FIRST NATIONS LAND MANAGEMENT ACT

The Minister of Crown-Indigenous Relations, pursuant to subsection 45(3) footnote a of the First Nations Land Management Act footnote b, makes the annexed Order Amending the Schedules to the First Nations Land Management Act (Miscellaneous Program).

Order Amending the Schedules to the First Nations Land Management Act (Miscellaneous Program)

Amendments

1 In Schedule 1 to the First Nations Land Management Act footnote b, the First Nations' names “Algonquins of Pikwakanagan”, “Scugog (also known as Mississaugas of Scugog Island)”, and “Whitefish Lake” in the column under the heading “First Nation” opposite the province of Ontario, are replaced by the following and are repositioned in alphabetical order:

2 In Schedule 1 to the Act, the First Nation's name “Montagnais du Lac St-Jean”, in the column under the heading “First Nation” opposite the province of Quebec, is replaced by “Pekuakamiulnuatsch First Nation”.

3 In Schedule 1 to the Act, the First Nations' names “Burrard”, “Haisla”, “Metlakatla”, “Mount Currie”, “Nak'azdli”, “Songhees”, “St. Mary's” and “Stz'uminus” in the column under the heading “First Nation” opposite the province of British Columbia, are replaced by the following and are repositioned in alphabetical order:

4 In Schedule 1 to the Act, the First Nations' names “George Gordon”, “Mistawasis”, and “One Arrow” in the column under the heading “First Nation” opposite the province of Saskatchewan, are replaced by the following and are repositioned in alphabetical order:

5 In Schedule 1 to the Act, the First Nation's name “Tsuu T'ina”, in the column under the heading “First Nation” opposite the province of Alberta is replaced by “Tsuut'ina Nation”.

6 In Schedule 2 to the Act, the First Nations' names “Scugog (also known as Mississaugas of Scugog Island)” and “Whitefish Lake” in the column under the heading “First Nation” opposite the province of Ontario, are replaced by the following and are repositioned in alphabetical order:

Coming into Force

9 This Order comes into force on the day on which it is registered.

Issues

The Office of the Indian Registrar has identified the names of 16 First Nations listed in the schedules to the First Nations Land Management Act and the names of 16 First Nations listed in the schedule to the First Nations Fiscal Management Act who have officially changed their names in the Indian Registration System.

Objective

The amendments have the following objective:

To update the schedules to reflect official names of First Nations

Description and rationale

The Order Amending the Schedules to the First Nations Land Management Act (Miscellaneous Program) updates the names of 16 First Nations to their official names, as reflected in the Indian Registration System. The Order Amending the Schedule to the First Nations Fiscal Management Act (Miscellaneous Program) updates the names of 16 First Nations to their official names, as reflected in the Indian Registration System.

Amendments to the schedules are required to ensure consistency with the Indian Registration System, as well as to prevent confusion as to the applicability of the orders to a specific First Nation. Additionally, amending federal statutory instruments to reflect First Nations' current names is a respectful step consistent with a nation-to-nation relationship and reconciliation.

One-for-one rule and small business lens

The one-for-one rule does not apply to these amendments, as there is no change in administrative costs or burden to businesses.

The small business lens does not apply to these amendments, as there are no costs to small businesses.
