CANADIAN INTERNATIONAL TRADE TRIBUNAL
DETERMINATION
Information technology consultation services
Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (file PR-2024-056) on April 7, 2025, with respect to a complaint filed by Primex Project Management Ltd. (Primex), of Winchester, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (solicitation WS4345162973) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the provision of informatics professional services.
Primex alleged various and multiple irregularities in the procurement process, including that the winning bidder did not have qualified resources in place at the time of bid submission, as required by the solicitation, and instead had resorted to poaching employees from Primex following the award of the contract.
Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was not valid.

Cloud-based services
The Canadian International Trade Tribunal has received a complaint (file PR-2024-084) from Micro Logic Sainte-Foy Ltée (Micro Logic), of Québec, Quebec, concerning a procurement (solicitation CS-IAAS-2024) made by Shared Services Canada. The solicitation is for the provision of cloud-based infrastructure as a service and native platform as a service. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on March 14, 2025, to conduct an inquiry into the complaint.
Micro Logic alleges that its elimination for non-compliance with a mandatory criterion at the pre-qualification stage consists in an unreasonable assessment and that proof of the required certifications was included in its bid.
