Unarmoured building cables — Decisions
On June 8, 2026, pursuant to subsection 39(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) extended the preliminary phase of the investigations into the alleged injurious dumping and subsidization of unarmoured building cables originating in or exported from the People’s Republic of China.
SIMA provides that, under normal circumstances, the preliminary phase of the investigations shall be completed within 90 days of the date of initiation. However, due to the complexity or novelty of the issues presented by these investigations and the number of persons involved, the period has been extended to 135 days, pursuant to subsection 39(1) of SIMA.
Consequently, the decision to issue preliminary determinations of dumping and/or subsidization or to terminate the investigations with respect to some or all of the goods will be made on or before July 29, 2026.

Notice is given that on June 9, 2026, pursuant to subsection 37.1(1) of the Special Import Measures Act, the Canadian International Trade Tribunal determined that there was evidence that disclosed a reasonable indication that the dumping and subsidizing of decorative and other non-structural plywood originating in and exported from the People’s Republic of China have caused or are threatening to cause injury to the domestic industry. The full description of the aforementioned goods and the excluded goods can be found in the Tribunal’s determination.

REQUEST FOR PANEL REVIEW
Certain oil country tubular goods originating in or exported from Mexico
Notice is hereby given, in accordance with the Special Import Measures Act and the Canada-United States-Mexico Agreement (CUSMA), that on June 8, 2026, a Request for Panel Review of the findings made by the Canadian International Trade Tribunal, respecting “Certain Oil Country Tubular Goods originating in or exported from Mexico”, was filed with the Canadian Section of the CUSMA Secretariat, pursuant to Article 10.12 of CUSMA, on behalf of Tubos de Acero de Mexico S.A.
The findings were published in the Canada Gazette on May 9, 2026 (Canada Gazette, Part I, Vol. 160, No. 19).
The panel review will be conducted in accordance with the Rules of Procedure for Article 10.12 (Binational Panel Reviews). Subrule 40(1)(c) of the above-mentioned rules provides that
- (i) a Party or interested person may challenge the final determination in whole or in part by filing a Complaint in accordance with Rule 44 no later than 30 days after the filing of the first Request for Panel Review [the deadline for filing a Complaint is July 8, 2026];
- (ii) a Party, an investigating authority or other interested person who does not file a Complaint but who intends to participate in the panel review must file a Notice of Appearance in accordance with Rule 45 no later than 45 days after the filing of the first Request for Panel Review [the deadline for filing a Notice of Appearance is July 23, 2026]; and
- (iii) the panel review will be limited to the allegations of error of fact or law, including challenges to the jurisdiction of the investigating authority, that are set out in the Complaints filed in the panel review and to the procedural and substantive defenses raised in the panel review.

EXPLANATORY NOTE
Chapter 10 of CUSMA establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a CUSMA country with review by binational panels.
These panels are established when a Request for Panel Review is received by the CUSMA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.
Under Article 10.12 of CUSMA, which came into force on July 1, 2020, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 10.12 (Binational Panel Reviews). These rules were adopted by the CUSMA Free-Trade Commission on July 2, 2020.
