Ministerial Instructions for the Student Direct Stream Program
These Instructions are published in the Canada Gazette in accordance with subsection 87.3(6) of the Immigration and Refugee Protection Act (the Act).
These Instructions are given pursuant to section 87.3 of the Act by the Minister of Citizenship and Immigration (the Minister) as, in the opinion of the Minister, these Instructions will best support the attainment of the immigration goals established by the Government of Canada.
These Instructions are consistent with the objectives of the Act, as set out in section 3.
These Instructions are directed to officers who are charged with handling and/or reviewing certain applications for study permits, and establish conditions that must be met for these study permits to receive priority processing. For the purposes of these Instructions, “priority processing” refers to an intended shortened processing time as compared to the regular study permit application process.
CONSIDERATIONS
Canada’s immigration objectives, as set out in section 3 of the Act, include the establishment of fair and efficient procedures to maintain the integrity of the Canadian immigration system.
The aim is to provide priority processing for study permits through the Student Direct Stream (SDS).
Upfront language test results for the SDS maintain program integrity while allowing the Department of Citizenship and Immigration to issue study permits that meet the requirements of section 216 of the Immigration and Refugee Protection Regulations (IRPR) within an expedited time frame.
The SDS is an optional program to which applicants can apply in order to have their study permit application processed on a priority basis.
SCOPE
These Instructions set out the conditions that study permit applications need to meet in order to be considered part of the SDS and receive priority processing.
These Instructions apply to applications for the SDS submitted on or after the date on which the Instructions take effect.
INSTRUCTIONS TO PROCESS ON A PRIORITY BASIS CERTAIN STUDY PERMIT APPLICATIONS
Officers are instructed to give priority processing to study permit applications that meet the following conditions.
Student Direct Stream
To be eligible for priority processing under the SDS, the study permit application must have been made by an applicant who is a legal resident of Antigua and Barbuda, Brazil, China, Colombia, Costa Rica, India, Morocco, Pakistan, Peru, Philippines, Senegal, Saint Vincent and the Grenadines, Trinidad and Tobago, or Vietnam.
In addition, applicants must provide the following documentation at the time they present their study permit application:
- (1) an acceptance letter from a postsecondary designated learning institution, as per section 211.1 of IRPR;
- (2) evidence that the tuition has been paid to the postsecondary designated learning institution referred to in (1) for the first year of study;
- (3) For applicants intending to study at a postsecondary designated learning institution outside Quebec, a Guaranteed Investment Certificate (GIC) that is equal to 75% of the low income cut-off (LICO)
- a. For applicants intending to study at a postsecondary designated learning institution in Quebec, a Guaranteed Investment Certificate (GIC) equal to the amount set by Schedule C of the Québec Immigration Regulation;
- (4) a medical examination, as per section 29 of IRPR;
- (5) a police certificate;
- (6) recent secondary or postsecondary school transcript(s);
- (7) a language test result, as described in these Instructions; and
- (8) Applicants intending to study in Quebec must only meet the financial requirements set out by the Ministère de l’Immigration, de la Francisation et de l’Intégration and must also have a Québec Acceptance Certificate (CAQ) from the Ministère de l’Immigration, de la Francisation et de l’Intégration.
For the purposes of these Instructions, language test results accepted are
- Results of an evaluation from a designated language-testing organization using a general language test approved pursuant to subsection 74(3) of the IRPR: IELTS General, CELPIP General, TEF Canada and TCF Canada; with a score that is equivalent to a Canadian Language Benchmarks score of at least 7 for each of the four language abilities (speaking, listening, reading, and writing); or
- Results of an academic language test from a language-testing organization designated pursuant to subsection 74(3) of the IRPR: IELTS Academic (minimum overall score of 6), CAEL (minimum overall score of 60), Pearson PTE Academic (minimum overall score of 60), TEF 5 épreuves (minimum overall score of 400) and TCF - tout public (minimum overall score of 400), with results from each of the four language abilities (speaking, listening, reading, and writing); or
- Results from the academic language test from Educational Testing Service (ETS) TOEFL iBT Test (minimum overall score of 83), with results from each of the four language abilities (speaking, listening, reading, and writing).
Additionally, all above noted tests must be taken in their in-person format to be accepted for the SDS. Online remotely proctored tests will not be accepted for the purposes of the SDS.
EFFECTIVE DATES
Applications to be submitted with language test results
These Instructions take effect January 1, 2024.
Repeal
The following Instructions are repealed, effective January 1, 2024: Ministerial Instructions for the Student Direct Stream Program, signed May 12, 2023.
Retention and dispositions
Applications received by the Department of Citizenship and Immigration on or after the Instructions take effect that do not meet the conditions set out in these Instructions will not receive priority processing.

