application — contracts
(3) Subsection (1) does not apply in respect of goods that meet all of the following conditions:
- (a) the goods are imported, purchased or acquired under a contract entered into at least 60 days before the day on which this section comes into force;
- (b) the goods are imported, purchased or acquired within 120 days after the day on which this section comes into force.
Jet fuel and additives
3.052 (1) It is prohibited for any person in Canada and any Canadian outside Canada to export, sell, supply or ship any good referred to in column 1 of Schedule 5.02, wherever situated, to Russia or to any person in Russia.
Non-application
(2) Subsection (1) does not apply in respect of usual and reasonable quantities of goods stored on board an aircraft and intended for consumption on board the aircraft during its outgoing and return flight.
Non-application — contracts
(3) Subsection (1) does not apply in respect of goods that meet all of the following conditions:
- (a) the goods are exported, sold, supplied or shipped under a contract entered into at least 60 days before the day on which this section comes into force;
- (b) the goods are exported, sold, supplied or shipped within 120 days after the day on which this section comes into force.
2 Subsection 3.08(5) of the Regulations is repealed.
3 (1) The marginal note to subsection 3.09(1) of the Regulations is replaced by “Industrial goods”.
(2) Subsection 3.09(2) of the Regulations is amended by striking out “and” at the end of paragraph (k), by adding “or” at the end of paragraph (l) and by adding the following after paragraph (l):
- (m) goods for use in relation to the urgent prevention or mitigation of an event likely to have a serious and significant impact on human health and safety, infrastructure or the environment.
(3) Subsection 3.09(3) of the Regulations is repealed.
(4) Section 3.09 of the Regulations is amended by adding the following after subsection (3):
Non-application — contracts
(4) Subsection (1) does not apply in respect of goods that meet all of the following conditions:
- (a) the goods were not referred to in Schedule 7 as it read immediately before the day on which this subsection comes into force;
- (b) the goods are referred to in Schedule 7 as it reads on the day on which this subsection comes into force;
- (c) the goods are exported, sold, supplied or shipped under a contract entered into at least 60 days before the day on which this subsection comes into force;
- (d) the goods are exported, sold, supplied or shipped within 120 days after the day on which this subsection comes into force.
4 Subsection 3.11(3) of the Regulations is repealed.
5 The Regulations are amended by adding the following after section 3.13:
Related chemicals — chemical weapons and biological weapons
3.131 (1) It is prohibited for any person in Canada and any Canadian outside Canada to export, sell, supply or ship any good referred to in column 1 of Part 1 of Schedule 10.1, wherever situated, to Russia or to any person in Russia.
Related goods — chemical weapons and biological weapons
(2) It is prohibited for any person in Canada and any Canadian outside Canada to export, sell, supply or ship any good referred to in Part 2 or 3 of Schedule 10.1, wherever situated, to Russia or to any person in Russia.
Non-application
(3) Subsections (1) and (2) do not apply in respect of
- (a) goods for use in support of international nuclear safeguards verifications;
- (b) goods for use in inspections under the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction, signed at Paris, France, on January 13, 1993, as amended from time to time;
- (c) the following goods, if stored on board an aircraft or ship:
- (i) equipment and spare parts that are necessary for the proper operation of the aircraft or ship, or
- (ii) usual and reasonable quantities of supplies that are intended for consumption on board the aircraft or ship during the outgoing and return flight or voyage;
- (d) goods exported for use or consumption on an aircraft or ship that is registered in Canada or the United States; or
- (e) goods for use in relation to the urgent prevention or mitigation of an event likely to have a serious and significant impact on human health and safety, infrastructure or the environment.
6 Section 3.14 of the Regulations is replaced by the following:
Metals
3.14 (1) It is prohibited for any person in Canada and any Canadian outside Canada to import, purchase or acquire any good referred to in column 1 of Part 1 or 2 of Schedule 11 from Russia or from any person in Russia.
Non-application
(2) Subsection (1) does not apply to goods if a contract for the import, purchase or acquisition of the goods is entered into before March 10, 2023.
Non-application — newly added goods
(3) Subsection (1) does not apply in respect of goods that meet all of the following conditions:
- (a) the goods were not referred to in Schedule 11 as it read immediately before the day on which this subsection comes into force;
- (b) the goods are referred to in Schedule 11 as it reads on the day on which this subsection comes into force;
- (c) the goods are exported from Russia at least 60 days before the day on which this subsection comes into force.
