CANADIAN INTERNATIONAL TRADE TRIBUNAL

FILE PR-2025-014 — NOTICE OF DETERMINATION

Night vision equipment

Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination on November 17, 2025, with respect to a complaint filed by Cadex Inc. (Cadex), of Saint-Jean-sur-Richelieu, Quebec, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (solicitation WS4843480208) by the Department of Public Works and Government Services on behalf of the Department of National Defence. The solicitation was for binocular night vision devices with in-service support for the Canadian Armed Forces.

Cadex had alleged that a technical requirement, namely the minimum signal-to-noise ratio, specified in the request for proposal, was unreasonable and impossible to meet, and resulted in the procurement being a disguised sole-source contract.

Having examined the evidence presented by the parties, the Tribunal determined that the complaint was valid.

Further information may be obtained from the Registry, 613‑993‑3595 (telephone), citt-tcce@tribunal.gc.ca (email).