Rescinding Ministerial Condition
(Section 84 of the Canadian Environmental Protection Act, 1999)
Whereas the Minister of the Environment published in Part I of the Canada Gazette (Vol. 131, No. 22) on May 31, 1997, conditions imposed pursuant to subsection 29(1) of the Canadian Environmental Protection Act, R.S.C. 1985, c. 16 (4th Supp.) on the manufacture or import of the substance ethane, 1,2-dichloro-, polymer with ammonia, N-substituted reaction products sodium hydroxide, Confidential Substance Identity Number 13774-4;
Whereas the Minister of the Environment varied those conditions (Canada Gazette, Part I, Vol. 135, No. 41, October 13, 2001) pursuant to subsection 84(3) of the Canadian Environmental Protection Act, 1999 (the Act);
Whereas the Minister of the Environment and the Minister of Health have assessed additional information in respect of the substance;
And whereas the ministers no longer suspect that the substance is toxic or capable of becoming toxic within the meaning of section 64 of the Act,
The Minister of the Environment hereby rescinds the conditions on the manufacture or import of the substance ethane, 1,2-dichloro-, polymer with ammonia, N-substituted reaction products sodium hydroxide, Confidential Substance Identity Number 13774-4, pursuant to subsection 84(3) of the Act.

Notice of intent to issue a notice under section 46 of the Act with respect to reporting of certain plastic products for 2024, 2025 and 2026
The Minister of the Environment is seeking feedback from interested parties on this notice of intent to issue a section 46 notice for the Federal Plastics Registry to create an inventory of data.
The notice would be issued under subsection 46(1) of the Canadian Environmental Protection Act, 1999 (the Act). The notice would require that any person described in Schedule 3 of the notice and who possesses or who may reasonably be expected to have access to information described in Schedules 4 through 5 of the notice provide the Minister with this information.
The notice would apply to the calendar years 2024, 2025, and 2026. Information pertaining to the 2024 calendar year would be required to be provided no later than September 29, 2025. Information pertaining to the 2025 calendar year would be required to be provided no later than September 29, 2026. Information pertaining to the 2026 calendar year would be required to be provided no later than September 29, 2027.

Pursuant to subsection 46(8) of the Act, any person subject to the notice would be required to keep copies of the information required by the notice, together with any calculations, measurements, and other data on which the information is based, for a period of three years from the date the information is required to be submitted. Where the person chooses to keep the information required by the notice, together with any calculations, measurements, and other data, at the parent company in Canada, that person would inform the Minister of the civic address of that parent company.
The Minister intends to publish, in part, information on resins and plastic products in response to the notice. Pursuant to section 51 of the Act, any person who provides information in response to the notice may submit, with their information and no later than the deadline for submission, a written request that the information be treated as confidential based on the reasons set out in section 52 of the Act. The person requesting confidential treatment of the information would indicate which of the reasons stipulated in section 52 of the Act applies to their request. Nevertheless, the Minister may decide to disclose the information submitted in response to the notice, in accordance with subsection 53(3) of the Act.
Every person to whom the notice is directed to would be required to comply with the notice. A person who fails to comply with the requirements of the notice would be liable under the applicable offence provisions of the Act.

- “accessories”
- in respect of Electric and Electronic Equipment, includes, but not limited to, cables, adaptors, cords, and chargers.
- “agricultural bags”
- means plastic bags of less than 30 kg capacity used for seed, feed or fertilizer.
- “agricultural container”
- means a jug or pail of less than 23 L capacity, excluding those used to contain animal health products.
- “agricultural drums”
- means jugs or pails of more than 23 L capacity, excluding those used to contain animal health products, but does not include equipment designed to transport a person.
- “agricultural net wrap”
- means knitted netting used to make round hay or straw bales.
- “agricultural tote bags”
- means large bags or mini-bulk bags, usually in 500 kg or 1 tonne sizes, used primarily to package seeds, pesticides and animal feed.
- “agriculture and horticulture”
- includes products made wholly or in part from plastics used in relation to agriculture and horticulture.
- “anchor”
- means a device attaching fishing gear to the bottom of the water.
- “animal health product containers”
- means any vessel containing chemicals or detergents for use in animal husbandry.
- “apparel”
- means

- “arranging direct reuse”
- as per the International Resource Panel of the United Nations, means the collection, inspection and testing, cleaning and redistribution of a product back into the market under controlled conditions (e.g. a formal business undertaking or charitable endeavour).
- “audio-visual equipment”
- means electric and electronic equipment (EEE) of which the primary purpose is collecting, storing, processing, presenting or communicating information, including sounds and images, recording or reproducing sounds and images, but does not include equipment or products that fall into the category of lighting equipment, parts, bulbs, and signs.
- “bale bags or tubes”
- means bags or tubes loaded with individual round or square bags using a bale loading machine for storage.
