Interim Order Respecting the Recycling of Vessels

Whereas the Minister of Transport believes that the annexed Interim Order Respecting the Recycling of Vessels is required to deal with a direct or indirect risk to marine safety or to the marine environment;

And whereas the provisions of the annexed Interim Order may be contained in a regulation made under paragraphs 35.1(1)(d)footnote a and 190(1)(c) of the Canada Shipping Act, 2001 footnote b;

Therefore, the Minister of Transport makes the annexed Interim Order Respecting the Recycling of Vessels under subsection 10.1(1)footnote c of the Canada Shipping Act, 2001 footnote b.

Interim Order Respecting the Recycling of Vessels

Definitions

Definitions

1 The following definitions apply in this Interim Order.

hazardous materials
means the materials listed in Appendix 2 to the Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships, 2009. (matières dangereuses)
Inventory of Hazardous Materials
means a record of the quantity and location of all the hazardous materials on board a vessel, including materials contained in the structure and the equipment of the vessel. (inventaire de matières dangereuses)
owner,
in respect of a Canadian vessel, means the owner registered in the Canadian Register of Vessels under Part 2 of the Canada Shipping Act, 2001 (propriétaire).
recycling,
in respect of a vessel, means the complete or partial dismantling of a vessel at a recycling facility in order to recover components and materials for reprocessing and reuse, while taking care of hazardous materials and any other materials, and includes associated operations such as on-site storage and treatment of components and materials. It does not include the repair or maintenance of a vessel. (recyclage)
recycling facility
means a defined area that is a site, yard or facility used for vessel recycling. (installation de recyclage)

Application

Vessels of 500 gross tonnage or more

2 This Interim Order applies in respect of the following vessels of 500 gross tonnage or more, other than government vessels, that are en route to a recycling facility to be recycled at that facility:

Requirements

Inventory of Hazardous Materials

3 (1) The owner of a vessel must keep an up-to-date Inventory of Hazardous Materials on board the vessel.

Availability

(2) The owner must ensure that the Inventory of Hazardous Materials is available to the master, the crew members and any person in charge of the recycling facility.

Preparation for recycling

4 The owner of a vessel must take measures to minimize the amount of cargo residues, fuel oil residues and waste remaining on board a vessel in preparation for recycling and keep on board the vessel a record of the measures taken.

Coming into Force

April 1, 2026

5 This Interim Order comes into force on April 1, 2026, but if it is made after that day, it comes into force on the day on which it is made.
