Her Excellency the Governor General in Council, on the recommendation of the Minister of Labour and the Minister of Transport, pursuant to sections 125 footnote a, 125.1 footnote b, 125.2 footnote c, 126 footnote d and 157 footnote e of the Canada Labour Code footnote f, makes the annexed Regulations Amending Certain Regulations Made Under Part II of the Canada Labour Code (Miscellaneous Program).

Canada Occupational Health and Safety Regulations
1 The definitions endroit présentant un risque d’incendie and verrouillé in section 1.2 of the French version of the Canada Occupational Health and Safety Regulations footnote 1 are replaced by the following:

2 Section 1.5 of the Regulations and the heading before it are replaced by the following:
Records
1.5 If an employer is required by section 125 or 125.1 of the Act to keep and maintain a record, the employer shall keep and maintain the record and make it readily available for examination by the Minister and by the policy committee or, if there is no policy committee, the work place committee or the health and safety representative for the work place to which it applies.
3 (1) The definition special need in subsection 1.8(1) of the Regulations is replaced by the following:
special need means a need that stems from a condition that impairs an employee’s ability to receive any information, instruction or training that is required by these Regulations to be provided. (besoins spéciaux)
(2) The definition média substitut in subsection 1.8(1) of the French version of the Regulations is replaced by the following:

4 Subsections 2.2(2) to (4) of the Regulations are replaced by the following:
(2) Every building, the construction of which begins before the day of the coming into force of this subsection, shall, if feasible, meet the requirements of the National Building Code.
(3) The renovation of any building or part of a building shall, if feasible, meet the requirements of the National Building Code.
(4) If it is not feasible for an employer to comply with the requirements of subsection (3), the employer shall, before the proposed renovations start, notify the work place committee or the health and safety representative.
5 Subsection 2.6(3) of the French version of the Regulations is replaced by the following:

6 Paragraph 2.8(b) of the English version of the Regulations is replaced by the following:

7 Subsection 2.9(2) of the Regulations is replaced by the following:
(2) A fixed ladder that is installed before the day of the coming into force of this section shall, if feasible, meet the requirements referred to in subsection (1).
8 Subsection 2.10(2) of the Regulations is replaced by the following:
(2) A fixed ladder that is installed in a grain-handling facility before the day of the coming into force of this section shall, if feasible, meet the requirements referred to in subsection 2.9(1).
9 The portion of section 2.13 of the Regulations before paragraph (a) is replaced by the following:
2.13 If there is a risk that tools or other objects could fall onto a person from a platform or other raised area, or through a floor opening or floor hole,

13 Section 2.25 of the Regulations is replaced by the following:
2.25 An employer shall ensure that the qualified person or persons referred to in subsection 2.24(4) are instructed and trained in the procedures to be followed in the operation, inspection, testing, cleaning and maintenance of the HVAC system and the calibration of probes or sensors on which the system relies.
14 Subsection 2.27(6) of the Regulations is replaced by the following:
(6) If feasible, the employer shall, in consultation with the work place committee or the health and safety representative, remove or control any health or safety hazard that is identified in the course of the investigation.
15 Section 3.2 of the Regulations is replaced by the following:
3.2 No employee shall use a temporary structure if it is feasible to use a permanent structure.
16 Paragraph 3.5(b) of the French version of the Regulations is replaced by the following:
- b) avant d’avoir reçu des consignes et une formation sur son mode d’utilisation en toute sécurité.
17 Section 3.7 of the French version of the Regulations is replaced by the following:

