CANADA MARINE ACT
Vancouver Fraser Port Authority — Supplementary letters patent
WHEREAS the Governor in Council issued a Certificate of Amalgamation containing letters patent to amalgamate the Vancouver Port Authority, the Fraser River Port Authority and the North Fraser Port Authority and to continue as one port authority named the Vancouver Fraser Port Authority (“Authority”), effective January 1, 2008;
WHEREAS Schedule C of the letters patent sets out the real property, other than federal real property, held or occupied by the Authority;
WHEREAS, pursuant to subsection 46(2.1) of the Canada Marine Act (“Act”), the Authority wishes to license as licensee and lease as lessee the real properties described below;
WHEREAS the Authority wishes to amend Schedule C of its letters patent to reflect a statutory right of way granted by Lantic Inc. to the Authority over land owned by Lantic Inc., pursuant to an agreement between the parties, dated April 26, 2024;
WHEREAS, on July 13, 2023, certain properties were purchased by the Authority with a condition that they be consolidated with certain other properties already held by the Authority and set out in Schedule C of the letters patent;
WHEREAS this consolidation is complete and is now reflected in a single title in the New Westminster Land Title Office;
WHEREAS the board of directors of the Authority has requested that the Minister of Transport (“Minister”) issue supplementary letter patent to amend Schedule C of the letters patent to set out the licensed real property and the leasehold interests in real property, to reflect the statutory right of way, and the consolidation of the real properties;
AND WHEREAS the Minister is satisfied that the amendments to the letters patent are consistent with the Act;
NOW THEREFORE, pursuant to subsection 9(1) of the Act, the letters patent are amended as follows:

Interim Order for the Protection of the Southern Resident Killer Whale (Orcinus orca) in the Waters of Southern British Columbia, 2026
Whereas the Minister of Transport is of the opinion that the annexed Interim Order for the Protection of the Southern Resident Killer Whale (Orcinus orca) in the Waters of Southern British Columbia, 2026 is required to deal with a direct or indirect risk to marine safety or to the marine environment;
And whereas the provisions of the annexed Order may be contained in a regulation made under paragraphs 35(1)(e)footnote a, 35.1(1)(k)footnote b and 136(1)(f)footnote c of the Canada Shipping Act, 2001 footnote d;
Therefore, the Minister of Transport makes the annexed Interim Order for the Protection of the Southern Resident Killer Whale (Orcinus orca) in the Waters of Southern British Columbia, 2026 under subsection 10.1(1)footnote e of the Canada Shipping Act, 2001 footnote d.

Interim Order for the Protection of the Southern Resident Killer Whale (Orcinus orca) in the Waters of Southern British Columbia, 2026
Definition
Definition of Southern Resident killer whale
1 In this Interim Order, Southern Resident killer whale means any member of the Killer Whale (Orcinus orca) Northeast Pacific southern resident population.
Non-application
Vessels
2 (1) This Interim Order does not apply to
- (a) a vessel that is in distress or providing assistance to a vessel or person in distress;
- (b) a vessel that is involved in pollution response operations;
- (c) a vessel that is avoiding an immediate or unforeseen danger; or
- (d) a vessel that is carrying a person referred to in paragraph (2)(a).
Persons
(2) This Interim Order does not apply to
- (a) an employee of the Government of Canada or a peace officer who is performing their duties, or a person who is assisting them or who is otherwise present at the request of the Government of Canada; or
- (b) a person who is operating a vessel referred to in any of paragraphs (1)(a) to (d).
Approach Distance Prohibition
Vessels
3 (1) A vessel must not approach within 1 000 m of a Southern Resident killer whale in the waters set out in Schedule 1.
Exceptions
(2) Subsection (1) does not apply to
- (a) a vessel in transit; or
- (b) a vessel carrying a person referred to in any of paragraphs 4(2)(a) to (c).
Persons
4 (1) A person operating a vessel must not approach within 1 000 m of a Southern Resident killer whale in the waters set out in Schedule 1.
Exceptions
(2) Subsection (1) does not apply to
- (a) a person acting in a manner authorized under the Species at Risk Act;
- (b) a person authorized under subsection 38(1) of the Marine Mammal Regulations to disturb a Southern Resident killer whale;
- (c) a person fishing for marine mammals for experimental, scientific, educational or public display purposes in the manner set out in a licence issued under the Fishery (General) Regulations; or
- (d) a person operating a vessel referred to in paragraph 3(2)(a) or (b).
Vessel Restricted Zones
Vessels
5 (1) A vessel must not navigate in the waters set out in Schedule 2 on or before November 30, 2026.
Exceptions
(2) Subsection (1) does not apply to
- (a) a vessel being used to access a private residence, a commercial establishment or any other establishment providing a service, if travel in the waters set out in Schedule 2 is the only practical means of access and the vessel is navigating directly between
- (i) a location on Pender Island or Saturna Island and another location on one of those islands,
- (ii) a location on Pender Island or Saturna Island and another location beyond the waters set out in Schedule 2,
- (iii) a location on Pender Island or Saturna Island and a mooring buoy located in the waters set out in Schedule 2, or
- (iv) a mooring buoy located in the waters set out in Schedule 2 and a location beyond those waters;
- (b) a human-powered vessel navigating at a distance of 20 m or less from the shoreline — meaning the line where the water surface touches the land — in the waters set out in items 1 and 2 of Schedule 2;
- (c) a vessel being used to fish under a licence issued under the Aboriginal Communal Fishing Licences Regulations
- (i) for food, social or ceremonial purposes, or
- (ii) for domestic purposes under a treaty within the meaning of section 35 of the Constitution Act, 1982; or
- (d) a vessel carrying a person referred to in any of paragraphs 6(2)(a) to (f).
Persons
6 (1) A person must not operate a vessel in the waters set out in Schedule 2 on or before November 30, 2026.
Exceptions
(2) Subsection (1) does not apply to
- (a) a person acting in a manner authorized under the Species at Risk Act;

