SPECIAL IMPORT MEASURES ACT

Certain carbon and alloy steel wire — Decision

On September 4, 2025, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made a preliminary determination of dumping concerning certain carbon and alloy steel wire from China, Chinese Taipei, India, Italy, Malaysia, Portugal, Spain, Thailand, Türkiye, and Vietnam.

The Canadian International Trade Tribunal (CITT) will conduct a full inquiry into the question of injury to the Canadian industry and will make an order or finding no later than 120 days after its receipt of the notice of the preliminary determination of dumping.

Pursuant to section 8 of SIMA, provisional duties are payable on the subject goods that are released from the CBSA during the period commencing September 4, 2025, and ending on the earlier of the day the investigation is terminated, the day on which the CITT makes an order or finding, or the day an undertaking is accepted.

The amount of provisional duties payable is not greater than the estimated margin of dumping. The Customs Act applies with respect to the accounting and payment of provisional duty. Therefore, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

The full product definition and potential applicable tariff classification numbers are found on the CBSA’s Dumping and subsidy investigations web page. The Statement of Reasons regarding this decision will be issued within 15 days following the decision.

Call centre training

The Canadian International Trade Tribunal has received a complaint from Formation New Era Inc. & Martin Robichaud EduCo Services Inc. in Joint Venture (FNE), of Vaudreuil-Dorion, Quebec, concerning a procurement (solicitation 100028281) made by the Department of Employment and Social Development (ESDC). The solicitation was for the services of training facilitators for the delivery of several virtual trainings to ESDC call centre employees. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on September 2, 2025, to conduct an inquiry into the complaint.

FNE alleges numerous flaws and irregularities in the evaluation process, including that ESDC inconsistently applied evaluation criteria, among other things.

INQUIRY NQ-2025-003 — NOTICE OF COMMENCEMENT OF INQUIRY

Certain carbon or alloy steel wire

Notice was received by the Canadian International Trade Tribunal on September 4, 2025, from the Director General of the Trade and Antidumping Programs Directorate at the Canada Border Services Agency (CBSA), stating that a preliminary determination had been made respecting the dumping of carbon or alloy steel wire, of round or other solid cross section, in nominal sizes up to and including 24.13 mm (0.950 inches) in diameter, whether or not coated or plated with zinc, zinc-aluminum alloy, or any other coating, including other base metals or polyvinyl chloride or other plastics, originating in or exported from the People’s Republic of China, the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei), the Republic of India, the Italian Republic, the Federation of Malaysia, the Portuguese Republic, the Kingdom of Spain, the Kingdom of Thailand, the Republic of Türkiye and the Socialist Republic of Vietnam, excluding the following:

Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry to determine whether the dumping of the above-mentioned goods has caused injury or retardation or is threatening to cause injury, to make inquiries with respect to massive importations, and to determine such other matters as the Tribunal is required to determine under that section.

Each person or government wishing to participate in the inquiry and at the hearing as a party must file Form I—Notice of Participation with the Tribunal, on or before September 19, 2025. Each counsel who intends to represent a party in the inquiry and at the hearing must file Form II—Notice of Representation and Form III—Declaration and Undertaking with the Tribunal, on or before September 19, 2025.

On October 24, 2025, the Tribunal will issue a list of participants. Counsel and self-represented participants are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those participants who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed Form III—Declaration and Undertaking with the Tribunal. This information will be included in the list of participants. One complete electronic version of all submissions must be filed with the Tribunal.

The Tribunal will hold a hearing relating to this inquiry commencing on December 1, 2025, to hear evidence and representations by interested parties. The type of hearing will be communicated at a later date.

EXPLANATORY NOTE

Chapter 10 of CUSMA establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a CUSMA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the CUSMA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.

Under Article 10.12 of CUSMA, which came into force on July 1, 2020, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 10.12 (Binational Panel Reviews). These rules were adopted by the CUSMA Free-Trade Commission on July 2, 2020.

SPECIES AT RISK ACT

Description of critical habitat of Chestnut-collared Longspur in Grasslands National Park of Canada

The Chestnut-collared Longspur (Calcarius ornatus) is a small ground-nesting songbird. During the breeding season, males can be readily distinguished from females by their black and white plumage and chestnut patch on their nape. Females appear more sparrow-like and are greyish-buff overall with dusky stripes. Chestnut-collared Longspur are a migratory bird protected under the Migratory Birds Convention Act, 1994 and are listed on Schedule 1 of the Species at Risk Act. In Canada, the Chestnut-collared Longspur breeding population is found in grazed mixed-grass prairie parcels that are at least 39 hectares, in southeastern Alberta, southern Saskatchewan, and southwestern Manitoba.

The Amended Recovery Strategy for the Chestnut-collared Longspur (Calcarius ornatus) in Canada - 2018 identifies critical habitat for the species in a number of areas, including within Grasslands National Park of Canada.

Notice is hereby given, pursuant to subsection 58(3) of the Species at Risk Act, that 90 days after the date of publication of this notice, subsection 58(1) of the Act will apply to the critical habitat of the Chestnut-collared Longspur, identified in the recovery strategy for the species that is included in the Species at Risk Public Registry, and that is located within Grasslands National Park of Canada, the boundaries of which are described in Schedule 1 to the Canada National Parks Act.
