His Excellency the Administrator of the Government of Canada in Council, on the recommendation of the Minister of Transport, pursuant to section 4.9 footnote a of the Aeronautics Act footnote b, makes the annexed Regulations Amending the Canadian Aviation Regulations (Miscellaneous Program, 2021-1).

Amendments

1 (1) Paragraph 202.15(3)(c) of the Canadian Aviation Regulations footnote 1 is replaced by the following:

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Issues

The need for a number of minor technical amendments to the Canadian Aviation Regulations (CARs) has been identified through the Aviation Safety Regulatory Review Initiative. Inconsistencies and discrepancies were identified by the Standing Joint Committee on the Scrutiny of Regulations; through internal consultations carried out by Transport Canada Civil Aviation in 2015 and 2016; through a 2013 national consultation; through recommendations from the 2016 Emerson report; and through an ongoing online consultation initiative, TC's Let's Talk Modernizing the Canadian Aviation Regulations.

These amendments represent a housecleaning phase of the modernization of the CARs, which addresses administrative, non-controversial, no-cost issues with the CARs. This regulatory proposal corrects minor discrepancies between the English and French versions of the CARs, eliminates spent provisions, and corrects references to names, grammar, and spelling.

Objective

The regulatory amendments have the following objectives:

Description and rationale

These regulatory amendments better align the English and French versions of the CARs and correct references to names, eliminate spent regulations and correct grammatical errors.

Remove provisions which are no longer relevant

Subsection 202.15(4): This provision is being removed, as the Canadian Civil Aviation Register Computer System does not indicate any foreign entities that have aircraft registered prior to September 1990. It is impossible for any new entity to meet the criteria of CAR subsection 202.15(4), making this provision no longer relevant.

Subsection 401.12(5) and subsection 402.08(4): These sections are being repealed, as the regulation regarding the validity of air traffic controller licences has been spent for nearly 10 years.

The heading after section 401.47: The heading after paragraph 401.47(b) “Period of Validity” is being repealed, as there are no provisions listed under the heading.

Grammar and reference corrections

Paragraph 202.15(3)(c): The reference to subsection 202.15(4) is being removed from this paragraph, as this subsection is being repealed.

Section 203.05; subsections 401.05(1), 401.05(2), 602.19(1), 602.36(2), and 602.73(4); section 602.116; and subsections 602.117(1), 602.128(4), 605.08(1), and 605.08(2): The amendment is replacing “notwithstanding” with “despite” in the relevant provisions, as “notwithstanding” is not considered to be plain language.

Paragraph (c) of the definition “flight instructor experience” in subsection 400.01(1); subsection 400.01(3); paragraph 401.05(3)(b); clause 401.05(3)(c)(iii)(D); paragraph 404.16(b); and paragraph 602.144(1)(a): The amendments are updating references by replacing “Canadian Forces” with “Canadian Armed Forces”.

Subparagraph 705.175(d)(vi): The amendment is updating the reference to the “Canadian Aviation Security Regulations” with the “Canadian Aviation Security Regulations, 2012”. Revisions to the Canadian Aviation Security Regulations resulted in its name change to Canadian Aviation Security Regulations, 2012. Also, the amendment is updating a reference to section 64 of the Canadian Aviation Security Regulations with section 543 of the Canadian Aviation Security Regulations, 2012 to ensure consistency with the numbering in the Canadian Aviation Security Regulations, 2012.

Section 801.11: Table 3 is being amended to add Montréal International (Mirabel) as item number 8 in recognition of the re-opening of the Mirabel control tower at the beginning of 2020. Control tower services are already being offered at Mirabel, so this change will not result in any incremental impacts.

Correct discrepancies between English and French and grammar in the French version of the CARs

Paragraph 302.202(4)(b): The amendment is correcting a discrepancy between the English and French versions of the Regulations. Presently, the phrase “at least once a year” in the French version (“au moins une fois l'an”) applies only to the obligation to make any required updates to the emergency plan. The amendment changes the French version to “faire l'examen du plan d'urgence et, s'il y a lieu, le mettre à jour au moins une fois par an après avoir consulté un échantillon représentatif des exploitants aériens qui utilisent l'aéroport et les organismes communautaires qui figurent dans le plan d'urgence” to clarify that the airport operator must review the emergency plan and make required updates at least once a year.

A second amendment to paragraph 302.202(4)(b) is correcting terminology used in the French version to ensure consistency with other areas of the Regulations. The phrase “une fois l'an” in the French version appears to be an unusual equivalent of the English term “once a year”. The formulation “une fois par an” is the French equivalent more commonly used, and will, therefore, replace the phrase “une fois l'an”.