- “bale wrap”
- means thin stretch film which is used to wrap round or large square bales of hay (and some cereal crops) after the bales have first been wrapped by twine or net wrap to create baleage, a form of silage (fermented feed) fed to livestock.
- “beverage container”
- means plastic packaging that is hermetically sealed and that contains a ready-to-drink beverage for human consumption.
- “bicycle”
- includes a tricycle, a unicycle and a power-assisted bicycle but does not include a motor assisted bicycle.
- “bio-based resin”
- means a solid or viscous organic plastic resin used as the basis of plastics, adhesives, varnishes, or other products, produced from renewable biomass sources.
- “buoy/float”
- means a floating device attached to fishing gear.
- “bus”
- means a motor vehicle designed for carrying 10 or more passengers and used for the transportation of persons.
- “carpets and other floor coverings”
- means floor coverings in which textile materials serve as the exposed surface of the article when in use and includes articles having the characteristics of textile floor coverings but intended for use for other purposes.
- “cladding”
- means the material or component of the wall assembly that forms the outer surface of the wall and is the first line of protection from the exterior environment (sun, wind, rain and temperature).
- “clips, supports, hooks”
- means any item used to support, train, or guide growing plants, excluding twine.
- “CO2 tubing for greenhouses”
- means tubing to deliver residual carbon dioxide gas to greenhouse growing areas.
- “composting”
- means plastic waste that undergoes degradation by biological processes at industrial composting facilities to yield carbon dioxide, water, inorganic compounds and biomass at a rate consistent with other known compostable materials and leave no visible, distinguishable or toxic residue and the packaging or item is associated with food or organic waste.
- “construction”
- includes products made wholly or in part from plastics typically used in the construction of buildings, structures, and public works.
- “device for refrigeration or freezing”
- means a device containing a refrigeration system that has a compressor, condenser, evaporator and expansion valve, and that contains or is designed to contain a halocarbon refrigerant.
- “device for use of suction, pressure or water to clean surfaces or materials”
- includes
- (a) electric vacuum cleaners and water-suction cleaning appliances for household and similar purposes, including vacuum cleaners for animal grooming, their rated voltage being not more than 250 V;
- (b) central-vacuum cleaners;
- (c) motorized cleaning heads and current-carrying hoses associated with a particular vacuum cleaner.
- “device for washing or drying dishes or textiles”
- includes
- (a) clothes washer;
- (b) clothes dryer;
- (c) integrated clothes washer-dryer, a household appliance that consists of a clothes washer component and a clothes dryer component located above, below or beside it, that is powered by one power source and that has its control panel located on one of the components;
- (d) combination clothes washer-dryer, a household appliance that has: a clothes washer function and clothes dryer function that utilize the same drum, a common control panel for both functions, and one power source;
- (e) electrically operated automatic dishwasher, whether built in or portable.
- “diversion”
- means all activities that collect plastics at end-of-life and send them for diversion (PDF).
- “door”
- means an assembled unit consisting of a frame and one or more moving leaves or panels whose primary purpose is to allow ingress/egress and designed for and installed in a vertical wall separating conditioned and unconditioned spaces in a residential building.
- “electric and electronic equipment (EEE)”
- means products made wholly or in part from plastics that operate with a battery or include a cord to connect to an electrical outlet, or that otherwise requires an electric current to operate, and/or that contains any electronic component.
- “energy recovery”
- means converting diverted plastics directly into energy (e.g. mass-burn incinerators) or into fluid or solid fuels that are then used to generate heat or electricity. The energy recovery system must have a net heating value of at least 12 780 kJ/kg.
- “Extended Producer Responsibility (EPR)”
- means a program established under a provincial law that makes producers financially and operationally responsible for the collection and value recovery of goods or packaging they produce at the postconsumer stage of the lifecycle of the goods or packaging.
- “farm vehicle”
- means a self-propelled vehicle designed and used primarily as a farm implement for drawing plows, mowing machines and other implements of husbandry and not designed or used for carrying a load.
- “final disposal”
- means deposition in a landfill or dump, or incineration without energy recovery.
- “fishing and aquaculture”
- means products made wholly or in part from plastics used in relation to fishing and aquaculture.
- “fishing gear marker”
- means a tag, float or buoy marked with
- (a) where a vessel registration number is set out in the licence authorizing the use of that gear, the vessel registration number; or
- (b) in any other case, the name of the person who owns the gear.
- “flexible”
- means, in respect of plastic packaging, designed to change shape under tension or heat, and includes
- (a) a film that is applied to goods or packaging;
- (b) a container — such as a bag, pouch, tube, or sachet — that is likely to change shape when contents are added or removed; and
- (c) a flexible layer integrated into rigid packaging.
