Amendments

Issues

The Office of the Indian Registrar has received resolutions from the councils of nine First Nations listed in the schedule to the First Nations Fiscal Management Act, six First Nations listed in schedules to the Indian Bands Council Elections Order, which is made pursuant to the Indian Act, and from the councils of two First Nations listed in the schedule to the First Nations Elections Act, regarding changes they would like to see in how the names of their respective First Nations are recorded in the Indian Registration System and in those schedules.

Objective

The amendments have the following objectives:

Description and rationale

In alignment with and in response to requests made by the respective First Nations, changes are made to their names in the schedules to the First Nations Elections Act and the First Nations Fiscal Management Act, as well as to the Indian Bands Council Elections Order.

Amendments to the schedules are being made to achieve consistency with the Indian Registration System, as well as to prevent confusion as to the applicability of the legislation and statutory instrument to a specific First Nation. Additionally, amending federal legislation and statutory instruments to reflect First Nations’ current names is a respectful step consistent with a nation-to-nation relationship and reconciliation.

One-for-one rule and small business lens

The one-for-one rule does not apply to these amendments, as there is no change in administrative costs or burden to businesses.

The small business lens does not apply to these amendments, as there are no costs to small businesses.
