FARM PRODUCTS AGENCIES ACT

Whereas the Governor in Council has, by the Canadian Pork Promotion-Research Agency Proclamation footnote a, established the Canadian Pork Promotion-Research Agency under subsection 39(1)footnote b of the Farm Products Agencies Act footnote c;

Whereas that Agency has been empowered to implement a promotion and research plan under that Proclamation;

Whereas the proposed Order Amending the Canadian Pork Promotion-Research Levies Order is an order of a class to which paragraph 7(1)(d)footnote d of that Act applies, by reason of section 2 of the Agencies’ Orders and Regulations Approval Order footnote e, and has been submitted to the National Farm Products Council under paragraph 42(1)(d)footnote b of that Act;

And whereas, under paragraph 7(1)(d)footnote d of that Act, the National Farm Products Council has approved the proposed Order after being satisfied that it is necessary for the implementation of the promotion and research plan that that Agency is authorized to implement;

Therefore, the Canadian Pork Promotion-Research Agency makes the annexed Order Amending the Canadian Pork Promotion-Research Levies Order under paragraphs 42(1)(d)footnote b and (e)footnote b of the Farm Products Agencies Act footnote c and section 9 of the schedule to the Canadian Pork Promotion-Research Agency Proclamation footnote a.

Order Amending the Canadian Pork Promotion-Research Levies Order

Amendments

1 (1) The definition produit du porc importé in section 1 of the French version of the Canadian Pork Promotion-Research Levies Order footnote 1 is replaced by the following:

Produit du porc qui est importé au Canada et classé sous un ou plusieurs des numéros tarifaires du Tarif des douanes figurant à l’annexe 2. (imported pork product)

(2) Section 1 of the Order is amended by adding the following in alphabetical order:

imported hog
means a hog that is imported into Canada and classified under one of the Customs Tariff tariff item numbers set out in Schedule 1.1. (porc importé)

2 Section 12 of the Order is replaced by the following:

Levy — importer

12 Each importer must pay to the Agency, for each imported hog or imported pork product, a levy in the amount set out in Schedule 1.

3 Paragraph 13(2)(b) of the Order is replaced by the following:

4 Section 16 of the Order is replaced by the following:

Cessation of effect

16 Sections 4 and 12 cease to have effect on June 30, 2026.

5 The Order is amended by adding, after Schedule 1, the Schedule 1.1 set out in the schedule to this Order.

6 Schedule 2 to the Order is amended by deleting the following:

Coming into Force

7 This Order comes into force on the day on which it is registered.

EXPLANATORY NOTE

(This note is not part of the Order.)

These amendments add the definition of “imported hog” under section 1, modify the placement of the list of imported hogs from Schedule 2 to the new Schedule 1.1, amend paragraph 13(2)(b) to reflect the new Schedule 1.1 and set June 30, 2026, as the date on which the levies cease to have effect.