- (f) an Indigenous person exercising an existing right, other than for fishing, for non-commercial purposes under section 35 of the Constitution Act, 1982; or
- (g) a person operating a vessel referred to in any of paragraphs 5(2)(a) to (d).
Speed Restricted Zones
Vessels
7 (1) A vessel must not proceed at a speed in excess of 10 knots over ground in the waters set out in Schedule 3 on or before November 30, 2026.
Exceptions
(2) Subsection (1) does not apply to a vessel that is operating without a motor.
Persons
8 (1) A person must not operate a vessel at a speed in excess of 10 knots over ground in the waters set out in Schedule 3 on or before November 30, 2026.
Exceptions
(2) Subsection (1) does not apply to a person operating a vessel referred to in subsection 7(2).
Repeal
9 The Interim Order for the Protection of the Killer Whale (Orcinus orca) in the Waters of Southern British Columbia, 2025, made on May 30, 2025, is repealed.
Coming into Force
June 1, 2026
10 This Interim Order comes into force on June 1, 2026, but if it is made after that day, it comes into force on the day on which it is made.

Interim Order Respecting the False Creek Exclusion Zone
Whereas the Minister of Transport believes that the annexed Interim Order Respecting the False Creek Exclusion Zone is required to deal with a direct or indirect risk to marine safety or to the marine environment;
And whereas the provisions of this annexed Interim Order may be contained in a regulation made under paragraphs 136(1)(f)footnote c and (h)footnote a of the Canada Shipping Act, 2001 footnote d;
Therefore, the Minister of Transport makes the annexed Interim Order Respecting the False Creek Exclusion Zone under subsection 10.1(1)footnote e of the Canada Shipping Act, 2001 footnote b.

