DETERMINATION

Vessels, miscellaneous — repair

Notice is given that, after completing its inquiry (File PR-2022-053), the Canadian International Trade Tribunal made a determination on February 1, 2023, with respect to a complaint filed by Chantier Davie Canada Inc. (Davie) of Ottawa, Ontario, and Wärtsilä Canada Inc. (Wärtsilä) of Surrey, British Columbia, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (solicitation F7049-200041/B) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Fisheries and Oceans. The solicitation was for the carrying out of work on the CCGS Terry Fox.

Davie and Wärtsilä alleged that PWGSC incorrectly determined that their bid was non-compliant. They also alleged that the successful bid did not meet the mandatory requirements of the solicitation.

Having examined the evidence presented by the parties and considered the provisions of the applicable trade agreement, the Tribunal determined that the complaint was valid in part.

INQUIRY

Hotels, motels and commercial accommodation

The Canadian International Trade Tribunal has received a complaint (File PR-2022-063) from Newland Canada Corporation (Newland) of Calgary, Alberta, concerning a procurement (solicitation W8484-230353/A) by the Department of National Defence. The solicitation was for the provision of accommodations in Brzeg, Poland, during the period of November 18, 2022, to May 31, 2023. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on January 31, 2023, to conduct an inquiry into the complaint.

Newland alleges that the procuring entity improperly awarded the contract to Brzeg Park Hotel.

Concrete reinforcing bar

Notice is given that on February 2, 2023, pursuant to paragraph 76.03(12)(b) of the Special Import Measures Act, the Canadian International Trade Tribunal continued, without amendment, its finding (Expiry review RR-2021-006) in respect of the dumping of concrete reinforcing bar from the Republic of Belarus, the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (excluding those goods exported by Feng Hsin Steel Co., Ltd.), the Hong Kong Special Administrative Region of the People’s Republic of China, Japan, the Portuguese Republic and the Kingdom of Spain. The full description of the aforementioned goods and the excluded goods can be found in the Tribunal’s order.

SPECIES AT RISK ACT

Description of critical habitat of the Hoptree Borer in Point Pelee National Park of Canada

The Hoptree Borer (Prays atomocella) is a small but distinctively patterned moth and is listed on Schedule 1 of the Species at Risk Act. In Canada, the Hoptree Borer is found in Point Pelee National Park of Canada and depends on the Common Hoptree, which is often a component of the stabilizing vegetation along sections of the Lake Erie shoreline.

The Recovery Strategy for the Hoptree Borer (Pray atomocella) in Canada identifies critical habitat for the species in a number of areas, including within Point Pelee National Park of Canada.

Notice is hereby given, pursuant to subsection 58(2) of the Species at Risk Act, that 90 days after the date of publication of this notice, subsection 58(1) of the Act will apply to the critical habitat of the Hoptree Borer, as defined in the recovery strategy for the species, that is included in the Species at Risk Public Registry that is located within Point Pelee National Park of Canada, the boundaries of which are described in Schedule 1 to the Canada National Parks Act.
