Ministerial condition
(Paragraph 84(1)(a) of the Canadian Environmental Protection Act, 1999)

Whereas the Minister of the Environment and the Minister of Health (the ministers) have assessed information pertaining to the substance 1-propanaminium, N-(3-aminopropyl)-2-hydroxy-N,N-dimethyl-3-sulfo-, N-(C12-18 and C18-unsatd. acyl) derivs., inner salts, Chemical Abstracts Service Registry Number 691400-36-9;

And whereas the ministers suspect that the substance is toxic or capable of becoming toxic within the meaning of section 64 of the Canadian Environmental Protection Act, 1999 (the Act),

The Minister of the Environment, pursuant to paragraph 84(1)(a) of the Act, hereby permits the manufacture or import of the substance subject to the conditions of the following annex.

ANNEX

Conditions
(Paragraph 84(1)(a) of the Canadian Environmental Protection Act, 1999)

1. The following definitions apply in these ministerial conditions:

“cosmetic”
means a cosmetic as defined in section 2 of the Food and Drugs Act;
“leave-on cosmetic”
means a cosmetic that is not meant to be rinsed or washed off immediately after its application and includes products such as hairstyling products, leave-on makeup, lotions, after shave, perfume, moisturizer, makeup remover, sun tanning products, skin creams, oils, serums, baby powder, baby oil, baby salve, diaper cream and oral hygiene products;
“notifier”
means the person who has, on May 22, 2026, provided to the Minister of the Environment the prescribed information concerning the substance, in accordance with subsection 81(1) of the Canadian Environmental Protection Act, 1999; and
“substance”
means 1-propanaminium, N-(3-aminopropyl)-2-hydroxy-N,N-dimethyl-3-sulfo-, N-(C12-18 and C18-unsatd. acyl) derivs., inner salts, Chemical Abstracts Service (CAS) Registry Number 691400-36-9.

2. The notifier may manufacture or import the substance subject to the present ministerial conditions.

Restrictions

3. The notifier shall manufacture or import the substance only when the following conditions are met:

4. The notifier shall not manufacture or import the substance for use in the manufacture of a leave-on cosmetic in which the substance is present at a concentration greater than 0.6% by weight.

5. The notifier shall not import the substance if it is present in a leave-on cosmetic at a concentration greater than 0.6% by weight.

Other requirements

6. (1) The notifier shall, prior to transferring the physical possession or control of the substance to any person

(2) Subsection (1) does not apply in relation to persons to whom the substance is transferred when it is contained in a product.

Record-keeping requirements

7. (1) The notifier shall maintain electronic or paper records, with any documentation supporting the validity of the information contained in these records, indicating

(2) When the notifier learns of a change to the address referred to in paragraph (1)(f), the notifier must update the electronic or paper records mentioned in subsection (1) accordingly within 30 days after learning of the change.

(3) The notifier shall create the electronic or paper records mentioned in subsection (1) no later than 30 days after the date the information or documents become available.

(4) The notifier shall maintain the electronic or paper records mentioned in subsection (1)

(5) Any records mentioned in subsection (1) that are kept electronically must be in an electronically readable format.

Coming into force

8. The present ministerial conditions come into force on May 29, 2026.

Order 2026-87-06-02 Amending the Non-domestic Substances List

Whereas, under subsection 87(5) of the Canadian Environmental Protection Act, 1999 footnote a, the Minister of the Environment has added the substance referred to in the annexed Order to the Domestic Substances List footnote b;

Therefore, the Minister of the Environment makes the annexed Order 2026-87-06-02 Amending the Non-domestic Substances List under subsection 87(5) of the Canadian Environmental Protection Act, 1999 footnote a.

CANADA–NOVA SCOTIA OFFSHORE PETROLEUM RESOURCES ACCORD IMPLEMENTATION AND OFFSHORE RENEWABLE ENERGY MANAGEMENT ACT

Joint directive

Notice is hereby given that the Minister of Energy and Natural Resources and the Nova Scotia Minister of Energy have issued a joint directive to the Canada–Nova Scotia Offshore Energy Regulator pursuant to paragraphs 41(1)(a) and (e) of the Canada–Nova Scotia Offshore Petroleum Resources Accord Implementation and Offshore Renewable Energy Management Act with respect to Exploration Licences and Work Deposits, and to undertake a review of the administrative requirements for Work Deposits and provide advice to the ministers on potential changes.