Non-application — contracts
(4) Subsection (1) does not apply in respect of goods that meet all of the following conditions:
- (a) the goods were not referred to in Schedule 11 as it read immediately before the day on which this subsection comes into force;
- (b) the goods are referred to in Schedule 11 as it reads on the day on which this subsection comes into force;
- (c) the goods are imported, purchased or acquired under a contract entered into at least 60 days before the day on which this subsection comes into force;
- (d) the goods are imported, purchased or acquired within 120 days after the day on which this subsection comes into force.
7 The Regulations are amended by adding the following after section 3.15:
Revenue-generating goods
3.16 (1) It is prohibited for any person in Canada and any Canadian outside Canada to import, purchase or acquire any good referred to in column 1 of Schedule 13, wherever situated, from Russia or from any person in Russia.
Non-application
(2) Subsection (1) does not apply in respect of
- (a) goods exported from Russia at least 60 days before the day on which this section comes into force; or
- (b) personal effects taken by an individual leaving Russia that are solely for the use of the individual or the individual’s immediate family.
Non-application — contracts
(3) Subsection (1) does not apply in respect of goods that meet all of the following conditions:
- (a) the goods are imported, purchased or acquired under a contract entered into at least 60 days before the day on which this section comes into force;
- (b) the goods are imported, purchased or acquired within 120 days after the day on which this section comes into force.
8 Section 5 of the Regulations is replaced by the following:
Assisting in prohibited activities
5 It is prohibited for any person in Canada and any Canadian outside Canada to knowingly do anything that causes, facilitates or assists in, or is intended to cause, facilitate or assist in, any activity prohibited by these Regulations.
9 Part 1 of Schedule 1 to the Regulations is amended by adding the following in numerical order:

Application Before Publication
17 For the purpose of paragraph 11(2)(a) of the Statutory Instruments Act, these Regulations apply according to their terms before they are published in the Canada Gazette.
Coming into Force
18 (1) Subject to subsections (2) and (3), these Regulations come into force on the day on which they are registered.
(2) Section 5 comes into force on the 30th day after the day on which these Regulations are registered.
(3) Sections 1 to 4, 6 to 8 and 13 to 16 come into force on the 60th day after the day on which these Regulations are registered.

Issues
Russia is developing sensitive technologies, including quantum technologies, to increase its military capabilities and gain a technological advantage. In the context of Russia’s unlawful war against Ukraine, this poses a threat to Ukrainian, European and Canadian security interests. Quantum technology provides for enhanced technological capabilities that lend themselves to significant dual-use capabilities in military and defence contexts, as is most visible in quantum cryptography and encryption but is also relevant in quantum optics and sensors. These advancements contribute to threatening international peace and security, and the current security architecture of the G7, including Canada.
More broadly, Russia’s capacity to wage war is in part dependent upon the ability of its manufacturing industries to access input materials, machinery and other ancillary items. Manufacturing accounts for around 12% of Russia’s economy. Manufactured products drive wider economic activity, all of which is taxed by the Russian government and contributes to Russia’s war economy. Many manufactured products are also used in the production and support of the Russian military industrial base, and in various weapons technologies or systems, such as chemical weapons (of which there is extensive evidence of Russian use in its war in Ukraine).
To further limit its ability to wage its unjustified war, additional amendments to the Special Economic Measures (Russia) Regulations (the Russia Regulations) are needed to sanction new individuals and entities, as well as restrict the export and import of certain goods and technologies to and from Russia.
Background
On February 24, 2022, Russia initiated an unjustified full-scale military invasion of Ukraine, launching combined attacks (from land, air and sea) on many cities, which violates the United Nations Charter and international law. Three and a half years later, Russia continues to wage a war of aggression against Ukraine and to commit atrocities against Ukrainians.
Experts from the Organization for Security and Co-operation in Europe Moscow Mechanism fact-finding missions, the Independent International Commission of Inquiry on Ukraine and the United Nations Office of the High Commissioner for Human Rights have concluded that Russia is committing serious human rights violations, war crimes, possible crimes against humanity and conflict-related sexual violence. As of April 2025, the UN Human Rights Monitoring Mission in Ukraine has confirmed that at least 13 134 civilians have been killed and over 31 867 were injured since February 24, 2022. Furthermore, 790 medical facilities and 1 670 educational facilities in Ukraine have been damaged or destroyed by Russia’s military since the invasion.