- “food contact”
- means, in respect of plastic packaging,
- (a) primary packaging for a food, as defined in section 2 of the Food and Drugs Act;
- (b) primary packaging for a dairy product, as defined in section B.08.001 of the Food and Drug Regulations;
- (c) packaging for a food for special dietary use, as defined in section B.24.001 of the Food and Drug Regulations;
- (d) packaging for an infant food, human milk fortifier or human milk substitute, as those terms are defined in section B.25.001 of the Food and Drug Regulations;
- (e) packaging for a novel food, as defined in section B.28.001 of the Food and Drug Regulations; or
- (f) primary packaging for food manufactured, sold or represented for use as food for animals.
- “footwear”
- means any article under Chapter 64 in the List of Tariff Provisions set out in the schedule to the Customs Tariff.
- “fossil-based resin”
- means a solid or viscous organic polymer used as the basis of plastics, adhesives, varnishes, or other products, derived from non-renewable fossil fuels.
- “grain bags”
- means bags used to store harvested field crops in farm fields as an alternative to on-farm steel silage bins or off-farm grain elevators.
- “industrial textiles”
- means any article under Chapter 59 in the List of Tariff Provisions set out in the schedule to the Customs Tariff.
- “information technology equipment”
- means devices or systems that generate and/or use timing signals or pulses having a rate of at least 9 kHz and employ digital techniques for purposes such as computation, display, control, data processing and storage.
- “institutional, commercial and industrial (ICI) waste stream”
- means the waste generated by all non-residential sources, and that is excluded from the residential waste stream, namely institutional waste, which is generated by institutional facilities such as schools, hospitals, government facilities, senior homes, or universities; commercial waste, which is generated by commercial operations such as shopping centres or offices; industrial waste, which is generated by manufacturing and primary and secondary industries, and is managed off-site from the manufacturing operation.
- “insulation material”
- includes
- (a) batt or blanket;
- (b) loose fill;
- (c) expanded polystyrene;
- (d) extruded polystyrene;
- (e) polyurethane and polyisocyanurate boards;
- (f) spray foam;
- (g) closed-cell polyurethane foam;
- (h) open-cell polyurethane foam; and
- (i) reflective bubble foil insulations and radiant barriers.
- “interior finishes (including flooring)”
- means any material that forms part of the building interior and is directly exposed. This includes but is not limited to interior claddings, flooring, and trim.
- “interior textiles”
- means any article under Chapter 63.I in the List of Tariff Provisions set out in the schedule to the Customs Tariff.
- “irrigation equipment”
- means hoses, tubes, watering cans, rain barrels, sprinkler heads or sprinklers that carry, store, or release water for irrigation.
- “landfill”
- means a facility for the disposal of municipal solid waste by placing it in or on land.
- “lighting equipment, parts, bulbs, and signs”
- means equipment that has the primary purpose of producing light, such as a bulb, lamp, light-emitting diode or tube.
- “longline”
- means a line that has a hook or hooks attached to it and that is anchored to the bed of the water.
- “luggage”
- means trunks, suitcases, vanity cases, executive cases, briefcases, school satchels, spectacle cases, binocular cases, camera cases, musical instrument cases, gun cases, holsters and similar containers; travelling bags, insulated food or beverage bags, toilet bags, rucksacks, handbags, shopping bags, wallets, purses, map cases, cigarette cases, tobacco pouches, tool bags, sports bags, bottle cases, jewelry boxes, powder boxes, cutlery cases, and similar containers, of composition leather, of sheeting of plastics, of textile materials, of vulcanized fibre, or wholly or mainly covered with such materials under Chapter 42 in the List of Tariff Provisions set out in the schedule to the Customs Tariff.
- “maple syrup tubing and taps”
- means the tubing used for carrying sap from maple trees to holding tanks, and the taps or spiles inserted in the tree to collect the sap.
- “medical devices”
- means a medical device as defined in the Medical Devices Regulations, but excluding any medical device considered biological waste such as implants and infected devices.
- “mobility aid”
- means devices, including manual wheelchair, electric wheelchair and scooter, that are used to facilitate the transport, in a normally seated orientation, of a person with a physical disability.
- “motor-assisted bicycle”
- means a bicycle,
- (a) that is fitted with pedals that are operable at all times to propel the bicycle;
- (b) that does not weigh more than 55 kg;
- (c) that has no hand- or foot-operated clutch or gearbox driven by the motor and transferring power to the driven wheel;
- (d) that has an attached motor driven by electricity or having a piston displacement of not more than 50 cm3; and
- (e) that does not have sufficient power to enable the bicycle to attain a speed greater than 50 km/h on level ground within a distance of 2 km from a standing start.
- “motor vehicle”
- includes an automobile, a motorcycle, a motor-assisted bicycle, and any other vehicle propelled or driven otherwise than by muscular power, but does not include a street car or other motor vehicle running only upon rails, a power-assisted bicycle, a motorized snow vehicle, a traction engine, a farm tractor, a self-propelled implement of husbandry or a road-building machine.
