EXPROPRIATION ACT

Notice of intention to expropriate — Lac-Mégantic Railway bypass [Servitude of non-construction]

NOTICE IS HEREBY GIVEN that Her Majesty in right of Canada requires, for the purposes of the construction and exploitation of a railway bypassing the downtown area of Lac-Mégantic, all the immovable real rights, being real and perpetual servitude, hereinafter described, namely:

ARTICLE 1. SERVITUDE OF NON-CONSTRUCTION

1.1. A real and perpetual servitude of non-construction, on the land hereinafter designated in paragraph 2.1, as servient land, and in favor of the dominant land hereinafter designated in paragraph 3.1, under which it is prohibited to construct, erect or develop any construction, structure or building and to deposit or store any materials, debris or other object on the servient land hereinafter designated in paragraph 2.1.

ARTICLE 2. SERVIENT LAND

2.1. The land required, as servient land, for the servitude of non-construction designated in paragraph 1.1, in favor of the dominant land hereinafter designated in paragraph 3.1, is known and designated as being:

A part of lot THREE MILLION ONE HUNDRED AND NINE THOUSAND TWO HUNDRED AND SIXTY-ONE (pt 3,109,261) of the cadastre of Quebec, Registration division of Frontenac, which can be more particularly described as follows:

ARTICLE 3. DOMINANT LAND

3.1. The dominant land of the servitude of non-construction is known and designated as the Lac-Mégantic railway bypass, passing on the lot SIX MILLION FOUR HUNDRED SEVENTY-THREE THOUSAND FIVE (6,473,005), of the cadastre of Quebec, registration division of Frontenac.

HER MAJESTY IN RIGHT OF CANADA intends to expropriate the immovable real right herein described at the article 1, for the needs of the Department of Transport Canada.

HER MAJESTY IN RIGHT OF CANADA asks the Land Registrar to register in the land register this notice and the plan attached hereto for the land designated above in the paragraph 2.1 as the “servient land”.

Any person who objects to the intended expropriation of the above-mentioned rights may, within thirty (30) days from the day upon which this Notice of Intention to Expropriate is published in the Canada Gazette, forward by registered mail to, or leave at, the Office of the Minister of Public Works and Government Services, Attention: Regional Director General, Place Bonaventure, South-West Portal, 800 de la Gauchetière Street West, Suite 7300, Montréal, Province of Quebec, H5A 1L6, an objection in writing stating the name and address of such person and indicating the nature of his or her objection and the nature of his or her interest in the matter of this intended expropriation.
