CANADIAN INTERNATIONAL TRADE TRIBUNAL
DETERMINATION
Vessels, miscellaneous — Repair
Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File PR-2023-006) on September 6, 2023, with respect to a complaint filed by Chantier Davie Canada Inc. (Davie), of Ottawa, Ontario, and Wärtsilä Canada Inc. (Wärtsilä), of Surrey, British Columbia, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (Solicitation F7049-200041/B) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Fisheries and Oceans. The solicitation was for the carrying out of work on the CCGS Terry Fox. The required work includes docking, inspection, repair, maintenance and alterations, and work on major components, including the propulsion system.
Davie and Wärtsilä alleged, among other things, that PWGSC improperly conducted the re-evaluation of the bids, such re-evaluation having been conducted by PWGSC further to the Tribunal’s determination and recommendations in Inquiry No. PR-2022-053, and that the successful bid did not meet the mandatory requirements of the solicitation. They further alleged that PWGSC denied their request for a debriefing related to the re-evaluation.
Having examined the evidence presented by the parties and considered the provisions of the applicable trade agreement, the Tribunal determined that the complaint was valid in part.

Carbon and alloy steel line pipe
Notice is given that on September 6, 2023, pursuant to paragraph 76.03(12)(b) of the Special Import Measures Act, the Canadian International Trade Tribunal continued its finding (Expiry Review RR-2022-001) made on January 4, 2018, in inquiry NQ-2017-002, concerning the dumping of carbon and alloy steel line pipe originating in or exported from the Republic of Korea. The full description of the aforementioned goods and excluded goods can be found in the Tribunal’s order.