To fund its unjustified war in Ukraine, the Kremlin has reshaped its economy, making its growth dependent on military spending and is also seeking greater self-sufficiency in strategic areas, such as sensitive technology. At a recent meeting of the Commission on Military-Technical Cooperation with Foreign States on May 23, 2025, President Putin articulated Russia’s plan for the renewal of its military, through AI-enabled military technologies, military-technical cooperation with other states and the mastery of dual-use goods.
A prominent example of this work is Russia’s investment in developing quantum technology — a sensitive technology with many dual-use military capabilities. Specifically, Russia’s Quantum Roadmap strategy illustrates the Kremlin’s desire to prioritize and build primacy in quantum technologies. The Quantum Roadmap is discussed conceptually in multiple forums, including at the yearly Future Technologies Forum by President Putin. The strategy discusses milestones planned through 2030 that outline grants to, and partnerships with, academia and industry in order to further quantum development in Russia. If successful, these plans would ultimately greatly enhance Russian military capabilities. The strategy, led and funded by Russian state corporations and incorporating a large consortium of companies and institutions, seeks to leverage government funding and grant programs, repatriated academics, and the Russian tech sector to realize these plans.
International response
The coalition of countries supporting Ukraine includes, but is not limited to, the G7 and European countries. This group is working to support Ukraine across a number of areas, including by contributing to energy security, nuclear safety, food security, humanitarian assistance, combatting Russian disinformation, imposing sanctions and economic measures, asset seizure and forfeiture, military assistance, ensuring accountability and fostering socio-economic recovery and reconstruction.
Certain countries have not participated in sanctions efforts targeting Russia in the wake of the 2022 invasion of Ukraine and appear to be directly and indirectly supplying goods and services that would otherwise be prohibited by coordinated international sanctions.
Canada’s response
Canada unequivocally condemns Russia’s unjustified and egregious actions. Following Russia’s unjustified occupation and attempted annexation of Crimea in March 2014, the Government of Canada, in tandem with like-minded countries, enacted sanctions through the regulations under the Special Economic Measures Act (SEMA). These sanctions impose dealings prohibitions (an effective asset freeze) on listed individuals and entities supporting or enabling Russia’s violation of Ukraine’s sovereignty. Any person in Canada and Canadians outside Canada are prohibited from dealing in the property of, entering into transactions with, providing services to, or otherwise making goods available to persons listed under schedules 1, 2 or 3 of the Russia Regulations. It is prohibited for any person in Canada and Canadians outside Canada to provide services in relation to ships in Schedule 1.1. It is also prohibited for these ships from entering or passing through Canada.
Since 2014, in coordination with its partners, Canada has imposed sanctions on more than 3 000 individuals and entities in Russia, Belarus, Ukraine and Moldova. This includes sanctions addressing Russian networks in third countries, as well as entities that are supporting Russia in these regions. Canada has also implemented targeted restrictions against Russia and Belarus in the financial, trade (goods and services), energy and transport sectors. Similarly, targeted sanctions are continually being developed and applied targeting Russia’s defence industrial base and sensitive technology sectors that contribute to Russia’s military capacity and capabilities. Canada is part of the Oil Price Cap Coalition, the G7 diamond import ban and ongoing efforts to use the proceeds from Russian sovereign assets to help Ukraine. Canada is steadfast in its commitment to support Ukraine’s sovereignty, territorial integrity, independence, and its efforts toward a just and sustainable peace.
Objective
- Expose, disrupt and hinder networks developing Russian sensitive dual-use technologies — and furthering their development — that are being leveraged by the Kremlin to pursue a technological and military advantage in its war against Ukraine.
- Reduce Russia’s ability to finance its unjustified war against Ukraine by impeding its generation of revenue through additional export and import prohibitions.
- Limit the supply of any technical goods to Russia that may contribute to the development of sensitive technologies or support the Russian defence industrial base.
- Provide stronger and more effective measures in responding to Russia’s actions in Ukraine, as well as Russia’s actions abroad that further its foreign policy objectives in Ukraine, by coordinating Canada’s measures with those taken by international partners.
