Her Excellency the Governor General in Council, on the recommendation of the Minister of Fisheries and Oceans, makes the annexed Regulations Amending Certain Department of Fisheries and Oceans Regulations (Miscellaneous Program) under subsection 43(1)footnote a of the Fisheries Act footnote b and section 6footnote c of the Coastal Fisheries Protection Act footnote d.

Atlantic Fishery Regulations, 1985
1 The portion of subsection 3(1) of the English version of the Atlantic Fishery Regulations, 1985 footnote 1 before paragraph (a) is replaced by the following:
3 (1) Subject to subsections (2) and (3), these Regulations apply to the management and control of fishing for the species of fish that are set out in Schedule I and that originate from
2 Subsection 17(2.1) of the English version of the Regulations is replaced by the following:
(2.1) Subject to subsections (2.2) and (2.3), if a commercial fishing licence authorizes the taking of specific quantities of any species set out in Part II of Schedule II, the fee for the licence shall be the sum of the products determined by multiplying the number of tonnes of each species set out in column I of Part II that are authorized to be taken under the licence from the waters set out in column II by the fee per tonne set out in column III.
3 The definition mussel in section 51 of the Regulations is replaced by the following:
- mussel
- means the shellfish the scientific name of which is Mytilus edulis, Mytilus trossulus or Modiolus modiolus; (moule)
4 Subsection 87(1) of the Regulations is replaced by the following:
87 (1) Subject to section 90, no person shall fish for a species of groundfish set out in column I of Schedule XXIII in a Stock Area set out in column II from a vessel of a vessel class set out in column III during the close time set out in column IV.
5 Paragraph 91(3)(b) of the English version of the Regulations is replaced by the following:
- (b) not more than one Atlantic halibut.
6 Subsection 106(2) of the Regulations is replaced by the following:
(2) If a person is the owner of a vessel less than 15.2 m in overall length, that person may, subject to these Regulations, use that vessel to fish with an otter trawl in the waters set out in item 4, column I, of Schedule XXXI during the period from September 1 to December 31.

Pacific Fishery Regulations,1993
13 (1) The definitions bait herring and fish landing station in subsection 2(1) of the Pacific Fishery Regulations, 1993 footnote 2 are repealed.
(2) The definitions owner and trap in subsection 2(1) of the Regulations are replaced by the following:
- owner,
- in respect of a vessel, means the person or aboriginal organization, as defined in section 2 of the Aboriginal Communal Fishing Licences Regulations, in whose name the vessel is registered; (propriétaire)
- trap
- means an enclosure that is designed to catch fish but does not include a trawl net or a purse seine; (casier)
(3) The definitions distance entre la ralingue et la nappe, parc à harengs and senne traînante in subsection 2(1) of the French version of Regulations are replaced by the following:

(4) Subsection 2(1) of the Regulations is amended by adding the following in alphabetical order:
- dip net
- means a bag-like net, fixed to a frame to which a handle is attached, that is used to catch fish without enmeshing them; (épuisette)
- licensed facility
- means
- (a) a facility used by a person who holds a licence issued under the British Columbia Fish and Seafood Act, SBC 2015, c. 14, as amended from time to time, for the purpose of carrying out activities authorized by the licence, whether or not the facility is specifically referenced in the licence; or
- (b) a vessel in respect of which a licence has been issued under subsection 18(4);
- purse seine
- means a net that is drawn around a school of fish and then closed at the bottom by means of a line passing through rings attached along the lower edge of the net; (senne coulissante)
14 Paragraph 6(a) of the French version of the Regulations is replaced by the following:
- a) de pêcher des poissons en les casaquant ou en utilisant des collets.
15 (1) Paragraph 17(1)(a) of the Regulations is replaced by the following:
- (a) a licensed facility;
(2) Paragraph 17(1)(c) of the Regulations is replaced by the following:
- (c) a vehicle whose operator holds a licence that is issued under the British Columbia Fish and Seafood Act, SBC 2015, c. 14, as amended from time to time, and that authorizes the holder to receive commercially caught fish.
(3) Subsection 17(3) of the Regulations is replaced by the following:
(3) An operator of a vehicle referred to in paragraph (1)(c) shall not off-load any salmon or roe herring received from a registered vessel at any place other than a licensed facility.
(4) The portion of subsection 17(4) of the Regulations before paragraph (b) is replaced by the following:
(4) The operator of a licensed facility at which salmon or roe herring is off-loaded shall
- (a) provide information respecting each off-loading by completing the form supplied by the Minister for that purpose;
(5) Paragraph 17(4)(d) of the Regulations is replaced by the following:
- (d) provide a copy of the completed form to a representative of the Department when requested to do so.
16 Subsection 19(3) of the Regulations is replaced by the following:
(3) If an Indian or the Northern Native Fishing Corporation is issued a Category A licence in respect of a vessel, the Indian or the Corporation must elect to pay either the applicable fee set out in subitem 3(1) of Part I of Schedule II or the applicable fee set out in subitem 3(2) of that Part.
17 Paragraph 20(2)(a) of the Regulations is replaced by the following:
- (a) the vessel registration certificate and all licences issued in respect of the vessel shall be returned to the Minister within seven days after the day on which the certificate becomes invalid; and
18 Section 25 of the English version of the Regulations is replaced by the following:
25 A person who is 16 years of age or older shall not engage in commercial fishing or be on board a vessel that is being used in commercial fishing unless they hold a fisher’s registration card.
19 Subsection 41(2) of the French version of the Regulations is replaced by the following:

