Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (file PR-2024-025) on October 1, 2024, with respect to a complaint filed by TYR Tactical Canada ULC (TYR) of Kanata, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (solicitation WS3836953161) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the supply of commercial, off-the-shelf dismounted infantry capability enhancement systems and related services.

TYR alleged that PWGSC did not grant TYR’s request for a debrief meeting and did not otherwise properly explain to TYR why it was not selected for an initial contract.

Having examined the evidence presented by the parties and considered the provisions of the applicable trade agreement, the Tribunal determined that the complaint was not valid.

INQUIRY

Highway maintenance and repair

The Canadian International Trade Tribunal has received a complaint (file PR-2024-044) from White Bear Industries Ltd., of Terrace, British Columbia, concerning a procurement (solicitation WS4269687423) by the Department of Public Works and Government Services (PWGSC). The solicitation was for the highway maintenance and repair of a portion of the Alaska Highway in British Columbia. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on September 26, 2024, to conduct an inquiry into the complaint.

White Bear Industries Ltd. alleges that the rejection of its bid by PWGSC on the basis of alleged misconduct that occurred during the execution of previous contracts with PWGSC was arbitrary, unfair, unjustified, did not satisfy the conditions for the rejection of bids under the solicitation, and constituted a breach of the applicable trade agreements.