- “motorcycle”
- means a self-propelled vehicle having a seat or saddle for the use of the driver and designed to travel on not more than three wheels in contact with the ground, and includes a motor scooter, but does not include a motor-assisted bicycle.
- “muscular-powered equipment”
- means equipment, with tires, that is propelled or drawn by muscular power.
- “nets and seines”
- includes drift nets, dip nets, trap nets, gill nets, bag nets, ring nets, square nets, drag seines, purse seines, beach seines, and bar seines.
- “packaging”
- means anything that is designed to be used for the containment, conservation, protection, handling, delivery, storage, transport or presentation of goods, and includes any label on the packaging.
- “paints and coatings”
- means paints, varnishes, lacquers, shellacs and stains.
- “piping, including pipe fittings”
- includes pipe, plumbing fixtures, fittings, unions and trims.
- “post-consumer recycled resin”
- means plastic resins that are recycled from end-of-life products, whether these are from residential, industrial, commercial, or institutional sources.
- “pot”
- means a type of fishing gear used for catching without enmeshing that contains bait which attracts the catch into it through one or more openings.
- “power tools”
- means
- (a) Portable electronic or electrical tools used for monitoring, measuring, weighing and adjusting; or
- (b) Portable/mobile electronic or electrical tools with a power cord, plug and/or batteries. Includes, but is not limited to, those used for bending, cutting, drilling, folding, grinding, milling, polishing, punching, sanding, sawing, shearing, soldering, turning, welding, or otherwise processing wood, metal or other materials, including battery-powered hand tools. Also includes tools used for nailing, riveting, screwing or removing nails, rivets or screws, regardless of whether they are marketed for household, industrial or commercial purposes.
- “pre-consumer (post-industrial) recycled resin”
- means plastic resins diverted from manufacturing processes prior to its use in a product.
- “primary packaging”
- means plastic packaging designed to come into direct contact with the goods it contains.
- “processed into chemicals, including fuels”
- means plastic waste that is turned into fuel or other chemicals for other products.
- “producer”
- means a brand owner or intellectual property holder who resides in Canada. If the brand owner is not a resident of Canada, then the first resident person to manufacture or import a plastic product in Canada is defined as the producer. If there is no resident manufacturer or importer, then the first resident person to distribute a plastic product in Canada is defined as the producer. If there is no resident importer or distributor, then the first resident person who supplied the plastic product to the consumer in Canada is defined as the producer.
- “producer responsibility organization (PRO)”
- means an organization that producers can retain or join to fulfil their extended producer responsibility or stewardship obligations.
- “propagation trays and growing pots”
- means trays used to propagate seedlings and pots for growing plants.
- “recycling”
- means processing into feedstocks or resins to produce new plastic products or packaging, displacing the primary or raw material from which they were produced, by some or any of the following processes:
- (a) conventional mechanical activities that separate, grind and heat products to produce plastic feedstocks or resins;
- (b) chemical or thermal processes such as depolymerization, pyrolysis or gasification that convert plastics into monomers or monomer feedstocks.
- “refurbishment”
- as per the International Resource Panel of the United Nations, means the modification of an object that is a waste or a product that takes place within maintenance or intermediate maintenance operations to increase or restore performance and/or functionality or to meet applicable technical standards or regulatory requirements, with the result of making a fully functional product to be used for a purpose that is at least the one that was originally intended.
- “remanufacturing”
- as per the International Resource Panel of the United Nations, means a standardized industrial process that takes place within industrial or factory settings, in line with specific technical specifications, including engineering, quality, and testing standards, and typically yields fully warranted products.
- “repair”
- as per the International Resource Panel of the United Nations, means the fixing of a specified fault in an object that is a waste or a product and/or replacing defective components to make the waste or product a fully functional product to be used for its originally intended purpose.
- “restricted-use vehicle”
- means a vehicle — excluding a competition vehicle but including an all-terrain vehicle designed primarily for recreational use — that
- (a) is designed to travel on not more than four wheels in contact with the ground; and
- (b) is not designed for use on public roads.
- “reusable packaging”
- packaging is reusable if
- (a) it is a plastic product, contains a plastic product that is integrated into the packaging or has at least one component;
- (b) it is designed to function properly in its original condition and for its original purpose for as many uses as possible without compromising its performance or structural integrity or causing risks to health or safety;
- (c) its reuse does not require the use of any single-use plastic items; and
- (d) a system of reuse is in place that allows for the reusable packaging to be refilled or exchanged
- (i) wherever it is sold, or
- (ii) at the user’s residence or place of business.
- “rigid”
- means, in respect of plastic packaging, a plastic product that is designed to maintain a structure that remains essentially unchanged when contents are added or removed and includes rigid foam packaging such as expanded polystyrene foam.
