Decorative and other non-structural plywood — Decisions

On August 24, 2026, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made preliminary determinations of dumping and subsidizing of decorative and other non-structural plywood from China.

The Canadian International Trade Tribunal (CITT) will conduct a full inquiry into the question of injury to the Canadian industry and will make an order or finding no later than 120 days after its receipt of the notice of the preliminary determinations of dumping and subsidizing.

Pursuant to section 8 of SIMA, provisional duties are payable on the subject goods that are released from the CBSA during the period commencing August 24, 2026, and ending on the earlier of the day the investigations are terminated, the day on which the CITT makes an order or finding, or the day an undertaking is accepted.

The amount of provisional duties payable is not greater than the estimated margin of dumping and the estimated amount of subsidy. The Customs Act applies with respect to the accounting and payment of provisional duty. Therefore, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

Forged grinding media — Decisions

On August 24, 2026, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) terminated the subsidy investigation respecting the subsidizing of forged grinding media originating in or exported from China by Jiangyin Xingcheng Magotteaux Steel Balls Co., Ltd. and Tangshan ZWell Equipment Manufacturing Co., Ltd. Further, pursuant to paragraph 41(1)(b) of SIMA, the CBSA has made a final determination of subsidizing in respect of forged grinding media originating in or exported from China, with respect to exporters for which the subsidy investigation has not been terminated under paragraph 41(1)(a) of SIMA.

On the same day, pursuant to paragraph 41(1)(b) of SIMA, the CBSA made a final determination respecting the dumping of forged grinding media originating in or exported from China.

The Canadian International Trade Tribunal (CITT) will continue its inquiry into the question of injury to the Canadian industry and will issue its decision by September 22, 2026. Provisional duties will continue to be imposed on the subject goods from China until then.

If the CITT finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, antidumping and/or countervailing duties will be applied to future importations of the subject goods. In that event, the importer in Canada shall pay such duties. However, provisional duties will no longer be imposed on imports of goods for which the subsidy investigation has been terminated. Any provisional duties paid or security posted will be refunded, as appropriate.

The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of antidumping and countervailing duties.

CANADA ENERGY REGULATOR

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES

KPT Energy GP Inc., for and on behalf of KPT Energy LP

By an application dated 26 August 2026, KPT Energy GP Inc., for and on behalf of KPT Energy LP (the Applicant), has applied to the Canada Energy Regulator (the CER) under Division 2 of Part 7 of the Canadian Energy Regulator Act (the Act) for authorization to export up to 2 628 000 MWh of combined firm and interruptible energy annually, for a period of 10 years.

The Commission of the Canada Energy Regulator (the Commission) wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The Directions on Procedure that follow explain in detail the procedure that will be used.

The Applicant shall provide a copy of the application by email to any person who requests one by emailing dan@kptenergy.ca. The application is also publicly available on the CER’s website.
Written submissions that any interested party wishes to present shall be filed online with the CER in care of the Secretary of the Commission, and emailed to the Applicant, by 5 October 2026.
Pursuant to subsection 359(2) of the Act, the Commission is interested in the views of submitters with respect to
- (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported; and
- (b) whether the Applicant has
  - (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
  - (ii) given an opportunity to buy electricity on conditions as favourable as the conditions specified in the application to those who, within a reasonable time after being so informed, demonstrate an intention to buy electricity for consumption in Canada.
Any answer to submissions that the Applicant wishes to present, in response to items 2 and 3 of this Notice of Application and Directions on Procedure, shall be filed with the CER in care of the Secretary of the Commission and emailed to the party that filed the submission by 20 October 2026.

Compost and sawdust collection and disposal

Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination on August 25, 2026, with respect to a complaint filed by Oceanside Properties Limited (Oceanside), of Hammonds Plains, Nova Scotia, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (solicitation WS5487993563) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for compost and sawdust collection and disposal.