Subparagraph 401.05(3)(c)(i): The amendment is correcting the wording in the French version to ensure alignment with the English version. This amendment better represents the true policy intent by altering a phrase which is wrongly worded in the French version. The English version requires that the tasks be representative (“tasks representative of those required”), whereas the French version requires that the number of tasks be representative (“consistait en un nombre représentatif de tâches”). The French wording is amended to state “consistait en des tâches représentatives”.

Paragraph 401.37(1)(b), subparagraph 401.37(1)(b)(ii), subsection 401.37(2), paragraph 401.53(1)(b), subparagraph 401.53(1)(b)(ii) and subsection 401.53(2): The amendment is correcting the wording in the French version to ensure that all references to “contrôle de compétence” is replaced by the phrase “vérification de compétences” to ensure consistency throughout the Regulations. Currently, the Regulations use the terms “contrôle de compétence” and “vérification de compétences” interchangeably as the equivalent of “competency check”, which could create ambiguity, so the French version is amended to refer only to “vérification de compétences”.

Section 501.03: The amendment is modifying the wording of the French version to represent the true policy intent, which is reflected in the English version. The French version of this section is missing words that would convey the notion of “beforehand”, which is included in the English version. This amendment modifies the wording in the French version from “convenue entre le propriétaire et le ministre” to “convenue au préalable entre le propriétaire et le ministre”.

Subparagraph 521.357(1)(a)(v): The amendment is updating the French version to ensure consistency with the English version and to reflect the true policy intent of the provision. The amendment replaces the reference to “les renseignements consignés à l'alinéa 521.365a)” with “les renseignements consignés en application de l'alinéa 521.365a)” to better reflect the English version, which says, “the information recorded under paragraph 521.365(a)”.

Subparagraph 703.08(g)(ix.1): The amendment is correcting the terminology used between the English and French by modifying the term “navigation system authorizations”. Currently, the French version states “les autorisations relatives au système de navigation”; this is amended to state “les autorisations concernant le système de navigation”.

Subparagraph 704.47(2)(a)(v): The amendment is correcting a grammatical error to keep the text consistent with other provisions in the CARs. The amendment replaces the phrase “de la composante vent arrière signalée” with “du vent arrière signalé”.

Section 901.64: The amendment is correcting the wording in the French provision to ensure that the wording of both French and English are consistent. Currently, the French version states “Le ministre délivre, sur demande, un certificat de pilote — petit aéronef télépiloté (VLOS) — avancées, si le demandeur lui démontre […]”, whereas the English version states “The Minister shall, on receipt of an application, issue a pilot certificate — small remotely piloted aircraft (VLOS) — advanced operations if the applicant demonstrates […]”. The French version is amended to read “Le ministre délivre, sur demande, un certificat de pilote — petit aéronef télépiloté (VLOS) — opérations avancées, si le demandeur lui démontre […]”.

Paragraph 901.65(1)(a): The amendment is correcting the wording of the French provision to ensure that the grammar in the French version is consistent with the English. The English version states “No holder of a pilot certificate […] shall operate a remotely piloted aircraft system under this Division unless the holder has […] been issued a pilot certificate”, whereas the French version states “Il est interdit au détenteur du certificat de pilote […] d'utiliser un système d'aéronef télépiloté en vertu de la présente section à moins que […] un certificat de pilote — petit aéronef télépiloté (VLOS) — opérations avancées lui ait délivré en vertu de l'article 901.64”. The French version is updated to read “lui ait été délivré” instead of “lui ait délivré”.

Subparagraph 901.78(c)(v): The amendment is correcting the wording in the French version to ensure consistency between the English and French. The amendment replaces the phrase “membres de l'équipage du système” with “membres d'équipage”.

Paragraph 901.83(b): The amendment is correcting the spelling of the word “connaissance” by adding an “s” at the end.

Section 903.02: The amendment is correcting the wording in the French version to reflect the true policy intent of the provision and ensure consistency with the English version, which says wording “30 working days” not “30 days”. Currently, the French version states, “au moins trente jours avant l'utilisation proposée”; it is amended to “au moins trente jours ouvrables avant l'utilisation proposée”.

One-for-one rule and small business lens

The one-for-one rule does not apply to these amendments, as there is no change in administrative costs or burden to business.

Analysis under the small business lens determined that the proposal will not impact small businesses in Canada.

Consultation

These amendments were not prepublished in the Canada Gazette, Part I, as they are technical, administrative, non-controversial amendments, which do not change the way stakeholders carry out their business activities, and do not generate incremental costs to stakeholders.

On February 12, 2021, members of the Canadian Aviation Regulation Advisory Council (CARAC) were consulted. CARAC is a joint undertaking of government and the aviation community, with participation from a large number of organizations outside Transport Canada representing the overall viewpoint of the aviation community. These include management and labour organizations, representing operators and manufacturers, and professional associations. CARAC has been part of the civil aviation rule-making process since 1993. At the end of the 30-day consultation period, one stakeholder comment was received in support of the proposal.
