RETAIL PAYMENT ACTIVITIES ACT

Delegation of authorities by the Governor of the Bank of Canada

The Bank of Canada gives notice, pursuant to subsection 15(2) of the Retail Payment Activities Act (RPAA), that the Governor of the Bank of Canada (the Governor) proposes, pursuant to subsection 15(1) of the RPAA, to delegate to the persons holding the positions set out in column I of the schedule below the Governor’s powers, duties and functions under the RPAA as set out in column II of the schedule. The delegations take effect on the day on which section 29 of the RPAA comes into force.

The Bank of Canada Executive Director responsible for retail payments supervision (Executive Director). If the Executive Director is absent or the position is vacant, the acting Executive Director. If the Executive Director is otherwise unable to act, or if there is no acting Executive Director, the Deputy Governor appointed under subsection 6(1) of the Bank of Canada Act.

Non-application of the RPAA – Governor’s orders

May specify the provision of the RPAA or its regulations that does not apply to a payment service provider or class of payment service providers (section 11).

Refusal to Register – Review by Governor

Review the refusal to register, make a decision confirming the refusal or directing the Bank to complete the registration, and notify the applicant of the decision (section 50).

Revocation of Registration – Review of notice of intent and Decision

Review the notice of intent to revoke the registration, direct the Bank to either withdraw the notice of intent or revoke the registration, and notify the payment service provider of the decision (section 53).

Revocation of Registration – Review not requested

May direct the Bank to revoke the payment service provider’s registration (section 54).

Administrative Monetary Penalties - Notices of Violation – Representations to Governor

Following representations made in accordance with the notice of violation, decide on a balance of probabilities whether the violation was committed and, if so, impose the penalty set out in the notice, a lesser penalty, or no penalty (subsection 78(2)).

Compliance Agreements – Notices of Default – Applications for review

Review the Bank’s decision and confirm it or decide that the payment service provider has complied with the compliance agreement (section 83).

The Bank of Canada Managing Director responsible for retail payments supervision (Managing Director). If the Managing Director is absent or the position is vacant, the acting Managing Director.

Bank’s Powers – Designation

Designate persons or classes of persons as authorized persons in respect of certain supervisory powers (section 68).

Administrative Monetary Penalties – Recovery of Debts – Certificate

Certify the unpaid amount of any debt referred to in subsection 88(1) (subsection 89(1)).

Compliance Orders – Governor’s orders

May by order or temporary order, direct the payment service provider to cease, refrain, or perform any acts, in the prescribed form and manner (section 94).

Compliance Orders – Court enforcement

May apply to a superior court for an order requiring the individual or entity to cease the contravention or to comply with the relevant provision of the RPAA, its regulations, or relevant order (section 95).

CRIMINAL CODE

Review of listed entities pursuant to section 83.05 of the Criminal Code

Whereas subsection 83.05(8.1)footnote a of the Criminal Code footnote b requires the Minister of Public Safety and Emergency Preparedness to review the list established by the Regulations Establishing a List of Entities footnote c, made under subsection 83.05(1)footnote d of that Act, within five years after the day on which subsection 83.05(8.1)footnote a came into force or within five years after the day on which the entity is added to the list, in order to determine whether there are still reasonable grounds, as set out in subsection 83.05(1)footnote d, for an entity to remain a listed entity;

And whereas, under subsection 83.05(8.1)footnote a of that Act, the Minister has reviewed each of the listed entities set out in the annexed schedules;

Therefore, notice is given, under subsection 83.05(10)footnote a of the Criminal Code footnote b, that the Minister of Public Safety and Emergency Preparedness reviewed each of the listed entities set out in the annexed Schedules 1 and 2 on May 21, 2024 and that, as a result of that review, the Minister has determined that there are still reasonable grounds, as set out in subsection 83.05(1)footnote d of that Act, for each entity set out in the annexed Schedule 1 to remain listed entities and that there are no longer reasonable grounds for the entity in the annexed Schedule 2 to remain as a listed entity.
