Polyethylene terephthalate resin — Decisions

On June 17, 2025, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) has made preliminary determinations of dumping of polyethylene terephthalate (PET) resin from China and Pakistan, and subsidizing of PET resin from China.

The subject goods are usually classified under the following tariff classification numbers:

The above-listed tariff classification numbers cover both subject and non-subject goods.

The Canadian International Trade Tribunal (CITT) will conduct a full inquiry into the question of injury to the Canadian industry and will make an order or finding no later than 120 days after its receipt of the notice of the preliminary determinations of dumping and subsidizing.

Pursuant to section 8 of SIMA, provisional duties are payable on the subject goods that are released from the CBSA during the period commencing June 17, 2025, and ending on the earlier of the day the investigations are terminated, the day on which the CITT makes an order or finding, or the day an undertaking is accepted.

The amount of provisional duties payable is not greater than the estimated margin of dumping and the estimated amount of subsidy. The Customs Act applies with respect to the accounting and payment of provisional duty. Therefore, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

Information

The Statement of Reasons regarding these decisions will be issued within 15 days following the decisions and will be available on the CBSA website.

Notice is given that on June 18, 2025, pursuant to paragraph 76.03(12)(b) of the Special Import Measures Act (SIMA), the Canadian International Trade Tribunal continued, without amendment, its order in respect of circular copper tube originating in or exported from the Federative Republic of Brazil, the Hellenic Republic, the People’s Republic of China and the Republic of Korea. In addition, pursuant to paragraph 76.03(12)(b) and subsection 76.04(1) of SIMA, the Tribunal continued, without amendment, its order in respect of the aforementioned goods originating in or exported from the United Mexican States. INQUIRY NQ-2025-002 — NOTICE OF COMMENCEMENT OF INQUIRY

Polyethylene terephthalate

Notice was received by the Canadian International Trade Tribunal on June 17, 2025, from the Director General of the Trade and Anti-dumping Programs Directorate at the Canada Border Services Agency (CBSA), stating that preliminary determinations had been made respecting the dumping of polyethylene terephthalate (“PET”) resin having an intrinsic viscosity of at least 0.70 decilitres per gram but not more than 0.88 decilitres per gram, including PET resin that contains various additives introduced in the manufacturing process, as well as blends of virgin PET resin and recycled PET, originating in or exported from the People’s Republic of China and the Islamic Republic of Pakistan, excluding 100% recycled PET resin, and the subsidizing of the above-mentioned goods from the People’s Republic of China.

Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry to determine whether the dumping and subsidizing of the above-mentioned goods have caused injury or retardation or are threatening to cause injury, to make inquiries with respect to massive importations, and to determine such other matters as the Tribunal is required to determine under that section.

Each person or government wishing to participate in the inquiry and at the hearing as a party must file Form I—Notice of Participation with the Tribunal, on or before July 2, 2025. Each counsel who intends to represent a party in the inquiry and at the hearing must file Form II—Notice of Representation and Form III—Declaration and Undertaking with the Tribunal, on or before July 2, 2025.

On August 6, 2025, the Tribunal will issue a list of participants. Counsel and self-represented participants are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those participants who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed Form III—Declaration and Undertaking with the Tribunal. This information will be included in the list of participants. One complete electronic version of all submissions must be filed with the Tribunal.

The Tribunal will hold a hearing relating to this inquiry commencing on September 15, 2025, to hear evidence and representations by interested parties. The type of hearing will be communicated at a later date.

Notice is hereby given that on June 19, 2025, pursuant to subsection 37.1(1) of the Special Import Measures Act, the Canadian International Trade Tribunal determined that there is evidence that discloses a reasonable indication that the dumping of carbon or alloy steel wire, of round or other solid cross section, in nominal sizes up to and including 24.13 mm (0.950 inches) in diameter, whether or not coated or plated with zinc, zincaluminum alloy, or any other coating, including other base metals or polyvinyl chloride or other plastics, originating in or exported from the People’s Republic of China, the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei), the Republic of India, the Italian Republic, the Federation of Malaysia, the Portuguese Republic, the Kingdom of Spain, the Kingdom of Thailand, the Republic of TĂĽrkiye and the Socialist Republic of Vietnam, has caused injury to the domestic industry. PRELIMINARY INJURY INQUIRY PI-2025-003 — NOTICE OF COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Thermal paper rolls

The Canadian International Trade Tribunal gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry to determine whether there is evidence that discloses a reasonable indication that the dumping and subsidizing of thermal paper rolls in nominal widths up to and including 15 centimetres, with a nominal paper weight of 70 grams per square meter (“gsm”) or less and a thermal active coating on one or both sides comprised of a dye and a developer that react and form an image when heat is applied, excluding thermal paper rolls with an adhesive backing, originating in or exported from the People’s Republic of China (the subject goods), have caused injury or retardation or are threatening to cause injury, as these words are defined in SIMA.

The Tribunal’s preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file Form I—Notice of Participation with the Tribunal, on or before June 25, 2025. Each counsel who intends to represent a party in the preliminary injury inquiry must file Form II—Notice of Representation and Form III—Declaration and Undertaking with the Tribunal, on or before June 25, 2025.

On June 30, 2025, the Tribunal will issue a list of participants. Counsel and self-represented participants are required to serve their respective submissions on each other on the dates outlined below.