- “roofing materials”
- means deck, shingles, barriers, and attachment systems.
- “secondary packaging”
- means plastic packaging, including any protective materials, designed to contain primary packaging.
- “siding”
- includes vinyl siding, insulated vinyl siding and propylene siding, used as cladding.
- “silage bags and tarps”
- means bags used to store loose silage crops (grains and hay) on farm fields or covers for silage pits.
- “single-use and disposable item”
- means a product that is designed to be used only once or for a short period of time for its original purpose before it is discarded and that
- (a) is a plastic product;
- (b) contains a plastic product that is integrated into it; or
- (c) has at least one component.
- “snowmobile”
- means a self-propelled vehicle designed to be driven primarily on snow.
- “sports equipment”
- means
- (a) Portable/mobile electronic or electrical equipment or devices used primarily for sport and/or leisure with a power cord, plug or batteries and a primary purpose that requires electricity and/or battery power; or
- (b) Exercise machines that use any kind of power mechanism (plug, cord or battery) to power the product and/or to assist in adjusting the resistance mechanism in the product, i.e. exercise machines with a primary purpose that requires electricity and/or battery power.
- “stewardship”
- is a term that is often used interchangeably with Extended Producer Responsibility (EPR), but that can also include collection for diversion on a voluntary basis.
- “tertiary packaging”
- means packaging designed to contain one or more articles or packages, or bulk material, for the purpose of transport, handling and/or distribution.
- “tire”
- means a component that is designed to surround the rim of a vehicle’s wheel.
- “tires for bicycles”
- means tires for bicycles, which includes tricycles, unicycles and power-assisted bicycles but does not include motor-assisted bicycles.
- “tires for farm vehicles”
- means tires for a self-propelled vehicle designed and used primarily as a farm implement for drawing plows, mowing machines and other implements of husbandry and not designed or used for carrying a load.
- “tires for mobility aids”
- means tires for devices, including manual wheelchair, electric wheelchair and scooter, that are used to facilitate the transport, in a normally seated orientation, of a person with a physical disability.
- “tires for motor vehicles”
- means tires for a vehicle that is drawn, propelled or driven by any means other than muscular power, but does not include railway equipment.
- “tires for muscular-powered equipment”
- means tires for equipment, with tires, propelled or drawn by muscular power, but does not include equipment designed to transport a person.
- “tires for trucks and trailers”
- means tires for a vehicle designed to carry or accommodate persons or property and to be drawn behind another vehicle, and includes a bus trailer, pole trailer and cable reel trailer, but does not include earth-moving equipment or a mobile home, trailer converter dolly or implement of farm.
- “toys”
- includes any toy, game, or other article designed, labelled, advertised, or otherwise intended for use by children and that is intended to be powered by electrical current from nominal 120 volt (110–125 v.) branch circuits. If the package (including packing materials) of the toy or other article is intended to be used with the product, it is considered to be part of the toy or other article. This definition does not include components that are powered by circuits of 30 volts root mean square (42.4 volts peak) or less, articles designed primarily for use by adults that may be used incidentally by children, or video games.
- “trailers”
- means a vehicle that is at any time drawn upon a highway by a motor vehicle, except an implement of husbandry, a mobile home, another motor vehicle or any device or apparatus not designed to transport persons or property, temporarily drawn, propelled or moved upon such highway, and except a sidecar attached to a motorcycle, and shall be considered a separate vehicle and not part of the motor vehicle by which it is drawn.
- “trap”
- means an apparatus that is so set as to enclose an area of water into which fish are guided by a leader through an opening or openings; does not include a trawl net or a purse seine.
- “trawl net”
- means any bag-type net that is dragged in the water by a vessel for the purpose of catching fish.
- “troll”
- means a line with a hook or hooks attached to it that is towed through the water by or from a vessel.
- “virgin bio-based biodegradable resin”
- means newly manufactured resin produced from biomass feedstock used as the raw material for the manufacture of plastic products that will break down, fragment or biodegrade in the environment.
- “virgin bio-based conventional resin”
- means newly manufactured resin produced from biomass feedstock used as the raw material for the manufacture of plastic products and that has never been used or processed before.
- “virgin fossil-based biodegradable resin”
- means newly manufactured resin produced from petrochemical feedstock used as the raw material for the manufacture of plastic products that will break down, fragment or biodegrade in the environment.
- “virgin fossil-based conventional resin”
- means newly manufactured resin produced from petrochemical feedstock used as the raw material for the manufacture of plastic products and that has never been used or processed before.
- “white goods”
- includes products made wholly or in part from plastics in large and small household appliances that require an electric current, gas or propane to function.
- “window”
- means an assembled unit consisting of a frame/sash component holding one or more pieces of glazing functioning to admit light and/or air into an enclosure and designed for a vertical, sloped, or horizontal installation in an external wall or roof of a building.