Description
The Regulations Amending the Special Economic Measures (Russia) Regulations (the amendments) add three individuals and 14 entities to Schedule 1 of the Russia Regulations. The individuals include heads of the sanctioned Russian Quantum Centre and lead developers of quantum technology in Russia. The entities include leading quantum research facilities in Russia and research labs that develop the quantum field in Russia, as well as quantum tech companies that are developing quantum technologies’ practical applications in collaboration with the Russian Quantum Centre.
The amendments also expand the aliases for entities already listed to ensure that all known aliases are covered in the Russia Regulations. Specifically, the Russian Quantum Centre will be listed as an alias for the International text-center for Quantum Optics and Quantum Technologies LLC — the former being most commonly used. Further, several known aliases are added for Federal Joint Venture Quantum Technologies, one of the key entities behind Russia’s quantum program.
In alignment with Canada’s like-minded partners, the amendments also impose new measures that prohibit any Canadian and persons in Canada from the export, sale, supply or shipment of the following items to Russia or any person in Russia:
- goods related to the production of chemical and biological weapons;
- jet fuel and additives;
- goods related to Russian industrial and economic processes, including input materials and industrial machinery (these include but are not limited to salts, earths, stone, mineral products, chemicals, dyes, paints, plastics, rubber, wood, paper, textiles, ceramics, metals, articles of metals, tools, machinery, vehicles and precision instruments); and
- high tech and advanced materials related to Russia’s military activities and development of sensitive technology.
In addition, the amendments prohibit any Canadian and persons in Canada from importing, purchasing or acquiring the following items from Russia or any person in Russia:
- coal;
- metals;
- a wide range of other goods which Russia exports overseas to generate revenue, including but not limited to chemicals, chemical products, plastics, wood, wood products, machinery, precision instruments and furniture (the full list can be found in Schedule 13 of the Russia Regulations).
Any person in Canada or Canadians outside Canada is prohibited from dealing in the property of, entering into transactions with, providing services to, transferring property to, or otherwise making goods available to listed persons (individuals and entities) — unless explicitly authorized by a permit granted on an exceptional basis or an exception in the Russia Regulations. Listed individuals are also rendered inadmissible to Canada under the Immigration and Refugee Protection Act (IRPA).
Under the Russia Regulations, listed persons may apply to the Minister of Foreign Affairs to have their name removed from the Schedule of designated persons. The Minister must determine whether there are reasonable grounds to make a recommendation to the Governor in Council for removal. Information on the delisting application process is available on the Global Affairs Canada’s (GAC) website.
Regulatory development
Consultation
GAC regularly engages with relevant stakeholders, including civil society organizations, cultural communities and other like-minded governments regarding Canada’s approach to sanctions implementation.
New sanctions measures are not prepublished in the Canada Gazette, Part I, and public consultation would not have been appropriate for these amendments. Publicizing the names of the listed persons targeted by sanctions could have resulted in asset flight and sanctions evasion prior to the coming into force of the amendments, which could compromise Canada’s foreign policy objectives.
Modern treaty obligations and Indigenous engagement and consultation
In accordance with the Cabinet Directive on the Federal Approach to Modern Treaty Implementation, an analysis was undertaken to determine whether the amendments to the Russian Regulations are likely to give rise to modern treaty obligations. The assessment examined the geographic scope and subject matter of the amendments in relation to modern treaties in effect and no modern treaty obligations were identified.
Instrument choice
The imposition of sanctions against foreign states and non-state actors is a key tool for the international community to support peace and security, and enforce international norms and laws. The Parliament of Canada has enacted legislation authorizing the imposition of sanctions through the United Nations Act, the SEMA and the Justice for Victims of Corrupt Foreign Officials Act (Sergei Magnitsky Law).
Canada has established a rigorous due diligence process to consider and evaluate possible cases that may warrant the use of sanctions. Given the elements proposed in the package, the SEMA was identified as the instrument of choice.
Sanctions measures under the SEMA are imposed by the Governor in Council, on the recommendation of the Minister of Foreign Affairs, through a regulatory process. The Russia Regulations are therefore the only available legal instrument for these amendments. No other instrument could be considered.