21 Subsection 3.13(1) of the English version of the Regulations is replaced by the following:
3.13 (1) If there is a risk that tools, equipment or materials could fall onto or from a temporary structure, the employer shall provide a protective structure or a safety net to protect from injury any employee on or below the temporary structure.
22 Paragraph 4.2(1)(a) of the Regulations is replaced by the following:
- (a) meet the standards set out in the applicable CSA standard referred to in subsection (2) if feasible; and
23 Section 5.3 of the Regulations is replaced by the following:
5.3 Every boiler, pressure vessel and pressure piping system used in a work place shall, if feasible, meet the standards relating to design, construction, testing, stamping, nameplates, fabrication inspection and installation set out in clauses 4.15 to 4.18 and 5.1 to 9.1 of Part I of the Boiler Code.
24 Section 5.17 of the English version of the Regulations is replaced by the following:
5.17 The employer shall keep a record of every boiler, pressure vessel and pressure piping system to which this Part applies and that is under the employer’s control.
25 Subsection 5.18(3) of the French version of the Regulations is replaced by the following:
(3) L’employeur doit conserver et rendre facilement accessibles tous les rapports faits au cours des deux dernières périodes d’inspection et, sur demande du comité local ou du représentant, lui en fournir copie.
26 (1) The portion of subsection 7.3(1) of the French version of the Regulations before paragraph (a) is replaced by the following:

7.6 If it is not feasible for an employer, without providing hearing protectors to maintain an employee’s exposure to a sound level that does not exceed the limits referred to in section 7.4, the employer shall, without delay,

- (a) make a report in writing to the Minister setting out the reasons why it is not feasible to do so; and

7.7 (1) If an employer is required to make a report in accordance with section 7.6, the employer shall, as soon as feasible, provide every employee who is exposed to the sound level referred to in section 7.4 with a hearing protector that

- (b) prevents the exposure to the sound level referred to in section 7.4.
(3) Subsection 7.7(3) of the Regulations is replaced by the following:
(3) Every employer shall ensure that every person, other than an employee, to whom the employer grants access to a work place if the person is likely to be exposed to a sound level that exceeds the limits referred to in section 7.4 uses a hearing protector that meets the standard referred to in paragraph (1)(a).
30 The definition isolé in section 8.1 of the French version of the Regulations is replaced by the following:

31 Subsection 8.3(1) of the Regulations is replaced by the following:
8.3 (1) The design, construction and installation of all electrical equipment, if feasible, shall meet the standards set out in the Canadian Electrical Code, Part I.
32 Paragraph 8.4(2)(b) of the French version of the Regulations is replaced by the following:

33 (1) Subsection 8.5(2) of the English version of the Regulations is replaced by the following:
(2) If it is not feasible to isolate the electrical equipment and an employee is required to work on live equipment, the employer shall instruct the employee in procedures that are safe for live conductors.

(7) No employee shall work near a live part of any electrical equipment referred to in subsection (6) if there is a risk that an unintentional movement by the employee could bring any part of the body of the employee or any thing with which the employee is in contact closer to that live part than the distance referred to in that subsection.
34 Subsection 8.8(2) of the Regulations is replaced by the following:
(2) A safety watcher shall be
- (a) informed of their duties as a safety watcher and of the hazard involved in the work;
- (b) trained and instructed in the procedures to follow in the event of an emergency;
- (c) authorized to stop immediately any part of the work that they consider dangerous; and
- (d) free of any other duties that might interfere with their duties as a safety watcher.
35 (1) Subsection 8.10(1) of the French version of the Regulations is replaced by the following:
8.10 (1) Avant qu’un employé monte sur un poteau ou une construction élevée utilisés pour supporter un outillage électrique, l’employeur doit lui donner des consignes et une formation sur l’inspection et la vérification préalables des poteaux ou des constructions élevées.
(2) Subsection 8.10(3) of the Regulations is replaced by the following:
(3) No employee shall work on any pole or elevated structure referred to in subsection (1) unless they have been instructed and trained in the rescue of employees who may be injured in the course of the work.
36 Section 8.12 of the French version of the Regulations is replaced by the following:
8.12 (1) Avant qu’un employé procède à l’isolation d’un outillage électrique, ou qu’il la modifie ou y mette fin, l’employeur doit fournir des consignes écrites sur les procédures à suivre pour l’exécution en toute sécurité de ce travail.

