Ministerial Instructions for the Student Direct Stream Program
These Instructions are published in the Canada Gazette in accordance with subsection 87.3(6) of the Immigration and Refugee Protection Act (the Act).
These Instructions are given pursuant to section 87.3 of the Act by the Minister of Citizenship and Immigration (the Minister) as, in the opinion of the Minister, these Instructions will best support the attainment of the immigration goals established by the Government of Canada.
These Instructions are consistent with the objectives of the Act, as set out in section 3.
These Instructions are directed to officers who are charged with handling and/or reviewing certain applications for study permits, and establish conditions that must be met for these study permits to receive priority processing. For the purposes of these Instructions, “priority processing” refers to an intended shortened processing time as compared to the regular study permit application process.
CONSIDERATIONS
Considering that Canada’s immigration objectives, as set out in section 3 of the Act, include the establishment of fair and efficient procedures to maintain the integrity of the Canadian immigration system;
Considering the aim to provide priority processing for study permits through the Student Direct Stream (SDS);
Considering that upfront language test results for the SDS maintain program integrity while allowing the Department of Citizenship and Immigration to issue study permits that meet the requirements of section 216 of the Immigration and Refugee Protection Regulations (IRPR) within an expedited time frame;
Considering that the SDS is an optional program to which applicants can apply in order to have their study permit application processed on a priority basis.
SCOPE
These Instructions set out the conditions that study permit applications need to meet in order to be considered part of the SDS and receive priority processing.
These Instructions apply to applications for the SDS submitted on or after the date on which the Instructions take effect.
INSTRUCTIONS TO PROCESS ON A PRIORITY BASIS CERTAIN STUDY PERMIT APPLICATIONS
Officers are instructed to give priority processing to study permit applications that meet the following conditions.
Student Direct Stream
To be eligible for priority processing under the SDS, the study permit application must have been made by an applicant who is a legal resident of Antigua and Barbuda, Brazil, China, Colombia, Costa Rica, India, Morocco, Pakistan, Peru, Philippines, Senegal, Saint Vincent and the Grenadines, Trinidad and Tobago, or Vietnam.
In addition, applicants must provide the following documentation at the time they present their study permit application:
- (1) an acceptance letter from a postsecondary designated learning institution, as per section 211.1 of IRPR;
- (2) evidence that the tuition has been paid to the postsecondary designated learning institution referred to in (1) for the first year of study;
- (3) a Guaranteed Investment Certificate (GIC) of CAN$10,000;
- (4) a medical examination, as per section 29 of IRPR;
- (5) a police certificate;
- (6) recent secondary or postsecondary school transcript(s); and
- (7) a language test result, as described in these Instructions.
- (8) Applicants intending to study in Quebec must also have a Québec Acceptance Certificate (CAQ) from the Ministère de l’Immigration, de la Francisation et de l’Intégration.
For the purposes of these Instructions, language test results accepted are
- Results of an evaluation from a designated language-testing organization using a general language test approved pursuant to subsection 74(3) of the IRPR: IELTS General, CELPIP General, TEF Canada and TCF Canada; with a score that is equivalent to a Canadian Language Benchmarks score of at least 7 for each of the four language abilities (speaking, listening, reading, and writing); or
- Results of an academic language test from a language-testing organization designated pursuant to subsection 74(3) of the IRPR: IELTS Academic (minimum score of 6), CAEL (minimum score of 60), Pearson PTE Academic (minimum score of 60), TEF - 5 épreuves (minimum score of 400) and TCF - tout public (minimum score of 400), with results from each of the four language abilities (speaking, listening, reading, and writing); or
- Results from the academic language test from Educational Testing Service (ETS) TOEFL iBT Test (minimum score of 83), with results from each of the four language abilities (speaking, listening, reading, and writing).
Additionally, all above noted tests must be taken in their in-person format to be accepted for the SDS. Online remotely proctored tests will not be accepted for the purposes of the SDS.

These Instructions take effect 90 days from the date they are signed.
Retention and dispositions
Applications received by the Department of Citizenship and Immigration on or after the Instructions take effect that do not meet the conditions set out in these Instructions will not receive priority processing.

