Paperboard cups and containers — Decisions

On August 17, 2026, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping and subsidization of paperboard cups and containers originating in or exported from the People’s Republic of China.

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES

New Brunswick Energy Marketing Corporation

By an application dated 26 August 2026, New Brunswick Energy Marketing Corporation (the Applicant) has applied to the Canada Energy Regulator (the CER) under Division 2 of Part 7 of the Canadian Energy Regulator Act (the Act) for authorization to export up to 9 846 000 MWh of combined firm and interruptible energy annually, for a period of 10 years. The Applicant, or its affiliates, has an interest in the following generation or transmission facilities in Canada:

Coleson Cove Generating Station, Saint John, N.B.
Mactaquac Generating Station, Mactaquac, N.B.
Beechwood Generating Station, Beechwood, N.B.

The Commission of the Canada Energy Regulator (the Commission) wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The Directions on Procedure that follow explain in detail the procedure that will be used.

The Applicant shall provide a copy of the application by email to any person who requests one by emailing LBowman@nbpower.com. The application is also publicly available on the CER’s website.
Written submissions that any interested party wishes to present shall be filed online with the CER in care of the Secretary of the Commission, and emailed to the Applicant, by 28 September 2026.
Pursuant to subsection 359(2) of the Act, the Commission is interested in the views of submitters with respect to
- (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported; and
- (b) whether the Applicant has
  - (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
  - (ii) given an opportunity to buy electricity on conditions as favourable as the conditions specified in the application to those who, within a reasonable time after being so informed, demonstrate an intention to buy electricity for consumption in Canada.
Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this Notice of Application and Directions on Procedure shall be filed with the CER in care of the Secretary of the Commission and emailed to the party that filed the submission by 13 October 2026.

EXPIRY REVIEW RR-2025-005 — NOTICE OF ORDER

Oil country tubular goods

Notice is given that on August 14, 2026, the Canadian International Trade Tribunal, pursuant to paragraph 76.03(12)(b) of the Special Import Measures Act, continued its order made on December 10, 2020, in expiry review RR-2019-005, continuing, without amendment, its order made on March 2, 2015, in expiry review RR-2014-003, continuing, without amendment its finding made on March 23, 2010, in inquiry NQ-2009-004 concerning the dumping and subsidizing of oil country tubular goods, originating or exported from the People’s Republic of China.

FILE PR-2026-001 — NOTICE OF DETERMINATION

Automated data processing software

Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination on August 17, 2026, with respect to a complaint filed by KEVEREST Technologies Inc. (KEVEREST), of Kitchener, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (solicitation BPM025773/33514) by Shared Services Canada (SSC). The solicitation was for the provision of MATLAB maintenance and support services.

KEVEREST alleged that SSC’s evaluation of its bid was unreasonable.

Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was valid.

PRELIMINARY INJURY INQUIRY PI-2026-003 — NOTICE OF DETERMINATION

Wheat gluten

Notice is given that on August 18, 2026, pursuant to subsection 37.1(1) of the Special Import Measures Act, the Canadian International Trade Tribunal determined that there is evidence that discloses a reasonable indication that the dumping of wheat gluten originating in or exported from the Italian Republic, the Republic of Poland, and the United Kingdom has caused injury to the domestic industry.

PRELIMINARY INJURY INQUIRY PI-2026-004 — NOTICE OF COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Paperboard cups and containers

The Canadian International Trade Tribunal gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry to determine whether there is evidence that discloses a reasonable indication that the dumping and subsidizing of paperboard cups and containers rolled from coated paperboard stock (excluding enhanced clay-coated paperboard stock) and blanks or flats for forming into such paperboard cups or containers, originating in or exported from the People’s Republic of China, excluding paperboard cups and containers packaged in party sets that contain other types of tableware (the subject goods), have caused injury or retardation or are threatening to cause injury, as these words are defined in SIMA.

The Tribunal’s preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file Form I—Notice of participation with the Tribunal, on or before August 31, 2026. Each counsel who intends to represent a party in the preliminary injury inquiry must file Form II—Notice of representation and Form III—Declaration and undertaking with the Tribunal, on or before August 31, 2026.

On September 4, 2026, the Tribunal will issue a list of participants. Counsel and self-represented participants are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those participants who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed Form III—Declaration and undertaking with the Tribunal. This information will be included in the list of participants. One complete electronic version of all submissions must be filed with the Tribunal.

Submissions by parties opposed to the complaint must be filed not later than noon (ET), on September 14, 2026. The complainant and supporting parties may make submissions in response to the submissions of parties opposed to the complaint not later than noon (ET), on September 21, 2026.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some of or all the information to be kept confidential must, among other things, submit a non-confidential edited version or non-confidential summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.