Regulatory analysis
Benefits and costs
These amendments to the Russia Regulations will strengthen existing economic measures against Russia, constrain Russia’s ability to finance and resource its unjustified war in Ukraine, and discourage individuals and entities from contributing, directly or indirectly, to Russia’s war efforts. By imposing these sanctions, Canada signals its strong condemnation of Russia’s ongoing behaviour and contributes to efforts to disrupt Russia’s war economy and bring pressure to end the war and the violation of Ukraine’s sovereignty.
Sanctions targeting specific persons have less impact on Canadian businesses than traditional broad-based economic sanctions. Moreover, such amendments have more limited impact on the citizens of the country of the listed persons. Based on an initial assessment of available open-source information and consultations within the Government of Canada, it is believed that the individuals and entities listed have limited linkages with Canada and, therefore, do not have business dealings that are significant to the Canadian economy. It is therefore anticipated that there will be no significant impacts on Canadians and/or Canadian businesses as a result of amendments listing entities and individuals.
The Government of Canada has consistently signalled its objection to Russia’s invasion of Ukraine through the imposition of increasingly severe economic measures. As a result of sanctions imposed by Canada, two-way trade between Canada and Russia has fallen by more than 95% since 2021. Businesses continuing to operate in such an environment therefore face inherent business risks and uncertainty.
According to trade data from Statistics Canada, Canadian exports to Russia of the goods that will be prohibited for export by these amendments represented $2.7 million in 2024. Any Canadian exporter who needs to find new markets for these products will incur some adjustment costs and possibly some business losses, although this will be mitigated by the delayed coming into force periods and prior contract exceptions. The categories of these goods that featured the highest 2024 export values are self-adhesive plastics ($1.9 million exports to Russia, comprising 0.96% of total exports of these items, with major alternative markets in the United States, the United Kingdom and France); machinery for working rubber or plastics ($63,000 in exports to Russia, comprising 0.08% of total exports of these items, with major alternative markets in the United States, China and Mexico); typewriter or similar ribbons ($59,000 in exports to Russia, comprising 0.19% of total exports of these items, with major alternative markets in the United Stated, Türkiye and Australia); and luminaires and lighting fittings ($23,000 in exports to Russia, comprising 0.00% of total exports of these items, with major alternative markets in the United States, Germany and the United Kingdom). The main provinces from which these goods were exported were Quebec ($2.4 million) and Ontario ($931,000).
Canadian imports of the goods that are now prohibited for import by these amendments represented $12.6 million in 2024. Any Canadian importer who needs to source these products from elsewhere will likely incur some adjustment costs, although this will be mitigated by the delayed coming into force periods and prior contract exceptions. The categories of these goods that featured the highest 2024 import values are plywood ($11.7 million in imports from Russia, comprising 1.9% of total imports of these items, with major alternative sources in China, the United States and Vietnam); certain mechanical parts ($1.3 million in imports from Russia, comprising 0.03% of total imports of these items, with major alternative sources in the United States, China and Japan), rubber tires ($394,000 in imports from Russia, comprising 0.01% of total imports of these items, with major alternative sources in the United States, China and Japan), electrical control boards, panels, consoles, desks, cabinets or other bases ($320,000 in imports from Russia, comprising 0.01% of total imports of these items, with major alternative sources in the United States, Mexico and Germany); and centrifuges ($310,000 in imports from Russia, comprising 0.01% of total imports of these items, with major alternative sources in the United States, China and Mexico). The main provinces from which these goods were imported were Quebec ($5.5 million) and Ontario ($5.3 million). Over 50% of the importing companies were wholesalers. There is no indication of any significant Canadian industry reliance on Russia for imports of these specific items.
Due to the absence of sufficient firm-level data, likely adjustment costs for Canadian businesses have not been fully evaluated. Nonetheless, there will likely be economic impacts for specific Canadian companies. However, the amendments include delayed coming into force dates and temporary exceptions for contracts established prior to the registration of the new prohibitions that are expected to help mitigate these impacts by providing some time for Canadian companies to adjust (e.g. to find replacement markets and sources). Based on the relatively low volume of affected goods currently traded with Russia, it is assumed that most impacted Canadian business will be able to find alternative markets and sources.