- “yarn, thread, twine, cordage, ropes, cables, woven and knitted or crocheted fabric”
- means articles of this type under Chapters 54, 55, 56, 58 and 60 in the List of Tariff Provisions set out in the schedule to the Customs Tariff.
SCHEDULE 3
Criteria for reporting
GENERAL
This notice applies to
(1) A person who is a producer of a plastic product; and
(2) A person who is a provider of another service that manages plastics or plastic products after collection for diversion
- (a) for recycling;
- (b) for composting;
- (c) for processing into chemicals;
- (d) for using for energy recovery;
- (e) for processing for final disposal or incineration without energy recovery;
- (f) for arranging direct reuse;
- (g) for refurbishing;
- (h) for remanufacturing; or
- (i) for repair.
SCHEDULE 4
Information required by this notice and manner of reporting
GENERAL
(1) A person subject to this notice under Schedule 3 shall provide a Statement of Certification or electronic certification certifying that the information is true, accurate and complete or shall authorize another person to act on their behalf and so certify using the Statement of Certification or electronic certification.
(2) A person subject to this notice under Schedule 3 shall provide the information required in this schedule, for each calendar year, using the online reporting system.
(3) A person subject to this notice under Schedule 3 may designate by name, with proof of designation,
- (a) a producer responsibility organization (PRO), engaged to fulfil the person’s extended producer responsibility (EPR) or stewardship obligations, to make a report to the registry on the person’s behalf; or
- (b) another person, in cases where no EPR or stewardship obligations exist, to make a report to the registry on the person’s behalf.
ADMINISTRATIVE INFORMATION
(4) A person subject to this notice under Schedule 3 who is a producer of a plastic product shall report the following information:
- (a) the name, email address, phone number, street address and, if different, mailing address of the producer;
- (b) the federal business number assigned to the producer by the Canada Revenue Agency (CRA); when a GST number has been assigned by CRA, it should be provided;
- (c) the name, email address, and telephone number of a person who
- (i) is an authorized representative of the producer and will act as the main contact,
- (ii) is an authorized representative of the producer and will be responsible for reporting, or
- (iii) has the authority to bind the producer to their report and is legally responsible for the data submitted to the Minister;
- (d) the primary, secondary, and tertiary six-digit North American Industry Classification System (NAICS) Canada code, if applicable;
- (e) the provinces and territories in which the producer places plastic products on the market;
- (f) the provincial and territorial EPR programs to which the producer is subject;
- (g) the provincial and territorial stewardship programs in which the producer participates; and
- (h) the PROs that a producer engages and the provinces and territories in which those PROs operate on behalf of the producer.
(5) A person subject to this notice under Schedule 3 who is a PRO or other person delegated by a producer shall report the following information:
- (a) the name, email address, phone number, street address and, if different, mailing address of the PRO or other person delegated by a producer;
- (b) the federal business number assigned by the Canada Revenue Agency (CRA) to the PRO (or other person delegated by the producer) and, if applicable, the GST number assigned by the CRA;
- (c) the name, email address, and telephone number of a person who
- (i) is an authorized representative of the PRO/other person delegated and will act as the main contact, or
- (ii) is an authorized representative of the PRO/other person delegated and will be responsible for reporting;
- (d) the primary, secondary, and tertiary six-digit NAICS Canada code, if applicable;
- (e) the provinces and territories in which the PRO/other person delegated manages plastic products on behalf of a producer;
- (f) the provincial and territorial EPR programs that the PRO/other person delegated operates under;
- (g) the provincial and territorial stewardship programs that the PRO/other person delegated operates under; and
- (h) the producers that the PRO/other person delegated engages and the provinces and territories in which those PROs operate on behalf of the producer.
(6) A person subject to this notice under Schedule 3 who is a provider of another service shall report the following information:
- (a) the name, email address, phone number, street address and, if different, mailing address of the provider;
- (b) the federal business number assigned to the provider by the CRA and, if applicable, the GST number assigned by the CRA;
- (c) the name, email address, and telephone number of a person who
- (i) is an authorized representative of the provider and will act as the main contact,
- (ii) is an authorized representative of the provider and will be responsible for reporting, or
- (iii) has the authority to bind the provider to their report and is legally responsible for the data submitted to the Minister;
- (d) the primary, secondary, and tertiary six-digit NAICS Canada code, if applicable; and
- (e) the provinces and territories in which the provider operates.
