FARM PRODUCTS AGENCIES ACT

Whereas the Governor in Council has, by the Canadian Egg Marketing Agency Proclamation footnote a, established the Canadian Egg Marketing Agency under subsection 16(1)footnote b of the Farm Products Agencies Act footnote c;

Whereas that Agency has been empowered to implement a marketing plan under that Proclamation;

Whereas that Agency has complied with the requirements of section 4footnote d of Part II of the schedule to that Proclamation;

Whereas the proposed Regulations Amending the Canadian Egg Marketing Agency Quota Regulations, 1986 and the Canadian Egg Marketing Levies Order are regulations of a class to which paragraph 7(1)(d)footnote e of that Act applies, by reason of section 2 of the Agencies’ Orders and Regulations Approval Order footnote f, and have been submitted to the National Farm Products Council under paragraph 22(1)(f) of that Act;

And whereas, under paragraph 7(1)(d)footnote e of that Act, the National Farm Products Council has approved the proposed Regulations after being satisfied that they are necessary for the implementation of the marketing plan that that Agency is authorized to implement;

Therefore, the Canadian Egg Marketing Agency makes the annexed Regulations Amending the Canadian Egg Marketing Agency Quota Regulations, 1986 and the Canadian Egg Marketing Levies Order under paragraph 22(1)(f) of the Farm Products Agencies Act footnote c and sections 2 and 10 of Part II of the schedule to the Canadian Egg Marketing Agency Proclamation footnote a.

Canadian Egg Marketing Agency Quota Regulations, 1986

1 The definition egg for processing quota in section 2 of the Canadian Egg Marketing Agency Quota Regulations, 1986 footnote 1 is repealed.

2 (1) Paragraph 4(1)(a) of the Regulations is replaced by the following:

(2) Paragraph 4(1)(b) of the English version of the Regulations is replaced by the following:

(3) Paragraphs 4(1)(c) and (d) of the Regulations are replaced by the following:

3 Section 5.1 of the Regulations and the heading before it are replaced by the following:

Entitlement to Special Temporary Market Requirement Quota and Vaccine Quota

5.1 A producer is entitled to be allotted a special temporary market requirement quota or a vaccine quota if the producer has been allotted, or would be entitled to be allotted, a federal quota under these Regulations.

4 Subsection 7.1(1) of the Regulations is repealed.

5 Schedule 1.2 to the Regulations is repealed.

Canadian Egg Marketing Levies Order

6 Section 2 of the Canadian Egg Marketing Levies Order footnote 2 is replaced by the following:

2 Subsection 3(1) does not apply in respect of eggs marketed under a special temporary market requirement quota that is allotted under the Canadian Egg Marketing Agency Quota Regulations, 1986.

7 Subsection 3(3) of the Order is repealed.

Coming into Force

8 These Regulations come into force on December 29, 2024.
