The Canadian International Trade Tribunal has received a complaint from Samdesk Canada Inc. (Samdesk), of Edmonton, Alberta, concerning a procurement (solicitation WS5357907637) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation is for the provision of Open-Source Intelligence (OSINT) GlobalConflictData Subscription.

Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on March 2, 2026, to conduct an inquiry into the complaint.

Samdesk alleges that PWGSC breached requirements of the applicable trade agreements by issuing a sole sourced, directed contact where the reason for limited tendering, namely the involvement of exclusive rights, was improper or unjustified.

INQUIRY NQ-2025-009 — NOTICE OF COMMENCEMENT OF INQUIRY

Truck bodies

Notice was received by the Canadian International Trade Tribunal on March 6, 2026, from the Director General of the Trade and Anti-dumping Programs Directorate at the Canada Border Services Agency (CBSA), stating that preliminary determinations had been made respecting the dumping and subsidizing of truck bodies, having an exterior length of 8.5 feet to 32 feet, inclusively, of maximum exterior width of 103 inches, whether assembled or unassembled, being the structure or fixture designed to be affixed to a truck chassis for the primary purpose of containing or supporting goods for on-road transportation, whether insulated or not, and whether equipped with refrigerating equipment or not, as well as truck body kits, assemblies, or subassemblies, originating in or exported from the People’s Republic of China, excluding:

  1. truck bodies for the primary purpose of bulk transporting liquids or gases;
  2. refuse truck bodies, being specialized truck bodies designed and constructed for the primary purpose of collecting, compacting, and transporting solid waste, of the kind used for municipal waste collection; and
  3. truck bodies that incorporate a hydraulic or mechanical system that permits the body to be elevated, tipped, or tilted for loading or unloading, such as dump truck bodies used for the transport of bulk materials, such as sand, gravel, or demolition debris, and flatbed tow truck bodies used for the transport of vehicles.

Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry to determine whether the dumping and subsidizing of the above-mentioned goods have caused injury or retardation or are threatening to cause injury, to make inquiries with respect to massive importations, and to determine such other matters as the Tribunal is required to determine under that section.

Each person or government wishing to participate in the inquiry and at the hearing as a party must file Form I—Notice of Participation with the Tribunal, on or before March 23, 2026. Each counsel who intends to represent a party in the inquiry and at the hearing must file Form II—Notice of Representation and Form III—Declaration and Undertaking with the Tribunal, on or before March 23, 2026.

On April 27, 2026, the Tribunal will issue a list of participants. Counsel and self-represented participants are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those participants who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed Form III—Declaration and Undertaking with the Tribunal. This information will be included in the list of participants. One complete electronic version of all submissions must be filed with the Tribunal.

The Tribunal will hold a hearing relating to this inquiry commencing on June 1, 2026, to hear evidence and representations by interested parties. The type of hearing will be communicated at a later date.

NOTICE OF DECISION

Certain softwood lumber products from Canada

Notice is hereby given, pursuant to rule 70 of the North American Free Trade Agreement (NAFTA) Rules of Procedure for Article 1904 Binational Panel Reviews, that the binational panel established to review the Final Affirmative Countervailing Duty Determination made by the United States Department of Commerce, respecting “Certain Softwood Lumber Products from Canada,” issued its Decision on the Redetermination on Remand on March 6, 2026 (Secretariat File No. USA-CDA-2017-1904-02).

In the March 6, 2026, Decision on first remand, the binational panel affirmed in part and remanded in part the United States Department of Commerce’s decision and instructed the investigating authority to provide its redetermination on remand by June 4, 2026.

The decision is available on the Secretariat’s website under “Decisions and Reports” in the “Publications” section.

EXPLANATORY NOTE

Chapter 19 of NAFTA establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.

Under Article 1904 of NAFTA, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part I, on January 1, 1994, and as amended, on March 29, 2008.
