SPECIAL IMPORT MEASURES ACT
Undertaking review on certain sucker rods — Decision
On January 27, 2025, pursuant to subsection 53(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) renewed the price undertakings on certain sucker rods from Argentina, Brazil and Mexico.
SIMA requires undertakings to be reviewed by the CBSA at least every five years to determine if they still serve the purpose for which they were intended.
The subject goods are usually classified under the following tariff classification number:
- 8413.91.00.10
The above-listed tariff classification covers both subject and non-subject goods.
Information
The Statement of Reasons regarding this decision will be issued within 15 days following the decision and will be available on the CBSA website.

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES
Blackout Power Trading Inc.
By an application dated 20 January 2025, Blackout Power Trading Inc. (the Applicant) has applied to the Canada Energy Regulator (the CER), under Division 2 of Part 7 of the Canadian Energy Regulator Act (the Act), for authorization to export up to 2 628 000 MWh of combined firm and interruptible energy annually, for a period of 10 years.
The Commission of the Canada Energy Regulator (the Commission) wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The Directions on Procedure that follow explain in detail the procedure that will be used.
- The Applicant shall provide a copy of the application by email to any person who requests one by emailing brian@blackoutpower.ca. The application is also publicly available on the CER website.
- Written submissions that any interested party wishes to present shall be filed online with the CER in care of the Secretary of the Commission, and emailed to the Applicant, by 10 March 2025.
- Pursuant to subsection 359(2) of the Act, the Commission is interested in the views of submitters with respect to
- (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported; and
- (b) whether the Applicant has
- (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
- (ii) given an opportunity to buy electricity on conditions as favourable as the conditions specified in the application to those who, within a reasonable time after being so informed, demonstrate an intention to buy electricity for consumption in Canada.
- Any answer to submissions that the Applicant wishes to present, in response to items 2 and 3 of this Notice of Application and Directions on Procedure, shall be filed with the CER in care of the Secretary of the Commission and emailed to the party that filed the submission by 25 March 2025.

Notice is given that, after completing its inquiry (File PR-2024-043), the Canadian International Trade Tribunal made a determination on January 29, 2025, with respect to a complaint filed by Keverest Technologies Inc. (Keverest), of Kitchener, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (solicitation WS4279111193) by the Department of Public Works and Government Services on behalf of the Department of Transport. The solicitation was for the supply and delivery of an automotive grade high resolution 128-channel LIDAR sensor.
Keverest alleged that the procuring entity did not follow the appropriate procedures during the procurement process.
Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was valid.

DETERMINATION

Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (file PR-2024-058) on January 28, 2025, with respect to a complaint filed by Busch Vacuum Technics Inc., of Boisbriand, Quebec, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (solicitation 24-58216) by the National Research Council of Canada. The solicitation was for the supply of laboratory and scientific equipment.
Busch Vacuum Technics Inc. alleged that the solicitation included technical requirements based on arbitrary or irrelevant technical specifications.

Uniforms and related program management services
The Canadian International Trade Tribunal has received a complaint (file PR-2024-067) from Unisync Group Limited (Unisync), of Mississauga, Ontario, concerning a procurement (solicitation 1122971211) by the Canada Post Corporation (CPC). The solicitation is for the provision of CPC’s national Corporate Uniform Program, which includes uniform design, manufacturing, warehousing, distribution, and program management services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on January 16, 2025, to conduct an inquiry into the complaint.
Unisync alleges that CPC breached requirements of the trade agreements in eliminating Unisync from the ongoing procurement process.