PART 1
INFORMATION TO PROVIDE RESPECTING ITEMS LISTED IN SCHEDULE 1
(7) A person subject to this notice under Schedule 3 shall report the following information, with respect to a given calendar year, in respect of each plastic product listed in Schedule 1 destined for both the residential waste stream and the institutional, commercial, and industrial waste stream, and following the timeline given in Schedule 5:
- (a) the identity of all the resins used to make plastic products placed on the Canadian market;
- (b) the source of the resin used to make plastic products placed on the Canadian market;
- (c) the category and subcategory of plastic products placed on the Canadian market;
- (d) the total quantity in tonnes of plastic in products placed on the Canadian market;
- (e) the total quantity in tonnes of plastic collected at end of life and sent for diversion;
- (f) the total quantity in tonnes of diverted plastics that are recycled;
- (g) the total quantity in tonnes of diverted plastics that are processed into chemicals, including fuels;
- (h) the total quantity in tonnes of diverted plastics that are sent to final disposal at a landfill;
- (i) the total quantity in tonnes of diverted plastics that are sent to final disposal and incinerated without energy recovery;
- (j) the total quantity in tonnes of diverted plastics that are sent to final disposal and composted;
- (k) the total quantity in tonnes of diverted plastics that are recovered for energy recovery;
- (l) the total quantity in tonnes of diverted plastic in products that is collected with direct reuse arranged;
- (m) the total quantity in tonnes of diverted plastic in products that are refurbished;
- (n) the total quantity in tonnes of diverted plastic in products that is remanufactured;
- (o) the total quantity in tonnes of diverted plastic in products that are repaired; and
- (p) the method used to determine the quantities referred to in paragraphs (d) through (o).
SCHEDULE 5
For the calendar year 2024
(1) A person subject to this notice under Schedule 3 shall report the information specified in Schedule 4, Sections 1 through 6, and Section 7, subsections (a) through (d), and (p), for the following plastic product categories:
- (a) Packaging;
- (b) Single-use or disposable plastic products; and
- (c) Electronic and Electrical Equipment (EEE).
For the calendar year 2025
In addition to the reporting requirements for the previous year,
(2) A person subject to this notice under Schedule 3 shall report the information specified in Schedule 4, Sections 1 through 6, and subsections (7)(a) through (d), and (p), for all remaining categories listed in Schedule 1;
(3) and shall in addition report the information specified in Schedule 4, subsections (7)(e) through (p), for the following categories:
- (a) Packaging;
- (b) Single-use or disposable plastic products; and
- (c) Agriculture and horticulture.
(4) and shall in addition report the information specified in Schedule 4, subsections (7)(e) and (p), for the following categories:
- (a) Electronic and Electrical Equipment (EEE); and
- (b) White goods.
For the calendar year 2026
In addition to the reporting requirements for the previous year,
(5) A person subject to this notice under Schedule 3 shall report the information specified in Schedule 4, Sections 1 through 6, and subsections (7)(f) through (p), for the following categories:

Notice of veterinary drugs master file updates and fees implementation
The Health Products and Food Branch (HPFB) is updating master file (MF) registration as a part of the continuing effort to implement a common intake approach for all drug product lines, including veterinary drugs. MF holders and applicants using MFs to support veterinary drug submissions will need to submit MF transactions via the Common Electronic Submission Gateway (CESG) using an application form in XML (Extensible Markup Language) format. This update is consistent with the transition of human drug MF application form to a web-based form effective June 26, 2023.
Additionally, fees will now be charged for MFs for veterinary drugs, to align them with the existing MF fee structure for human drugs. A public stakeholder consultation was held from June 2 to August 12, 2023. Comments received may be viewed on the Proposed fees for veterinary drugs master files — Consultation comments web page.
Both changes for veterinary drugs go into effect on January 2, 2024.
Important information
Using a web-based form to encode the MF’s content
- allows a single process for submitting information;
- removes file size limitations imposed by other communication methods, such as email; and
- enhances accuracy, consistency and reliability of the information captured in Health Canada systems.
This form will have to be included with every Electronic Common Technical Document (eCTD) and non-eCTD transaction that is sent via the CESG.
A web-based template is now available. It will generate an XML file upon completion.

HPFB will continue to keep confidential business information confidential in accordance with applicable law, including the Access to Information Act and the Food and Drugs Act.
Updates to process
This transition will harmonize the MF processes for human and veterinary drugs. Therefore, HPFB will update the existing master file guidance for human drugs to expand the scope to include veterinary drugs. HPFB will publish the updated guidance in advance of any change.
Fees consultation
MF registration is a non-regulatory activity service provided by HPFB. It offers a mechanism for giving confidential business information to Health Canada that is not available to
- the applicant of a drug submission; and
- the manufacturer of the dosage form.
To recover the costs associated with registering and maintaining MFs, HPFB will charge existing MF fees for veterinary MF-related activities. There are different fees for new MF registrations, MF updates and MF letters of access.

HPFB will increase these fees by 2% annually on April 1. The adjusted fees will be published in the annual Health Canada fees report and on the Health Canada website.

HPFB will not charge the file registration fee for existing MFs; however, applicable fees will be charged for all letters of access or updates as of January 2, 2024.
