REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Issues

In December 2012, the Standing Joint Committee for the Scrutiny of Regulations raised a number of issues of an administrative nature regarding the Assessable Activities, Exceptions and Executive Committee Projects Regulations (the Regulations). The majority of these issues were resolved by the Regulations Amending the Assessable Activities, Exceptions and Executive Committee Projects Regulations (Miscellaneous Program), which were made on February 1, 2019. However, three suggested amendments were not included in the amending Regulations, as they were dependent on the passage of legislation in 2019. The Standing Joint Committee for the Scrutiny of Regulations has recently written to the Department of Crown-Indigenous Relations and Northern Affairs requesting that these amendments be made as soon as possible.

Objective

To provide clarity and accuracy to the Regulations.

Description and rationale

The amendments to the Regulations provide clarification and precision by replacing outdated references to the Navigable Waters Protection Act with references to the Canadian Navigable Waters Act and the Wrecked, Abandoned or Hazardous Vessels Act, which received royal assent on June 21, 2019, and February 28, 2019, respectively.

One-for-one rule and small business lens

The one-for-one rule does not apply to these amendments, as there is no change in administrative costs or burden to business.

The small business lens does not apply to these amendments, as there are no costs to small business.