CANADA MARINE ACT
Trois-Rivières Port Authority — Supplementary letters patent
WHEREAS letters patent were issued by the Minister of Transport (“Minister”) for the Trois-Rivières Port Authority (“Authority”), under the authority of the Canada Marine Act (“Act”), effective May 1, 1999;
WHEREAS Schedule C of the letters patent sets out the immovables, other than federal immovables, held or occupied by the Authority;
WHEREAS, pursuant to subsection 46(2.1) of the Act, the Authority wishes to acquire the immovable known and designated as being lot 1 018 894 of the cadastre of Quebec;
WHEREAS the board of directors of the Authority has requested that the Minister issue supplementary letters patent to set out the said immovable in Schedule C of the letters patent;
AND WHEREAS the Minister is satisfied that the amendment to the letters patent is consistent with the Act;
NOW THEREFORE, pursuant to subsection 9(1) of the Act, the letters patent are amended as follows:

- 2. These supplementary letters patent take effect on the date of registration in the Land register of Quebec of the deed of sale evidencing the transfer of the immovable to the Authority.

CANADA SHIPPING ACT, 2001
Interim Order No. 6 Respecting Flooded Areas
Whereas the Minister of Transport is of the opinion that the annexed Interim Order No. 6 Respecting Flooded Areas is required to deal with a direct or indirect risk to marine safety or to the marine environment;
And whereas the provisions of the annexed Interim Order may be contained in a regulation made under paragraphs 136(1)(f)footnote a and (h)footnote a and 207(1)(c) of the Canada Shipping Act, 2001 footnote b;
Therefore, the Minister of Transport makes the annexed Interim Order No. 6 Respecting Flooded Areas under subsection 10.1(1)footnote c of the Canada Shipping Act, 2001 footnote b.

Interim Order No. 6 Respecting Flooded Areas
Interpretation
Interpretation
1 Unless the context requires otherwise, words and expressions used in this Interim Order have the same meaning as in the Vessel Operation Restriction Regulations.
Prohibitions
Operation of vessels
2 It is prohibited for a person to operate a vessel in any of the following waters:
- (a) the part of the Ottawa River in Quebec between Macdonald-Cartier bridge and Rockland;
- (b) the part of the Ottawa River between Barrage de Carillon and Lac des Deux Montagnes; and
- (c) the waters of Lac des Deux Montagnes eastward to Pointe-Calumet.
Maximum speed
3 It is prohibited for a person to operate a pleasure craft at a speed in excess of 10 km/h in any of the following waters:
- (a) Lac des Deux Montagnes east of Pointe-Calumet;
- (b) Lac Saint-Louis; and
- (c) Rivière des Prairies.
Exception
Persons
4 Section 2 does not apply to vessels operated by any of the following persons:
- (a) an employee of a provincial government, a local authority or a government, council or other entity authorized to act on behalf of an Indigenous group who is acting in the course of their duties;
- (b) a member of a fire department or police force who is acting in the course of their duties;
- (c) an employee of a Crown corporation who is acting in the course of their duties;
- (d) a person who is authorized by an entity referred to in paragraph (a), (b) or (c) to support flood response measures or to participate in the repair, demolition or construction of infrastructure related to the floods, and who is acting in the course of their duties;
- (e) an officer or a non-commissioned member of the Canadian Forces who is acting in the course of their duties;
- (f) an officer of the Canadian Coast Guard who is acting in the course of their duties;
- (g) a person who operates a ferry vessel, as defined in section 2 of the Hull Construction Regulations, as a service available to the public, if the operation of the ferry vessel does not present an important risk to safety; and
- (h) a person who operates a vessel solely to gain access to their property, if the property is not accessible by road, or a person acting on behalf of the property owner.

Powers
6 An enforcement officer may
- (a) prohibit the movement of any vessel or direct it to move as specified by the enforcement officer; and
- (b) stop and board any vessel at any reasonable time and
- (i) direct any person to put into operation or cease operating any equipment on board the vessel,
- (ii) ask any pertinent questions of, and demand all reasonable assistance from, any person on board the vessel, and
- (iii) require that any person on board the vessel provide to the enforcement officer, for examination, any document or information that is in the person’s possession.

Order Repealing Interim Order No. 6 Respecting Flooded Areas
Whereas the Minister of Transport made Interim Order No. 6 Respecting Flooded Areas on May 9, 2023, under subsection 10.1(1)footnote c of the Canada Shipping Act, 2001 footnote b;
And whereas that Minister believes that that Interim Order is no longer required to deal with a direct or indirect risk to marine safety or to the marine environment;
Therefore, the Minister of Transport makes the annexed Order Repealing Interim Order No. 6 Respecting Flooded Areas under subsection 10.1(1)footnote a of the Canada Shipping Act, 2001 footnote b.