Canadian banks and financial institutions are required to comply with sanctions. They will do so by adding the newly listed individuals and entities to their existing monitoring systems, which will result in a minor compliance cost. As of August 2024, financial institutions must report transactions suspected of being related to sanction evasion to the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC). Financial institutions also have other legal obligations with respect to monitoring and reporting of relevant property ownership, export and import of goods and other activities in connection with sanctioned individuals and entities. Canadian importers and exporters will need to ensure they continue to check their intended imports and exports against the lists of prohibited items in the Russia Regulations. The amendments could create additional costs for businesses seeking permits that would authorize them to carry out import and/or export transactions that would be otherwise prohibited.
The incremental cost to the Government of Canada to administer and enforce these additional prohibitions will be minimal. The Canada Border Services Agency (CBSA) is expected to incur incremental costs associated with screening incoming and outgoing shipments for compliance with the new prohibitions. The Royal Canadian Mounted Police (RCMP), Immigration, Refugees and Citizenship Canada, and other departments and agencies may incur a small cost to update their relevant systems to include the persons and goods listed through the amendments.
Small business lens
Analysis under the small business lens concludes that the amendments could impact Canadian small businesses. The amendments listing new individuals and entities do not impose any new compliance or administrative burden on small businesses in Canada. However, these amendments prohibit Canadian businesses from dealing with, providing services to, or otherwise making goods available to the listed persons, but do not create obligations related to them. The additional goods prohibited for import and export could impact Canadian small businesses, which would face adjustment costs if they currently export or import the newly prohibited goods to or from Russia. GAC does not have data available to fully assess the extent to which these prohibitions will impact small businesses.
Alternative compliance options for small businesses would not be possible because the amendments are intended to prohibit trade with Russia in specific goods in order to reduce Russia’s ability to finance its war efforts through import/export revenues. However, GAC recognizes that businesses, irrespective of size, will require time to implement these changes and, therefore, the amendments provide some transition time (e.g. a delayed coming into force) for businesses to comply with new requirements.
Canadian businesses may seek permits under the Special Economic Measures Permit Authorization Order to allow them to perform a specified activity prohibited in the Russia Regulations. Those permits are granted on an exceptional basis. GAC does not anticipate any applications resulting from listing these persons as the Department’s assessment has not identified business dealings that are significant to Canada’s economy. In relation to prohibitions on the import and export of goods, as noted above, the Russian markets for exports and sources for imports represent a very small proportion of the global market, and GAC has not identified any significant Canadian industry reliance on Russia for imports of these specific items. Nevertheless, there will be adjustment costs for some Canadian businesses, including small businesses. While a delayed coming into force and prior contract exceptions provide time for adjustment, some Canadian businesses affected by the prohibitions may apply for permits.
Canadian small businesses are also subject to the duty to disclose under the Russia Regulations, which would represent a direct compliance requirement. However, as the newly listed persons have no known legitimate linkages with Canada, GAC does not anticipate any disclosures resulting from the amendments.
One-for-one rule
The one-for-one rule does not apply, as there is no incremental change in the administrative burden on business. The permitting process for businesses meets the definition of “administrative burden” in the Red Tape Reduction Act; however, while permits may be granted under the Special Economic Measures Permit Authorization Order on an exceptional basis, it is possible that some businesses currently exporting or importing newly prohibited items to and from Russia will seek permits to continue such activity. However, given analysis suggesting that there is no reliance on such items it is more likely that businesses will turn to alternate markets than attempt to continue trade with Russia via seeking a permit.
Regulatory cooperation and alignment
While the amendments are not related to a work plan or commitment under a formal regulatory cooperation forum, they align with actions taken by Canada’s partners and like-minded partners. Sanctions are most effective when they are applied in a coordinated manner and Canada is working to harmonize efforts internally and with partners to facilitate a unified front on sanctions.
Canada’s international partners continue to update their sanctions regimes against individuals and entities in Russia and enforce far-reaching financial, trade and investment prohibitions on Russia. Countries and jurisdictions that have sanctioned individuals and entities related to Russia’s gross and systematic violations of human rights, as well as infringing of Ukraine’s sovereignty and territorial integrity, include Australia, the European Union, Japan, New Zealand, Switzerland, the United Kingdom and the United States. Some of the persons proposed for listing in the amendments have been subject to sanctions by like-minded nations. The goods prohibited for import and export by the amendments are also prohibited by the European Union and the United Kingdom, and many of them are also prohibited by the United States, Japan and others.