(3) Un exemplaire des consignes doit être montré à l’employé et celles-ci doivent lui être expliquées.
(4) Les consignes doivent, au cours de la période visée à l’alinéa (2)b), être conservées et rendues facilement accessibles pour consultation par les employés et, par la suite, elles doivent être conservées par l’employeur pendant un an à son établissement d’affaires le plus près du lieu de travail où est situé l’outillage électrique.
37 Subsection 8.13(4) of the Regulations is replaced by the following:
(4) If, because of the nature of the work in which the electrical equipment is being used, it is not feasible to comply with subsection (1), no work on or live test of electrical equipment shall be performed unless a guarantee of isolation referred to in section 8.14 is given to the person in charge.
38 Paragraph 8.14(3)(b) of the Regulations is replaced by the following:
- (b) if owing to an emergency it is not feasible for the person in charge to receive a written guarantee of isolation, a non-written guarantee of isolation.
39 Subsection 8.17(2) of the French version of the Regulations is replaced by the following:

(2) If, after the connections are made, a safety ground is required to ensure the safety of an employee working on the electrical equipment, the safety ground shall be connected to the common grounding network.

42 Subsection 9.5(2) of the Regulations is replaced by the following:
(2) If it is not feasible to comply with paragraph (1)(b), the employer shall provide a waste disposal system that meets the standards set out in ANSI standard ANSI Z4.3-1979, Minimum Requirements for Nonsewered Waste-Disposal Systems, dated November 8, 1978.
43 Paragraph 9.6(1)(d) of the French version of the Regulations is replaced by the following:

45 (1) Subsection 9.12(1) of the English version of the Regulations is replaced by the following:
9.12 (1) If feasible, a toilet room shall be provided for employees and, subject to section 9.13, if persons of both sexes are employed at the same work place, a separate toilet room shall be provided for employees of each sex.

(6) If feasible, toilet rooms and wash basins separate from those used by other employees shall be provided for food handlers.
46 Subsection 9.19(2) of the Regulations is replaced by the following:
(2) If an outdoor privy is provided by an employer, the employer shall provide wash basins required by subsection (1) as close as possible to the outdoor privy.
47 The portion of section 9.20 of the French version of the Regulations before paragraph (a) is replaced by the following:

56 Subsection 10.7(1) of the Regulations is replaced by the following:
10.7 (1) If a report referred to in section 10.5 recommends a medical examination for the employees likely to be exposed to a hazardous substance, the employer shall consult a physician to ascertain the necessity for that medical examination.
57 Section 10.9 of the English version of the Regulations is replaced by the following:
10.9 If a hazardous substance is stored, handled or used in a work place, any hazard resulting from that storage, handling or use shall be confined to as small an area as possible.
58 Section 10.11 of the English version of the Regulations is replaced by the following:
10.11 The quantity of a hazardous substance for use or processing in a work place shall, if feasible, be limited to the quantity required in one work day.
59 The portion of paragraph 10.14(2)(a) of the Regulations before subparagraph (i) is replaced by the following:
- (a) the education and training of each employee who handles or is exposed to or who is likely to handle or be exposed to a hazardous substance, with respect to

(2) If feasible, every ventilation system installed before January 1, 1997 to control the concentration of an airborne hazardous substance shall be maintained so as to meet the requirements set out in subsection (1).
63 (1) Subsections 10.18(1) and (2) of the French version of the Regulations are replaced by the following:

(2) The portion of subsection 10.19(3) of the Regulations before paragraph (a) is replaced by the following:
(3) If the concentration of an airborne chemical agent is likely to exceed the value referred to in subsection (1), air samples shall be taken and the concentration of the chemical agent shall be determined
65 (1) Subsection 10.21(1) of the English version of the Regulations is renumbered as section 10.21.
(2) Paragraph 10.21(a) of the French version of the Regulations is replaced by the following:

- (b) that use would result in a concentration of an airborne chemical agent that exceeds the values referred to in paragraph 10.19(1)(a) or subsection 10.19(1.1) or the limit referred to in subsection 10.20(1) or (2).
66 Section 10.23 of the Regulations is replaced by the following:
10.23 If feasible, the employer shall provide automated warning and detection systems if the seriousness of any exposure to a hazardous substance so requires.

