DETERMINATION

Certain wind towers

Notice is given that on June 20, 2023, pursuant to subsection 37.1(1) of the Special Import Measures Act, the Canadian International Trade Tribunal determined (Preliminary Injury Inquiry PI-2023-001) that there is evidence that discloses a reasonable indication that the dumping and subsidizing of certain wind towers originating in or exported from the People’s Republic of China have caused injury or are threatening to cause injury to the domestic industry. The full description of the aforementioned goods can be found in the Tribunal’s determination.

DETERMINATION

Heating and ventilation and air circulation

Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File PR-2023-002) on July 14, 2023, with respect to a complaint filed by RollanTech Inc. (RollanTech), of Montréal, Quebec, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (Solicitation WS3851704599) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Fisheries and Oceans. The solicitation was for the provision of a new boiler coil for the Clayton boiler already installed on board the Martha L. Black.

RollanTech alleged that PWGSC had wrongly awarded the contract to a bidder that did not comply with a mandatory requirement of the solicitation.

Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was not valid.

DETERMINATION

Hotels, motels and commercial accommodation

Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File PR-2022-063) on June 7, 2023, with respect to a complaint filed by Newland Canada Corporation (Newland), of Calgary, Alberta, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (Solicitation W8484-230353/A) by the Department of National Defence. The solicitation was for the provision of accommodations in Brzeg, Poland, during the period of November 18, 2022, to May 31, 2023, with an option to extend.

Newland alleged that the procuring entity had improperly awarded the contract to Park Hotel Brzeg.

Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was not valid.