Interim Order Respecting the False Creek Exclusion Zone
Definition
Definition of exclusion zone
1 In this Interim Order, exclusion zone means the area of False Creek, Vancouver, in British Columbia, east of the Cambie Bridge.
Prohibitions
Pleasure craft
2 (1) The owner or operator of a pleasure craft must not allow it to navigate, anchor, moor or berth in the waters of the exclusion zone.
Vessels carrying passengers
(2) The authorized representative of a vessel that is carrying passengers must not allow it to navigate, anchor, moor or berth in the waters of the exclusion zone.
Exceptions — Pleasure Craft
Exceptions
3 Subsection 2(1) does not apply in respect of a pleasure craft that
- (a) is subject to a mooring agreement with a marina located within the exclusion zone, if the pleasure craft
- (i) is transiting from the marina to waters outside the exclusion zone by the most direct route, or vice-versa, or
- (ii) is anchored, moored or berthed at the marina;
- (b) is in distress or is being used to provide assistance to a vessel or person in distress;
- (c) is forced to navigate, anchor, moor, or berth in waters in the exclusion zone to avoid immediate danger;
- (d) is being used by an employee of the Government of Canada or a peace officer in the performance of their duties or by a person who is assisting them or who is otherwise present at the request of the Government of Canada;
- (e) is being used to fish, under a licence issued under the Aboriginal Communal Fishing Licences Regulations,
- (i) for food, social or ceremonial purposes, or
- (ii) for domestic purposes under a treaty within the meaning of section 35 of the Constitution Act, 1982; or
- (f) is being used for non-commercial purposes by an Indigenous person exercising an existing right, other than for fishing, under section 35 of the Constitution Act, 1982.
Exceptions — Vessels Carrying Passengers
Exceptions
4 Subsection 2(2) does not apply in respect of a vessel carrying passengers that
- (a) is subject to a mooring agreement with a marina located within the exclusion zone, if the vessel
- (i) is transiting from the marina to waters outside the exclusion zone by the most direct route, or vice-versa, or
- (ii) is anchored, moored or berthed at the marina;
- (b) is in distress or is providing assistance to a vessel or person in distress;
- (c) is forced to navigate, anchor, moor, or berth in waters in the exclusion zone to avoid immediate danger;
- (d) is being used by an employee of the Government of Canada or a peace officer in the performance of their duties or by a person who is assisting them or who is otherwise present at the request of the Government of Canada;
- (e) is transporting a representative of the Government of Canada or of a province for the purpose of their attending an event in an official capacity; or
- (f) operates a regularly scheduled service along the False Creek waterway with stops at the Plaza of Nations dock and the Olympic Village dock.
Enforcement
Enforcement officers
5 For the purpose of ensuring compliance with section 2, the following persons or classes of persons are appointed or specified as enforcement officers:
- (a) marine safety inspectors;
- (b) marine security inspectors;
- (c) members of the Royal Canadian Mounted Police;
- (d) members of any harbour or river police force;
- (e) members of any provincial, county or municipal police force; and
- (f) persons designated as a fishery officer under subsection 5(1) of the Fisheries Act.
Powers
6 An enforcement officer may
- (a) prohibit the movement of any vessel or direct it to move as specified by the enforcement officer; and
- (b) stop and board any vessel at any reasonable time and
- (i) direct any person to put into operation or cease operating any equipment on board the vessel,
- (ii) ask any pertinent questions of, and demand all reasonable assistance from, any person on board the vessel, and
- (iii) require that any person on board the vessel provide the enforcement officer with any document or information, for examination, that is in the person’s possession.
Repeal
7 This Interim Order is repealed on July 8, 2026.
Coming into Effect
June 1, 2026
8 This Interim Order comes into effect on June 1, 2026, but if it is made after that day, it comes into force effect on the day on which it is made.

Interim Order No. 4 Respecting Area 2 of the Pacific Pilotage Authority Region
Whereas the Minister of Transport believes that the annexed Interim Order No. 4 Respecting Area 2 of the Pacific Pilotage Authority Region is required to deal with an urgent issue related to the provision of pilotage services that poses a significant risk to safety, human health or the environment;
And whereas the provisions of the annexed Interim Order may be contained in a regulation made under the Pilotage Act footnote f;
Therefore, the Minister of Transport makes the annexed Interim Order No. 4 Respecting Area 2 of the Pacific Pilotage Authority Region under subsection 52.2(1)footnote g of the Pilotage Act footnote a.

Interim Order No. 4 Respecting Area 2 of the Pacific Pilotage Authority Region
Definitions
1 The following definitions apply in this Interim Order.
- crude oil
- means any liquid hydrocarbon mixture occurring naturally in the earth, whether or not treated to render it suitable for transportation, and includes:
- (a) crude oil from which distillate fractions have been removed; and
- (b) crude oil to which distillate fractions have been added. (pétrole brut)
- crude oil tanker
- means an oil tanker engaged in the trade of carrying crude oil. (transporteur de pétrole brut)
- Regulations
- means the General Pilotage Regulations. (Règlement)
Extended compulsory pilotage area
2 Area 2 of the region of the Pacific Pilotage Authority, described in paragraph 1(b) of Schedule 5 to the Regulations, is deemed to include all waters enclosed within a line commencing from a position at Latitude 48°15′48″ N., Longitude 123°21′12″ W., and thence, to a position at Latitude 48°22′27″ N., Longitude 123°23′12″ W., and thence, to a position at Latitude 48°22′27″ N., Longitude 123°25′48″ W., and thence, to a position at Latitude 48°16′03″ N., Longitude 123°29′36″ W., and thence, to a position at Latitude 48°15′54″ N., Longitude 123°31′48″ W., and thence, to a position at Latitude 48°16′21″ N., Longitude 123°34′00″ W., and thence, to a position at Latitude 48°14′42″ N., Longitude 123°34′00″ W., and thence, to a position at Latitude 48°14′29″ N., Longitude 123°32′00″ W., and thence, back to position at Latitude 48°15′48″ N., Longitude 123°21′12″ W.
Ships subject to compulsory pilotage
3 Despite subsection 25.9(1) of the Regulations, only laden crude oil tankers with a summer deadweight tonnage of 40,000 or more are subject to compulsory pilotage within Area 2 of the region of the Pacific Pilotage Authority, as extended under section 2.
Additional required information in notice
4 In addition to the information required under section 25.13 of the Regulations, the notice referred to in section 25.12 of the Regulations must indicate the nature of any cargo on board the ship.
Repeal
5 The Interim Order No. 3 Respecting Area 2 of the Pacific Pilotage Authority Region, made on May 30, 2025, is repealed.