Coming into Force
426 These Regulations come into force on the day on which they are registered.
REGULATORY IMPACT ANALYSIS STATEMENT
(This statement is not part of the Regulations.)
Issues
The Standing Joint Committee for the Scrutiny of Regulations (SJCSR) has identified a number of concerns noticing various technical errors and inconsistencies in various occupational health and safety regulations that the Labour Program of Employment and Social Development Canada (the Labour Program) needed to address.
Background
The Labour Program seeks to promote and sustain stable industrial relations and safe, fair, healthy, equitable and productive workplaces within the federal jurisdiction (e.g. interprovincial transportation, postal services and courier companies, telecommunications, banking, grain handling, nuclear facilities, federal Crown corporations, and certain activities undertaken on First Nations land). This mandate is partially achieved through the development and implementation of occupational health and safety regulations that aimed to reduce work-related accidents and illnesses in federal jurisdiction workplaces made under Part II of the Canada Labour Code (the Code).
Over the years, the SJCSR reviewed occupational health and safety regulations under the purview of the Labour Program (listed below) and noted the need for miscellaneous amendments to address issues they identified:
- Canada Occupational Health and Safety Regulations (COHSR), which establish health and safety standards to address hazards, and prevent accidents and injuries in federally regulated workplaces;
- On Board Trains Occupational Health and Safety Regulations (OTOHSR), which establish health and safety standards to protect employees on board trains while the train is in operation, and address hazards that are unique to the working environment on board a train in addition to general occupational health and safety hazards;
- Aviation Occupational Health and Safety Regulations (AOHSR), which establish health and safety standards for the federally regulated aviation industry in order to protect the health and safety of employees on board aircraft while in operation and in respect of persons granted access to those aircraft by the employer;
- Maritime Occupational Health and Safety Regulations (MOHSR), which establish health and safety standards for the federally regulated marine sector in order to protect the health and safety of employees on board vessels and in the loading or unloading of vessels; and
- Policy Committees, Workplace Committees and Health and Safety Representatives Regulations, aim to reduce accidents, illnesses and fatalities in federally regulated work places by improving the capacity of policy committees, work place committees and health and safety representatives to identify and address hazards in the work place.
Objectives
The objectives of the Regulations Amending Certain Regulations Made Under Part II of the Canada Labour Code (Miscellaneous Program) hereinafter referred to as “the amendments” are as follows:
- To correct references to section numbering, typographical or grammatical errors;
- To correct discrepancies between the English and the French versions;
- To add clarity or ensure enforceability of regulatory provisions;
- To improve consistency or harmonize terms with other provisions within or among the regulations; and
- To repeal obsolete or unnecessary regulatory provisions.
Description
The Labour Program is proposing a series of miscellaneous amendments to address various concerns raised by SJCSR. These amendments of administrative and editorial nature do not negatively impact stakeholders or change the policy intention of the regulations. Each of the amendments falls into one of five categories mentioned above.
Examples of the proposed amendments are included below to illustrate the five categories of amendments that will achieve the objectives of this proposal.
To correct references to section numbering, typographical or grammatical errors:
- Subsection 174(2) [English of MOHSR]: The proper provision to be referenced has been corrected to subsection 171(2) from subsection 172(2).
- Preamble [English and French of MOHSR]: The proper provision to be referenced has been corrected to sections 125, 125.1, 125.2, 126 and 157 from the Code from section 157.
- Subsection 149(2) [French of MOHSR]: A comma is introduced to ensure proper grammar is used.
To correct discrepancies between the English and the French version:
