APPRENTICE LOANS ACT

Whereas, on January 26, 2017, the Minister of Employment and Social Development authorized the Minister of Labour, pursuant to section 11 of the Department of Employment and Social Development Actfootnote a, to exercise the powers and perform the duties and functions of the Minister of Employment and Social Development under the Apprentice Loans Act footnote b;

Therefore, the Minister of Labour, pursuant to subsection 12(3) of the Apprentice Loans Act footnote b, makes the annexed Regulations Amending the Apprentice Loans Regulations.

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Issues

Pursuant to subsection 12(3) of the Apprentice Loans Act (Act), the regulatory amendment was developed to amend Schedule 1 to the Apprentice Loans Regulations (Regulations), to ensure that all apprentices registered in a Red Seal trade program are eligible for Canada Apprentice Loans.

Background

The Canadian Council of Directors of Apprenticeship (CCDA) is a voluntary intergovernmental partnership among the provinces and territories and the federal government. The CCDA consists of 15 members including one official from each province and territory and two federal government representatives from the Department of Employment and Social Development. The CCDA manages the Red Seal Program, which is responsible for apprenticeship training and trade certification.

In 2015, Employment and Social Development Canada developed the Canada Apprentice Loan (CAL) to enable apprentices registered in Red Seal trade programs to receive Canada Apprentice Loans to help cover the costs of technical training that forms part of apprenticeship programs. Schedule 1 to the Regulations lists all of the designated Red Seal trades in each province and territory and is regularly updated according to the CCDA Red Seal Program.

Subsection 12(3) of the Act permits the Minister of Employment and Social Development to amend Schedule 1 to the Regulations. On January 26, 2017, the Minister of Employment and Social Development authorized the Minister of Labour, pursuant to section 11 of the Department of Employment and Social Development Act, to exercise the powers and perform the duties and functions of the Minister of Employment and Social Development under the Act.

Objectives

The objective of this regulatory amendment is to reflect changes made by the CCDA Red Seal Program. Furthermore, the amendment will ensure that the list of designated Red Seal trades in Schedule 1 to the Regulations are consistent with those reflected by the Red Seal trade program in each province and territory.

Description

The amendment to the Regulations will update the list of designated Red Seal trades in Schedule 1 to reflect changes by the CCDA Red Seal Program. This amendment will include renaming trades as well as updating where trades are designated Red Seal.

“One-for-One” Rule

The “One-for-One” Rule does not apply to the Regulations, as there is no change in administrative costs to business.

Small business lens

The small business lens does not apply to the Regulations, as there are no costs to small businesses.

Consultation

The regulatory amendment of Schedule 1 to the Regulations is operational in nature. It does not represent a policy change. No prepublication is required.

Rationale

The regulatory amendment will support the aforementioned objectives by ensuring that the list of all designated Red Seal trades remains up-to-date. By extension, this would ensure that all apprentices registered in a Red Seal trade are eligible for Canada Apprentice Loans.

Implementation, enforcement and service standards

This regulatory amendment will come into force the day it is registered by the Privy Council Office and will be amended on a yearly basis to ensure Schedule 1 reflects any changes made by CCDA Red Seal Program.
