Her Excellency the Governor General in Council, on the recommendation of the Minister of Crown-Indigenous Relations, under section 7 of An Act to give effect to the Anishinabek Nation Governance Agreement, to amend the Sechelt Indian Band Self-Government Act and the Yukon First Nations Self-Government Act and to make related and consequential amendments to other Acts, chapter 9 of the Statutes of Canada, 2022, fixes October 1, 2022 as the day on which Part 1 of that Act comes into force, other than section 6, which came into force on assent.
EXPLANATORY NOTE
(This note is not part of the Order.)
Proposal
This Order-in-Council fixes October 1, 2022, as the day on which Part 1, other than section 6, of An Act to give effect to the Anishinabek Nation Governance Agreement, to amend the Sechelt Indian Band Self-Government Act and the Yukon First Nations Self-Government Act and to make related and consequential amendments to other Acts comes into force.
Objective
The objective is to fix, under section 7 of An Act to give effect to the Anishinabek Nation Governance Agreement, to amend the Sechelt Indian Band Self-Government Act and the Yukon First Nations Self-Government Act and to make related and consequential amendments to other Acts, chapter 9 of the Statutes of Canada, 2022, October 1, 2022, as the day on which Part 1 of that Act comes into force, other than section 6, which came into force on assent.
Background
- On April 6, 2022, the Anishinabek Nation Governance Agreement (the Governance Agreement) was signed by the Minister of Crown-Indigenous Relations, the Grand Council Chief of the Anishinabek Nation and five First Nations (Nipissing, Magnetawan, Moose Deer Point, Wahnapitae and Zhiibaahaasing).
- The Governance Agreement provides for the establishment and operations of two levels of Anishinabek self-governance, specifically a central Anishinabek Nation Government, and the local governments of the five First Nations.
- These structures are reflective of the Anishinabek Nation’s culture, and community interests, and effectively transition them away from the Indian Act.
- The Governance Agreement will also provide for Anishinabek Nation and First Nation law making authority in areas of core governance, i.e. leadership selection, citizenship, language and culture, and the management and operations of government.
- The enabling legislation for the Governance Agreement was introduced in the Senate on June 9, 2022, it was passed in the House of Commons on June 22, 2022, and received royal assent on June 23, 2022.
Implications
There are no financial implications associated with the Order-in-Council.
Consultation
Canada consulted the Anishinabek Nation and First Nations extensively while negotiating the Governance Agreement. Further, the Anishinabek Nation and signatory First Nations were consulted on the Governance Agreement’s enabling legislation.
