Polyethylene terephthalate resin — Decision

On March 19, 2025, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping of polyethylene terephthalate (PET) resin originating in or exported from the People’s Republic of China (China) and the Islamic Republic of Pakistan, and the alleged injurious subsidizing of PET resin originating in or exported from China.

The alleged dumped and subsidized goods are normally imported to Canada under the following tariff classification numbers:

The tariff classification numbers include non-subject goods. In addition, subject goods may fall under tariff classification numbers that are not listed.

The Canadian International Trade Tribunal (CITT) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The CITT will make a decision within 60 days of the date of initiation. If the CITT concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

The full product definition is found on the CBSA website. The Statement of Reasons regarding the decision will be issued within 15 days following the decision and will be available on the CBSA website.

Representations

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping and alleged subsidizing. Written submissions must be sent only electronically to simaregistry@cbsa-asfc.gc.ca. To be given consideration in these investigations, the CBSA must receive this information by July 25, 2025.

Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission must also be provided.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Polyethylene terephthalate

The Canadian International Trade Tribunal gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (PI-2024-005) to determine whether there is evidence that discloses a reasonable indication that the dumping and subsidizing of polyethylene terephthalate (“PET”) resin having an intrinsic viscosity of at least 0.70 deciliters per gram but not more than 0.88 deciliters per gram, including PET resin that contains various additives introduced in the manufacturing process, as well as blends of virgin PET resin and recycled PET, originating in or exported from the People’s Republic of China and the Islamic Republic of Pakistan, and excluding 100% recycled PET resin (the subject goods), have caused injury or retardation or are threatening to cause injury, as these words are defined in SIMA.

The Tribunal’s preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file Form I—Notice of participation with the Tribunal, on or before April 1, 2025. Each counsel who intends to represent a party in the preliminary injury inquiry must file Form II—Notice of representation and Form III—Declaration and undertaking with the Tribunal, on or before April 1, 2025.

On April 7, 2025, the Tribunal will issue a list of participants. Counsel and self-represented participants are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those participants who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed Form III—Declaration and Undertaking with the Tribunal. This information will be included in the list of participants. One complete electronic version of all submissions must be filed with the Tribunal.

Submissions by parties opposed to the complaint must be filed not later than noon (ET), on April 17, 2025. The complainant and supporting parties may make submissions in response to the submissions of parties opposed to the complaint not later than noon (ET), on April 25, 2025.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some of or all the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

INQUIRY

Laundering services

The Canadian International Trade Tribunal has received a complaint (file PR-2024-083) from Blessed Cleaners Inc. (Blessed Cleaners), of Winnipeg, Manitoba, concerning a procurement (solicitation WS4871309269A) made by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for dry cleaning and laundry services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on March 14, 2025, to conduct an inquiry into the complaint.

Blessed Cleaners alleges that, by not factoring environmental fees into the extended price when determining the pricing scores, PWGSC failed to follow due process, and the resulting award decision was capricious, arbitrary and unfair to all bidders.

INQUIRY

Repairs to address fire damper deficiencies

The Canadian International Trade Tribunal has received a complaint (file PR-2024-079) from McKay Mechanical Inc. (McKay), of Cornwall, Ontario, concerning a procurement (solicitation GOC3526903-CT/GOC3526903-CT1) made by Brookfield Global Integrated Solutions (BGIS) for repair work to address fire damper deficiencies. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal decided on March 12, 2025, to conduct an inquiry into the complaint.

McKay claims that BGIS, which allegedly conducted this procurement on behalf of the Department of Public Works and Government Services, improperly awarded the contract to another bidder after it privately sole sourced or invited only certain suppliers to bid on the solicitation. McKay, which has participated in open competitive processes for similar solicitations in the past, also submits that it was not invited to participate in this solicitation.

Wildlife control services

The Canadian International Trade Tribunal has received a complaint (file PR-2024-082) from West Coast Wildlife Control Services Ltd. (West Coast), of Comox, British Columbia, concerning a procurement (solicitation WS4046247012) made by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for wildlife control services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on March 12, 2025, to conduct an inquiry into the complaint.

West Coast alleges that the successful bidder did not meet the mandatory requirements of the solicitation, and that PWGSC improperly conducted the technical evaluation resulting in an unfair advantage to the successful bidder.

Notice is given that on March 19, 2025, pursuant to paragraph 76.03(12)(b) of the Special Import Measures Act, the Canadian International Trade Tribunal continued, without amendment, its order (expiry review RR-2024-001) made on July 3, 2019, in expiry review RR-2018-002, continuing, without amendment, its finding made on November 12, 2013, in inquiry NQ-2013-002, concerning the dumping and subsidizing of unitized wall modules, with or without infill, including fully assembled frames, with or without fasteners, trims, cover caps, window operators, gaskets, load transfer bars, sunshades and anchor assemblies, excluding non-unitized building envelope systems, such as stick systems and point-fixing systems originating in or exported from the People’s Republic of China.

Description of critical habitat of Broad-banded Forestsnail in Point Pelee National Park of Canada

The Broad-banded Forestsnail (Allogona profunda) is a large terrestrial hermaphroditic snail listed on Schedule 1 of the Species at Risk Act. The Broad-banded Forestsnail shells are round and slightly flat in shape and are yellow with brown bands. In Canada, the species occurs only in Point Pelee National Park of Canada and on Pelee Island in southern Ontario. It is found in wooded alvars and Hackberry dominated woodlands and forests with naturally occurring gaps in canopy cover.

The Recovery Strategy for the Broad-banded Forestsnail (Allogona profunda) in Canada identifies critical habitat for the species in a number of areas, including within Point Pelee National Park of Canada.

Notice is hereby given, pursuant to subsection 58(3) of the Species at Risk Act, that 90 days after the date of publication of this notice, subsection 58(1) of the Act will apply to the critical habitat of the Broad-banded Forestsnail, identified in the recovery strategy for the species that is included in the Species at Risk Public Registry, and that is located within Point Pelee National Park of Canada, the boundaries of which are described in Schedule 1 to the Canada National Parks Act.