Interim Order No. 5 Respecting the Belledune Compulsory Pilotage Area
Whereas the Minister of Transport believes that the annexed Interim Order No. 5 Respecting the Belledune Compulsory Pilotage Area is required to deal with an urgent issue related to the provision of pilotage services that poses a significant risk to safety, human health or the environment;
And whereas the provisions of the annexed Interim Order may be contained in a regulation made under the Pilotage Act footnote f;
Therefore, the Minister of Transport makes the annexed Interim Order No. 5 Respecting the Belledune Compulsory Pilotage Area under subsection 52.2(1)footnote g of the Pilotage Act footnote a.

2 The area consisting of all the navigable waters within an arc having a radius of two nautical miles measured from the breakwater light at Latitude 47°54′48″ N., Longitude 65°50′18″ W. is deemed to be described in Schedule 2 to the Regulations as the Belledune compulsory pilotage area within the Atlantic Pilotage Authority’s region.
Experience at sea — pilotage certificate
3 An applicant for a pilotage certificate for the Belledune compulsory pilotage area does not have to meet the additional experience at sea qualifications set out in subsection 22.22(1) of the Regulations if, within the two-year period immediately before the date of the application, they have successfully completed a familiarization program that is established by the Atlantic Pilotage Authority and provides an equivalent degree of experience.
Repeal
4 The Interim Order No. 4 Respecting the Belledune Compulsory Pilotage Area, made on June 3, 2025, is repealed.

Interim Order No. 5 Respecting the Sheet Harbour Compulsory Pilotage Area
Whereas the Minister of Transport believes that the annexed Interim Order No. 5 Respecting the Sheet Harbour Compulsory Pilotage Area is required to deal with an urgent issue related to the provision of pilotage services that poses a significant risk to safety, human health or the environment;
And whereas the provisions of the annexed Interim Order may be contained in a regulation made under the Pilotage Act footnote f;
Therefore, the Minister of Transport makes the annexed Interim Order No. 5 Respecting the Sheet Harbour Compulsory Pilotage Area under subsection 52.2(1)footnote g of the Pilotage Act footnote a.

Interim Order No. 5 Respecting the Sheet Harbour Compulsory Pilotage Area
Definition of Regulations
1 In this Interim Order, Regulations means the General Pilotage Regulations.
Compulsory pilotage area
2 The area consisting of all the navigable waters within a line drawn from a position at Latitude 44°50′45″ N., Longitude 62°32′12″ W. to Guilford Rock, thence to a position at Latitude 44°45′36″ N., Longitude 62°29′30″ W., thence to Western Shagroost Island, thence to Fishery Island, and thence to a position at Latitude 44°51′21″N. , Longitude 62°28′15″ W. is deemed to be described in Schedule 2 to the Regulations as the Sheet Harbour compulsory pilotage area within the Atlantic Pilotage Authority’s region.
Ships subject to compulsory pilotage
3 (1) Despite subsection 22.3(1) of the Regulations, only the following ships and classes of ships are subject to compulsory pilotage within the Sheet Harbour compulsory pilotage area:
- (a) ships of 170 m or more in length;
- (b) tankers; and
- (c) liquid natural gas carriers.
Ships not subject to compulsory pilotage
(2) However, the ships and classes of ships referred to in subsection 22.3(2) of the Regulations are not subject to compulsory pilotage within the Sheet Harbour compulsory pilotage area.
Exception
(3) A ship referred to in paragraph 22.3(2)(b), (c), (d), (e) or (f) of the Regulations is subject to compulsory pilotage within the Sheet Harbour compulsory pilotage area if the Atlantic Pilotage Authority determines that the ship poses a risk to safe navigation for any of the following reasons:
- (a) the seaworthiness of the ship;
- (b) unusual conditions on board the ship;
- (c) operations being conducted by the ship;
- (d) weather conditions, tides, currents or ice.
