DEPARTMENT OF THE ENVIRONMENT
MIGRATORY BIRDS CONVENTION ACT, 1994
Notice of intent: Consultation on proposed amendments to the Migratory Birds Regulations, 2022
Notice is hereby given that Environment and Climate Change Canada (ECCC) is seeking comments on proposed amendments to the Migratory Bird Regulations, 2022 (MBR 2022).
- A public comment period is open from November 7 to December 6, 2026.
ECCC is the lead federal department responsible for the protection, management, and conservation of migratory birds in Canada and is proposing amendments to the MBR 2022. These changes would provide more flexibility, clarity, and certainty for high-priority activities, including those related to migratory bird welfare, public safety, health, and national security, and certain projects and other activities.
Purpose
The purpose of the proposed amendments is to provide more regulatory flexibility and certainty for important activities related to migratory bird welfare, public safety, health, and national security, and for certain projects and other activities, including
- measures to protect migratory bird welfare:
- hazing (scaring birds away from environmental hazards);
- activities related to public safety, health, and national security;
- national interest projects listed under the Building Canada Act; and
- revisions of the damage or danger permit provisions (sections 70 and 71 of the MBR 2022) to recognize that either the migratory bird or the nest could be the cause of the damage or danger, instead of only the migratory bird, as is currently the case.
A second notice of intent and accompanying consultation document addressing additional proposed amendments are anticipated to be published later in fall 2026. The amendments will include
- humane euthanasia to minimize pain and suffering experienced by migratory birds in situations where rehabilitation is not possible;
- projects with minimal impact on migratory birds (known as de minimis projects); and
- the sale of feathers by Indigenous Peoples.
ECCC will carefully consider all comments received, and feedback will help inform the refinement of the proposals to support balance and effective regulations.
Background
ECCC administers the Migratory Birds Convention Act, 1994 (MBCA) and the MBR 2022. The Migratory Birds Regulations were first enacted in 1918. Prior to 2022, they had been amended with isolated changes to deal with specific issues but had never been subject to a comprehensive review. As a result, the regulatory text and structure were outdated, lacked clarity, and did not meet modern legal standards. These issues in turn led to difficulty in the interpretation of the Regulations, in their application, and in their enforcement. In 2022, the MBR 2022 came into force with amendments that focused on improving the structure and the clarity of the Regulations, recognizing Indigenous rights, updating hunting provisions, and limiting nest protection requirements to nests that are important for migratory bird conservation.
The proposed amendments are part of ECCC’s ongoing efforts to continue to modernize the MBR 2022.