20 (1) Subsection 54(1) of the English version of the Regulations is replaced by the following:
54 (1) Where a close time set out in Part I of Schedule VI is varied pursuant to section 6 of the Fishery (General) Regulations to permit salmon fishing by gill net, the notice referred to in section 7 of the Fishery (General) Regulations shall specify one of the gill net mesh sizes set out in column I, one of the maximum gill net depth limits set out in column II, one of the maximum gill net hang ratios set out in column III, one of the minimum corkline to web distances set out in column V and one of the maximum corkline to web distances set out in column VI of the table to this section.
(2) Paragraph 54(2)(e) of the French version of the Regulations is replaced by the following:
- e) la distance entre la ralingue et la nappe est inférieure à la distance entre la ralingue et la nappe minimale ou est supérieure à la distance entre la ralingue et la nappe maximale indiquée sur l’avis.
(3) The headings of columns V and VI of the table to section 54 of the French version of the Regulations are replaced by “Distance entre la ralingue et la nappe minimale” and “Distance entre la ralingue et la nappe maximale”, respectively.
(4) The table to section 54 of the English version of the Regulations is amended by replacing “1.2 m 1.5 m” in columns V and VI opposite “Not exceeding 133 mm” in column I with “1.2 m”.
(5) The table to section 54 of the English version of the Regulations is amended by replacing “2.0 m” in columns V and VI opposite “Not exceeding 137 mm” in column I with “1.5 m”.
(6) The table to section 54 of the English version of the Regulations is amended by adding a reference to “2.0 m” in column V opposite “Not exceeding 140 mm” in column I.
(7) The table to section 54 of the English version of the Regulations is amended by adding a reference to “2.0 m” in column VI opposite “Not exceeding 140 mm” in column I.
21 The portion of subsection 57(1) of the Regulations before the table is replaced by the following:
57 (1) No person shall fish for salmon in the waters set out in column I of the table to this section during the close time set out in column II from a vessel where the aggregate length of gill net on the drum or drums of the vessel and in the water is greater than the net length set out in column III.
22 The definition longueur in subsection 60(1) of the French version of the Regulations is replaced by the following:
- longueur

45 Section 20 of the French version of the Coastal Fisheries Protection Regulations footnote 5 is replaced by the following:

Issues
The Standing Joint Committee for the Scrutiny of Regulations (SJCSR) has recommended that miscellaneous minor amendments be made to a number of regulations made under the Fisheries Act, and the Coastal Fisheries Protection Act. In addition, in the course of applying the regulations, the Department of Fisheries and Oceans of Canada has become aware of additional non-substantive amendments that are required to be made to the above-mentioned regulations.
The regulatory amendments will ensure that each of the regulations is accurate and operates as intended.
Objective
The objectives of the regulatory amendments are to
- respond to recommendations made by the SJCSR;
- ensure that the regulations are clear, accurate, and serve to minimize the possibility of misinterpretation of their regulatory requirements;
- update the regulations to reflect current terminology and remove any outdated references;
- repeal obsolete or spent regulatory provisions that have no current application;
- correct discrepancies between the French and English versions;
- harmonize terms used in the regulations with those used in the enabling statute or related regulations;
- correct typographical or grammatical errors; and
- add definitions for terms used in the regulations.
Description and rationale
Numerous minor and administrative amendments are proposed for various regulations made under the Fisheries Act and the Coastal Fisheries Protection Act.
The amendments encompass the following.
Fisheries Act
Atlantic Fishery Regulations, 1985 (AFR, 1985)
The amendments to the Atlantic Fishery Regulations, 1985 ensure that the Regulations are clear, accurate, and serve to minimize the possibility of misinterpretation of their regulatory requirements; update the Regulations to reflect current terminology and remove any outdated references; repeal obsolete or spent regulatory provisions that have no current application; correct discrepancies between the French and English versions; add clarity to a regulatory provision; and correct typographical or grammatical errors.
Maritime Provinces Fishery Regulations (SOR/93-55)
The amendment to the Maritime Provinces Fishery Regulations removes an outdated reference.
Saskatchewan Fishery Regulations, 1995 (SOR/95-233)
The amendment to the Saskatchewan Fishery Regulations, 1995, responds to a recommendation made by the SJCSR. The amendment corrects a typographical error.
Pacific Fishery Regulations, 1993 (SOR/93-54)
The amendments to the Pacific Fishery Regulations, 1993, correct typographical or grammatical errors; correct discrepancies between the French and English versions; remove obsolete references; add definitions for terms used in the Regulations; ensure that the Regulations are clear, accurate, and serve to minimize the possibility of misinterpretation of their regulatory requirements; and respond to other recommendations made by the SJCSR.
Coastal Fisheries Protection Act
Coastal Fisheries Protection Regulations (C.R.C., c. 413)
The amendment to the Coastal Fisheries Protection Regulations responds to a recommendation made by the SJCSR. The amendment corrects a discrepancy between the French and English versions.
One-for-one rule and small business lens
The one-for-one rule does not apply to these amendments, as there is no change in administrative costs or burden to business.
Analysis under the small business lens determined that the amendments will not impact small businesses in Canada.
