CANADA-NOVA SCOTIA OFFSHORE PETROLEUM RESOURCES ACCORD IMPLEMENTATION ACT
Notice of setting aside of a Fundamental Decision of the Canada-Nova Scotia Offshore Petroleum Board
On October 3, 2023, the Minister of Energy and Natural Resources received notice of a Fundamental Decision from the Canada-Nova Scotia Offshore Petroleum Board to issue Exploration Licence 2437.
Pursuant to section 34 of the Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act, the Minister of Energy and Natural Resources suspended the implementation of this Fundamental Decision for a period ending on December 2, 2023.
Following the suspension and pursuant to paragraph 35(1)(a) of the Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act, this notice confirms that on December 2, 2023, and consistent with the approach taken by the provincial Minister of Natural Resources and Renewables, the Minister of Energy and Natural Resources set aside this Fundamental Decision.

Description of critical habitat of American Badger jeffersonii subspecies, Western population, in Vaseux-Bighorn National Wildlife Area and Vaseux Lake Bird Sanctuary and of American Badger jeffersonii subspecies, Eastern population, in Columbia National Wildlife Area
The American Badger jeffersonii subspecies (Taxidea taxus jeffersonii), Western population and Eastern population, is listed as endangered on Schedule 1 of the Species at Risk Act. In Canada, the American Badger jeffersonii subspecies is found in southern British Columbia, within which two distinct populations are recognized: Western population and Eastern population. The primary habitat requirements for American Badger jeffersonii subspecies are soil conditions suitable for digging and available prey populations. In British Columbia, the American Badger jeffersonii subspecies is typically associated with grassland and open forest ecosystems, which are most common at valley bottom elevations; however, badgers can be found at any elevation up to, and including, alpine areas, and in various types of forested and unforested ecosystems.
The latest Recovery Strategy for the American Badger jeffersonii subspecies (Taxidea taxus jeffersonii) Western population and Eastern population in Canada identifies the critical habitat for the species in a number of areas, including within federally protected areas.
Notice is hereby given that, pursuant to subsection 58(2) of the Species at Risk Act, subsection 58(1) of that Act will apply, 90 days after this publication, to the critical habitat of the American Badger jeffersonii subspecies, Western population and Eastern population, identified in the recovery strategy for those species — that is included on the Species at Risk Public Registry — that is found within the Columbia National Wildlife Area, Vaseux-Bighorn National Wildlife Area, and Vaseux Lake Bird Sanctuary described in Schedule 1 of the Wildlife Area Regulations made pursuant to the Canada Wildlife Act and in the schedule to the Migratory Bird Sanctuary Regulations made pursuant to the Migratory Birds Convention Act, 1994.
