FARM PRODUCTS AGENCIES ACT

Regulations Amending the Canadian Hatching Egg Producers Quota Regulations

Whereas the Governor in Council has, by the Canadian Hatching Egg Producers Proclamation (see footnote a), established Canadian Hatching Egg Producers pursuant to subsection 16(1) (see footnote b) of the Farm Products Agencies Act (see footnote c);

Whereas Canadian Hatching Egg Producers has been empowered to implement a marketing plan pursuant to that Proclamation;

Whereas, pursuant to section 6 (see footnote d) of the schedule to that Proclamation, Canadian Hatching Egg Producers has applied the allocation system set out in Schedule “B” annexed to the Federal Provincial Agreement for Broiler Hatching Eggs;

Whereas the proposed Regulations Amending the Canadian Hatching Egg Producers Quota Regulations are regulations of a class to which paragraph 7(1)(d) (see footnote e) of that Act applies by reason of section 2 of the Agencies’ Orders and Regulations Approval Order (see footnote f) and have been submitted to the National Farm Products Council pursuant to paragraph 22(1)(f) of that Act;

And whereas, pursuant to paragraph 7(1)(d) (see footnote g) of that Act, the National Farm Products Council is satisfied that the proposed Regulations are necessary for the implementation of the marketing plan that Canadian Hatching Egg Producers is authorized to implement and has approved the proposed Regulations;

Therefore, Canadian Hatching Egg Producers, pursuant to paragraph 22(1)(f) of the Farm Products Agencies Act (see footnote h) and subsection 5(1) of the schedule to the Canadian Hatching Egg Producers Proclamation (see footnote i), makes the annexed Regulations Amending the Canadian Hatching Egg Producers Quota Regulations.

REGULATIONS AMENDING THE CANADIAN HATCHING EGG PRODUCERS QUOTA REGULATIONS

AMENDMENTS

1. (1) The definitions “Act”, “Agency”, “broiler hatching egg”, “chick”, “Commodity Board”, “marketing”, “producer” and “signatory provinces” in section 2 of the Canadian Hatching Egg Producers Quota Regulations (see footnote 1) are repealed.

(2) Section 2 of the Regulations is renumbered as subsection 2(1) and is amended by adding the following:

(2) Unless otherwise provided, the definitions in section 1 of the schedule to the Canadian Hatching Egg Producers Proclamation apply in these Regulations.

2. The Regulations are amended by replacing “23(3)” with “22(3)” in the following provisions:

3. (1) The schedule to the Regulations is replaced by the schedule set out in Schedule 1 to these Regulations.

(2) The schedule to the Regulations is replaced by the schedule set out in Schedule 2 to these Regulations.

COMING INTO FORCE

4. (1) These Regulations, except subsection 3(2), come into force on the day on which they are registered.

(2) Subsection 3(2) comes into force on January 1, 2014.

EXPLANATORY NOTE

(This note is not part of the Regulations.)

The expression “Canadian Broiler Hatching Egg Marketing Agency” is replaced by “Canadian Hatching Egg Producers,” to reflect the current name of the Agency. References to the Farm Products Agencies Act, the Canadian Hatching Egg Producers Proclamation and the National Farm Products Council are updated to reflect the current instruments.

The definitions in the Canadian Hatching Egg Producers Proclamation are incorporated by reference, and definitions duplicating those in the Proclamation (i.e. “Act,” “Agency,” “broiler hatching egg,” “chick,” “commodity board,” “marketing,” “producer,” and “signatory provinces”) are repealed.

Section 2 of the Regulations is renumbered as subsection 2(1) and is amended by adding subsection 2(2).

Under paragraphs 4(1)(c) and 4(2)(c), the reference to subsection 23(3) is replaced by 22(3).

The amendments establish the final 2013 and the initial 2014 limits for broiler hatching eggs in the signatory provinces.