Oceanside alleged that PWGSC did not provide the debrief it requested after contract award and that PWGSC erred in the financial evaluation of the bids.

Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was not valid.

INQUIRY NQ-2026-004 — NOTICE OF COMMENCEMENT OF INQUIRY

Decorative and other non-structural plywood

Notice was received by the Canadian International Trade Tribunal on August 24, 2026, from the Director General of the Trade and Anti-dumping Programs Directorate at the Canada Border Services Agency (CBSA), stating that preliminary determinations had been made respecting the dumping and subsidizing of decorative and other non-structural plywood, as defined below (the subject goods). The subject goods are defined as

Decorative and other non-structural plywood, whether or not surface coated or covered, and veneer core platforms for the production of decorative and other non-structural plywood, originating in or exported from the People’s Republic of China. Decorative and other non-structural plywood is defined as a flat, multilayered plywood or other veneered panel, consisting of two or more layers or plies of wood veneers and a core, with the face and/or back veneer made of wood. The veneers, along with the core are glued or otherwise bonded together. Decorative and other non-structural plywood include products that meet the American National Standard for Hardwood and Decorative Plywood, ANSI/HPVA HP-1-2016 (including any revisions to that standard).
Excluding
- (a) Structural plywood (i) that is manufactured to meet CSA O121 (Douglas fir plywood), CSA O151 (Canadian softwood plywood), CSA O153 (Poplar plywood), or U.S. Products Standard PS 1-09, PS 2-09, or PS 2-10 for Structural Plywood (including any revisions to that standard or any substantially equivalent domestic or international standard intended for structural plywood), (ii) which has both a face and a back veneer of coniferous wood, and (iii) which is for use in structural applications;
- (b) Finished plywood products for use as flooring;
- (c) Plywood which has a shape or design other than a flat panel;
- (d) Phenolic Film Faced Plyform (PFF), also known as Phenolic Surface Film Plywood (PSF), defined as a panel with an “Exterior” or “Exposure 1” bond classification as is defined by The Engineered Wood Association, having an opaque phenolic film layer with a weight equal to or greater than 90 g/m3 permanently bonded on both the face and back veneers and an opaque, moisture resistant coating applied to the edges; and
- (e) Laminated veneer lumber door and window components with (1) a maximum width of 44 millimeters, a thickness from 30 millimeters to 72 millimeters, and a length of less than 2413 millimeters, (2) water boiling point exterior adhesive, (3) a modulus of elasticity of 1,500,000 pounds per square inch or higher, (4) finger-jointed or lap-jointed core veneer with all layers oriented so that the grain is running parallel or with no more than 3 dispersed layers of veneer oriented with the grain running perpendicular to the other layers, and (5) top layer machined with a curved edge and one or more profile channels throughout.

Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry to determine whether the dumping and subsidizing of the above-mentioned goods have caused injury or retardation or are threatening to cause injury, to make inquiries with respect to massive importations, and to determine such other matters as the Tribunal is required to determine under that section.

Each person or government wishing to participate in the inquiry and at the hearing as a party must file Form I—Notice of participation with the Tribunal, on or before September 8, 2026. Each counsel who intends to represent a party in the inquiry and at the hearing must file Form II—Notice of representation and Form III—Declaration and undertaking with the Tribunal, on or before September 8, 2026.

On October 13, 2026, the Tribunal will issue a list of participants. Counsel and self-represented participants are required to serve their respective submissions on each other on the dates outlined in the notice on the Tribunal’s website. Public submissions are to be served on counsel and those participants who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed Form III—Declaration and undertaking with the Tribunal. This information will be included in the list of participants. One complete electronic version of all submissions must be filed with the Tribunal.

The Tribunal will hold a hearing relating to this inquiry during the week of November 23, 2026, to hear evidence and representations by interested parties. The type of hearing, as well as the hearing’s start date and duration, will be communicated to the parties and posted on the Tribunal’s website at a later date.
