Her Excellency the Governor General in Council, on the recommendation of the Public Service Commission, makes the annexed Regulations Repealing the Communications Security Establishment Appointments Regulations (Miscellaneous Program) under section 21 of the Public Service Employment Act footnote a.

Repeal

1 The Communications Security Establishment Appointments Regulations footnote 1 are repealed.

Coming into Force

2 These Regulations come into force on the day on which they are registered.

Issues

As a result of the coming into force of the Communications Security Establishment Act (CSEA) on August 1, 2019, certain regulations previously made under the Public Service Employment Act (PSEA) — namely, the Communications Security Establishment Exclusion of Positions and Employees Approval Order (the Order) and the Communications Security Establishment Appointments Regulations (the Regulations) — have lapsed and must be repealed.

Objective

The objective of this initiative is to repeal the Order and the Regulations given the enabling authority is now under the CSEA.

Description and rationale

The PSEA provides the framework for the staffing system of the federal public service. In April 1975, the Order was made to exclude employees and positions of the Communications Security Establishment (CSE) from most of the provisions of the PSEA; the Regulations were also made at that time to authorize the Deputy Minister of the Department of National Defence to appoint persons to the CSE.

As of August 1, 2019, with the coming into force of the CSEA, the Chief of the CSE has been conferred management and control authorities of the CSE, including exclusive appointment authorities. Therefore, their appointments are not subject to the PSEA. Consequently, the Deputy Minister of the Department of National Defence no longer has appointment authorities for the CSE.

The Order Repealing the Communications Security Establishment Exclusion of Positions and Employees Approval Order (Miscellaneous Program) and the Regulations Repealing the Communications Security Establishment Appointments Regulations (Miscellaneous Program) come into force on the day on which they are registered.

As this is a repeal of statutory instruments whose provisions are no longer in application, there has been no prepublication in the Canada Gazette, Part I.

One-for-one rule and small business lens

The one-for-one rule applies since two regulatory titles are removed, and the initiative is considered two titles out.

Analysis under the small business lens determined that the initiative will not impact small businesses in Canada.
