CANADA MARINE ACT
Hamilton-Oshawa Port Authority — Supplementary letters patent
WHEREAS the Governor in Council issued a Certificate of Amalgamation containing letters patent to amalgamate the Hamilton Port Authority and the Oshawa Port Authority and to continue as one port authority named the Hamilton-Oshawa Port Authority (“Authority”), effective June 18, 2019;
WHEREAS Schedule C of the letters patent sets out the real property, other than federal real property, held or occupied by the Authority;
WHEREAS, pursuant to subsection 46(2) of the Canada Marine Act (“Act”), the Authority wishes to dispose of real property as described below;
WHEREAS the board of directors of the Authority has requested that the Minister of Transport (“Minister”) issue supplementary letters patent to amend Schedule C of the letters patent;
AND WHEREAS the Minister is satisfied that the amendment to the letters patent is consistent with the Act,
NOW THEREFORE, pursuant to subsection 9(1) of the Act, the letters patent are amended as follows:
- Schedule C of the letters patent is amended by adding the following after the description of “Part 1 (Hamilton) 3.”:

CANADA MARINE ACT
Hamilton-Oshawa Port Authority — Supplementary letters patent
WHEREAS letters patent were issued by the Minister of Transport (“Minister”) for the Hamilton-Oshawa Port Authority (“Authority”) under the authority of the Canada Marine Act (“Act”), effective November 29, 2024;
WHEREAS Schedule B of the letters patent describes the federal real property or federal immovables managed by the Authority;
WHEREAS on November 29, 2024, the Minister issued supplementary letters patent to the Authority to exchange federal real properties for other real properties of comparable value belonging to the City of Oshawa;
WHEREAS, due to an administrative error, the plan number describing one of the real properties was incorrectly described, the transaction to exchange the real properties described in the November 29, 2024, supplementary letters patent has not yet taken place due to the discovery of the error;
WHEREAS the board of directors of the Authority has requested that the Minister issue supplementary letters patent to correct the error in the description of the real property being acquired by the Authority, by replacing the incorrect plan number with the correct plan number described below in Schedule B of the letters patent;
AND WHEREAS the Minister is satisfied that the amendment to the letters patent of the Authority is consistent with the Act,
NOW THEREFORE, pursuant to subsection 9(1) of the Act, the letters patent of the Authority are amended as follows:
- Item 17 of Part 2 (Oshawa) of Schedule B of the letters patent is replaced by the following:
- 17. PIN 16378-0030 (LT), Parts 1, 2, and 3 on Plan 40R-32410.
- These supplementary letters patent take effect on the date of registration, in the Oshawa Land Registry Office, of the deeds of sale evidencing the exchange of real property described above between the Authority and the City of Oshawa.

CANADA MARINE ACT
Saint John Port Authority — Supplementary letters patent
BY THE MINISTER OF TRANSPORT
WHEREAS letters patent were issued by the Minister of Transport (“Minister”) for the Saint John Port Authority (“Authority”), under the authority of the Canada Marine Act (“Act”), effective May 1, 1999;
WHEREAS section 9.2 of the letters patent sets out a limit on the power of the Authority to borrow money on its credit for port purposes;
WHEREAS the board of directors of the Authority has requested that the Minister issue supplementary letters patent to increase the aggregate limit on the power of the Authority to borrow money on the credit of the Authority for port purposes set out in section 9.2 of the letters patent;
WHEREAS, by Order in Council P.C. 2025-975 of December 18, 2025, the Governor in Council, pursuant to subsection 8(5) of the Act, approved the provisions of the proposed supplementary letters patent for the purposes of increasing the aggregate limit on the power of the Authority to borrow money on the credit of the Authority for port purposes;
AND WHEREAS the Minister is satisfied that the amendment to the letters patent is consistent with the Act;
NOW THEREFORE, pursuant to subsection 9(1) of the Act, the letters patent are amended as follows:
- Section 9.2 of the letters patent issued to the Saint John Port Authority is replaced by the following:
9.2 Restriction on Incurrence of Borrowing. The Authority shall not incur any item of Borrowing so that the aggregate Borrowing of the Authority would exceed $70,000,000.

Vancouver Fraser Port Authority — Supplementary letters patent
WHEREAS the Governor in Council issued a Certificate of Amalgamation containing letters patent to amalgamate the Vancouver Port Authority, the Fraser River Port Authority and the North Fraser Port Authority and to continue as one port authority named the Vancouver Fraser Port Authority (“Authority”), effective January 1, 2008;
WHEREAS Schedule B of the letters patent describes the federal real property or federal immovables managed by the Authority;
WHEREAS the Minister of Transport may transfer the management of federal real property or federal immovables administered by another member of the King’s Privy Council for Canada to the Authority, under paragraph 44(2)(b) of the Canada Marine Act (“Act”), if the Minister of Transport has the consent of the other member;
WHEREAS the Minister of Transport wishes to transfer management of the federal immovable described below, located on the South Arm Channel of the Fraser River in British Columbia, and administered by the Minister of Fisheries, to the Authority;
WHEREAS the Minister of Transport has received consent from the Minister of Fisheries to transfer the management of this federal immovable to the Authority;
WHEREAS the board of directors of the Authority has requested that the Minister of Transport issue supplementary letters patent amending Schedule B of its letters patent to reflect this transfer of management;
AND WHEREAS the Minister is satisfied that the amendment to the letters patent is consistent with the Act,
NOW THEREFORE, pursuant to subsection 9(1) of the Act, the letters patent are amended as follows:
- Schedule B of the letters patent of the Authority is amended by adding the following to the list of federal real property in paragraph 3 after the entry containing “Encumbrance Number 273757C”:
INTEREST LANDS TO WHICH INTEREST RELATES Part of Fraser River Trifurcation Wall – Phase 1 (Fixture) Part of the structure located in the Main Arm of the Fraser River, adjacent to the DP World Fraser Surrey site at 11060 Elevator Road, Surrey, BC, described as Part of the Fraser River Trifurcation Wall – Phase 1, comprising Section 1, Section 2, and Section 3 as shown on Reference Plan FR-83-10. - These supplementary letters patent take effect on the date of issuance.