International obligations
Compliance with Canada’s international obligations was considered in the development of the amendments.
Effects on the environment
The amendments are unlikely to result in important environmental effects. In accordance with the Cabinet Directive on Strategic Environmental and Economic Assessment (SEEA Directive), a preliminary scan concluded that a strategic environmental and economic assessment is not required.
Gender-based analysis plus
None of the newly listed individuals have Canadian citizenship; as a result, the scope of the gender-based analysis plus (GBA+) is limited.
The subject of economic sanctions has previously been assessed for effects on gender and diversity. Although intended to facilitate a change in behaviour through economic pressure on individuals and entities in foreign states, sanctions under the SEMA can nevertheless have an unintended impact on certain vulnerable groups and individuals. Rather than affecting Russia as a whole, these targeted sanctions impact individuals believed to be engaged in activities that directly or indirectly support, provide funding for or contribute to a violation of the sovereignty or territorial integrity of Ukraine. Therefore, these sanctions are unlikely to have a significant impact on vulnerable groups as compared to traditional broad-based economic sanctions directed toward a state. In so far as sanctions limit Russia’s ability to wage war, individuals vulnerable to gender-based discrimination and children are likely to benefit from these measures.
Implementation, compliance and enforcement, and service standards
The amendments listing individuals and entities come into force on the day they are registered.
The prohibitions will apply to any person (individual or entity) in Canada as well as Canadians outside of Canada. For goods related to the production of chemical and biological weapons, the prohibition will come into force 30 days after the amendments to the Russia Regulations are registered. All the other prohibitions will come into force 60 days following registration. In addition, for an additional 120 days, these prohibitions, except for the chemical and biological weapons related ones, will not apply to an activity (e.g. export or import) necessary to satisfy contracts that were in place prior to registration. This is to allow time for industry to understand and adjust to the amendments.
Consequential to being listed in the Russia Regulations, and pursuant to the application of paragraph 35.1(b) of the IRPA, the listed individuals would be inadmissible to Canada.
The names of the listed individuals and entities will be available online for financial institutions to review and will be added to the Consolidated Canadian Autonomous Sanctions List. This will help persons in Canada and Canadians outside of Canada to comply with the Russia Regulations.
Information about items prohibited for export and import will be available online on the sanctions page of GAC’s website for businesses to review. This will help to facilitate compliance with the Russia Regulations. The CBSA is responsible for screening for sanctioned goods at the border. For exports, the CBSA has advised that the additional trade prohibitions will not impose additional resource burdens given the limited overall trade with Russia and given the high level of scrutiny on all trade with Russia that is already performed. For imports, the additional prohibitions are expected to impose additional resource burdens given additional screenings that will be required for incoming goods. GAC will work with the CBSA to ensure that existing tools and resources are used to support any additional enforcement requirements. Shipments intercepted for suspected non-compliance may be detained by a CBSA officer until the officer is satisfied that the import or export of the goods complies with all applicable requirements, which may include the Russia Regulations. Goods found to be non-compliant will be prohibited for import into or export from Canada.
The Trade Commissioner Service at GAC, abroad and in Canada, continues to assist clients in understanding Canadian sanctions regulations, notably the impact of regulations on any activities in which Canadians may be engaged. GAC is also increasing outreach efforts across Canada through presentations and other events — including engaging with businesses, universities, and provincial and territorial governments — to enhance national awareness of and compliance with Canadian sanctions.
Under the SEMA, both RCMP and CBSA officers have the power to enforce sanctions violations through their authorities as defined under the Customs Act, the Excise Act or the Excise Act, 2001, and sections 487 to 490, 491.1 and 491.2 of the Criminal Code. The RCMP and the CBSA, as well as other government departments, including Public Safety Canada, Innovation, Science and Economic Development Canada, Natural Sciences and Engineering Research Council of Canada, Immigration, Refugees and Citizenship Canada and Transport Canada, were consulted in the development of the amendments.
In accordance with section 8 of the SEMA, every person who knowingly contravenes or fails to comply with the Russia Regulations is liable, upon summary conviction, to a fine of not more than $25,000 or to imprisonment for a term of not more than one year, or to both: or, upon conviction on indictment to imprisonment for a term of not more than five years.