- Schedule 1, paragraphs 1(f) and 2(f) [French of AOHSR] and Schedule V, paragraphs 1(f) and 2(f) [French of COHSR]: The words “mesures pour éviter l’infection” are replaced by “mesures pour éviter la contamination” to better align with “Anti-contamination procedures.”
- Paragraphs 12(5)(e) and 12(9)(a), subsections 12(6) and 229(3), and section 237 [French of MOHSR]: The word “passerelles” is replaced by “passerelles d’embarquement.”
To add clarity or ensure enforceability of regulatory provisions:
- Sections 4.5, 4.6 and 4.7 [English of OTOHSR]: The words “set out in section 4.4” are replaced by “referred to in section 4.4” because section 4.4 does not set out a limit, rather it refers to a limit referenced elsewhere in the regulations.
- Subsection 8.3(3) [English of AOHSR]: The text is modified by clarifying that the qualified person must abide by the requirements outlined in paragraphs 8.3(3)(a) and (b). The current text describes the inspection, testing and maintenance duties of the qualified person, but does not prescribe that such duties must be met by the qualified person.
To improve consistency or harmonize terms with other provisions within or among the regulations:
- Various provisions through the regulations [COHSR, OTOHSR, AOHSR and MOHSR]: “If feasible” replaced “reasonably practicable,” “practicable” and “possible” to be used as the French equivalent of “dans la mesure du possible.”
- Various provisions through the regulations [French of AOHSR and MOHSR]: The word “ventilation” has been changed to “aeration” to ensure consistent use of the word as equivalent to the English word “ventilation.”
- Whenever an issue was identified in one regulation, but also applied to other regulations, corrections in these other regulations have been made. For example, issues related to discrepancies of the French equivalent of the English words “education,” “training” and “instructions” have been amended in COHSR, OTOHSR, AOHSR and MOHSR.
To repeal obsolete or unnecessary regulatory provisions:
- Section 3.2 [English and French of AOHSR]: This provision requires certain equipment be operated and maintained in accordance with standards established under the Aeronautics Act. Legal obligations under another Act should be met regardless of whether it is specified in a provision made under the Code.
- Section 4 [English and French of the Policy Committees, Work Place Committees and Health and Safety Representatives Regulations]: The opening phrase “Subject to section 135.1 of the Act” is repealed because indicating that section 4 is subject to section 135.1 of the Act has no effect on the operation of the provision, and that clearly, the regulations are subordinate to the legislation.
- Subsection 99(2) [English and French of MOHSR]: This provision prohibits an employer from disclosing information “whose disclosure is prohibited by law.” Such requirement is repealed given that this provision is unnecessary if the disclosure is already prohibited.
- Subsection 236(7) [English and French of MOHSR]: This provision provides that if the use of visual signals by a signaller will not be an effective means of communication, the employer must provide the signaller and the operator with a telephone, radio or other audible signalling device. However, subsection 229(7) already provides that “if it is not practicable for a signaller to use visual signals, a telephone, radio or other signalling device must be provided by the employer for the signaller’s use.” Therefore, this subsection is duplicative and repealed.
“One-for-One” Rule
The “One-for-One” Rule does not apply to these amendments, as there is no change in administrative costs or burden to business.
Small business lens
The small business lens does not apply to these amendments, as there are no costs to small business.
Consultation
As the amendments are considered to be administrative in nature, do not change the policy intent of the regulations and do not have any practical impact on federally regulated employers and employees, it was determined that formal consultations were not necessary.
Rationale
The amendments will increase the accuracy, consistency and enforceability of COHSR, MOHSR, AOHSR, OTOHSR, and Policy Committees, Workplace Committees and Health and Safety Regulations, reducing the likelihood of misinterpretation of these regulations. They are in response to SJCSR concerns, comments and recommendations, and stakeholders are not expected to be negatively impacted.
Implementation, enforcement and service standards
The amendments are administrative in nature, and do not make any substantive changes to any of the provisions identified. No incremental implementation or enforcement activities are anticipated.
