Regulations Amending the Vessel Operation Restriction Regulations

His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to sections 136 (see footnote a) and 207 of the Canada Shipping Act, 2001 (see footnote b), makes the annexed Regulations Amending the Vessel Operation Restriction Regulations.
REGULATIONS AMENDING THE VESSEL OPERATION RESTRICTION REGULATIONS
AMENDMENTS
1. Paragraph 3(2)(d) of the Vessel Operation Restriction Regulations (see footnote 1) is replaced by the following:
- (d) a person who operates a safety boat for surveillance, rendering assistance and lifeguarding within the scope of regular activities carried out by a recreational institution or a teaching or racing organization established under provincial, federal or foreign laws.
2. The portion of subsection 9(5) of the French version of the Regulations before paragraph (a) is replaced by the following:
(5) Lorsqu’une pancarte autorisée par le ministre est installée directement sur une bouée, une bande horizontale est tracée juste au-dessus et juste au-dessous de la pancarte de manière que chaque bande soit conforme aux exigences suivantes :
3. Subsection 11(1) of the Regulations is replaced by the following:
11. (1) No person shall hold a sporting, recreational or public event or activity in waters other than those described in Schedule 8 in a manner or at a place that would interfere with the safe and efficient navigation of vessels.
4. (1)Paragraph 14(2)(b) of the French version of the Regulations is replaced by the following:

Issues
Local authorities in the province of Quebec requested that certain municipal inspectors in the Municipality of St-Hippolyte be granted enforcement authority under the Vessel Operation Restriction Regulations (the Regulations) in order to enhance the safety of navigation, and protect the environment and public interest.
Local authorities in the provinces of Ontario and Quebec have identified errors and omissions with respect to the names and geographic coordinates of certain lakes identified in the Schedules to the Regulations. These errors and omissions can lead to regulatory misinterpretation and/or confusion resulting in a negative effect on the safety of the users of these bodies of water.
In response to comments received from the Standing Joint Committee for the Scrutiny of Regulations (SJCSR), amendments and clarifications to the Regulations are required to correct any discordance, as outlined in the correspondence between the SJCSR and Transport Canada (TC).
Background
The Regulations, made pursuant to the Canada Shipping Act, 2001 (CSA 2001), provide for the establishment of restrictions to boating activities and navigation on Canadian waters.
Increased water activities due to population growth and the technical evolution of vessels have resulted in an increase in conflict between waterway users. As a consequence, there is an increased risk to users’ safety and in some instances, an increased risk to sensitive ecosystems. Each year, Transport Canada (TC) receives a number of applications from local authorities to impose or amend restrictions on navigation in order to enhance the safety of navigation, to protect the environment or to protect public interest. The amendments are proposed by local authorities and the justifications for the amendments are based on the applications provided to TC.
Objectives
The objectives of the amendments are
- To assist in the maintenance of an effective enforcement regime and promote the viable and effective use of Canadian waters;
- To increase safety and environmental protection for both recreational boaters and commercial operators; and
- To include updates, corrections and clarifications requested by the SJCSR.
These objectives support the requests made by local authorities (communities, enforcement agencies and governments) to amend the Regulations.
Description
The Regulations provide for the establishment of restrictions to boating activities and navigation in Canadian waters. The restrictions set out in the Schedules to the Regulations include prohibitions with respect to access by vessels to specified waters; restrictions on the mode of propulsion used; maximum engine power or speed limits; and prohibitions on recreational towing (e.g. water-skiing) activities. The Schedules to the Regulations also specify waters in which a permit is required in order to hold a sporting, recreational or public event or activity (e.g. regattas and dragon boat races).
The changes to the Regulations Amending the Vessel Operation Restriction Regulations include
- Amending the Regulations to include the appointment of municipal inspectors employed by the Municipality of St-Hippolyte, Quebec, on the list of persons authorized to ensure compliance with the Regulations. At this time, three firefighters are designated as municipal inspectors for the Municipality of St-Hippolyte. The appointment of these designated officials assists in maintaining and promoting the safe operation of vessels in the area. The appointment allows the enforcement officer to prohibit the movement of any vessel, direct it to move, stop and board it, direct any person to cease operation, ask questions, demand reasonable assistance, and require that any person on board the vessel provide requested documentation. If necessary, enforcement officers may issue fines ranging from $100 to $500 as per the Contraventions Act and corresponding Regulations.
- Improving the enforceability of the Regulations by making corrections to existing restrictions on 87 bodies of water in the province of Ontario and 59 bodies of water in the province of Quebec, to accurately reflect the geographical place, names and coordinates. Correcting these errors increases the clarity and enforceability of the Regulations and will decrease potential confusion between users of the waterways and TC’s enforcement partners.

- Amending subsection 9(5) of the French version to ensure that it accommodates the intent reflected in the English counterpart.
- Amending subsection 11(1) of both the English and French versions to remove the words “unreasonably” and “indûment” respectively, to remove the subjective qualifiers.
- Amending paragraph 14(2)(b) of the French version to change the wording “en bon état de navigabilité” to “en état de navigabilité.”
- Amending the table in section 16, Item 18 in the French version to change the word “et” to the word “ou” to harmonize the style between the English and French versions.
- Amending sections 19 and 20 in the French version to replace the wording “la surveille” with “la supervise directement” to ensure congruence with the English version.
- Amending Schedule 1, Part 1, Item 10 in the Peace River Region to ensure that the coordinates listed in the English version are identical to those in the French version.
- Amending the French version of Schedule 1, Part 1, Item 14 in the Northeast Region to include the reference to “Floatingstone Lake” to match the English version.
- Amending the French version of Schedule 1, Part 2, Item 22 in Column 2 to read “havre de Port Dalhousie” to ensure consistency with the English version.
- Amending the English version of Schedule 5, Part 3, Item 5 in the Haliburton Area to correct the spelling of the word “boundaries.”
“One-for-One” Rule
The “One-for-One” Rule does not apply, as there is no change in the administrative costs to businesses.
Small business lens
The small business lens does not apply, as the amendments are administrative in nature. There are no costs to small businesses.
Consultation
Consultations were conducted in every location, where a change is being made, by the local authorities and enforcement partners.
Since the changes are administrative in nature, consultations on the amendments were met without controversy or opposition. The amendments were requested by local authorities to TC. Transport Canada only proceeds with potential amendments if consensus exists within the community from which the request originates.
Local communities, enforcement agencies, local and municipal governments proposed, justified and support the changes.
Rationale
The intent of these amendments is to enhance the safety of commercial and recreational navigation on Canadian waters. By ensuring the correct information for a lake is listed in the Schedules to the Regulations (e.g. the correct geographical coordinates, the proper name and location for the lake) less regulatory misinterpretation can be expected, which will contribute to reducing confusion between users of the waterways and enforcement partners.
The appointment of municipal inspectors (three firefighters), from the Municipality of St-Hippolyte, Quebec, will assist in maintaining and promoting the safe operation of vessels in the area. This will result in positive safety benefits for this region.
A request to be designated as an enforcement officer under the Regulations originates at the local (municipal) level. A formal request to have a person or classes of persons designated must be sent to TC’s Office of Boating Safety for review. Upon review and approval of the request, section 16 (the table) of the Regulations is updated to include that person or classes of persons for enforcement purposes. At this time, there are 24 persons or classes of persons designated as enforcement officers under the Regulations.
Consultation with the industry has shown that the amendments have no negative impact on current commercial operations since the changes are administrative in nature. No costs are associated with the amendments. Minimal savings may be seen as a result of the reduced number of compliance calls to enforcement agencies, because there will be less confusion due to the correction of geographic location identifiers.
Implementation, enforcement and service standards
The CSA 2001 provides for maximum fines upon summary conviction of $100,000 or one year in prison, or both for violations of regulations made under Part 5 of the Act, which includes these Regulations. Enforcement is by way of summary conviction or ticketing under the Contraventions Act. The Contraventions Regulations, made pursuant to the Contraventions Act, set out fine amounts for contravention of regulations made under the CSA 2001. The Regulations specify the classes of persons who are entitled to enforce the Regulations and include the Royal Canadian Mounted Police (RCMP), provincial and municipal police forces, as well as other groups such as special constables, conservation officers, wildlife officers, marine safety inspectors and marine patrol officers.
As matters pertaining to navigation and shipping fall under jurisdiction of the federal government, the amendments to the Regulations are used as a mechanism whereby local authorities can respond to local safety situations and threats to the environment or the public interest, by partnering with the federal government to enact regulations under the CSA 2001. Since the philosophy behind the Regulations is one of partnership between federal, provincial and municipal governments through an existing program, TC staff provides regulatory briefings and other support to assist local enforcement agencies in their enforcement functions.
