DETERMINATION

Hotels, motels and commercial accommodation

Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File PR-2022-037) on December 19, 2022, with respect to a complaint filed by Newland Canada Corporation (Newland), of Calgary, Alberta, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (solicitation W8484-23-0296/A) by the Department of National Defence (DND). The solicitation was for accommodations and laundry services.

Newland alleged that it had obtained evidence that the winning bidder was performing the contract by accommodating DND personnel at two establishments, thereby calling into question the evaluation of the bids by DND and the subsequent award. It also claimed that both hotels in question failed to meet some of the mandatory requirements of the solicitation.

Having examined the evidence presented by the parties and considered the provisions of the applicable trade agreement, the Tribunal determined that the complaint was valid in part.

Issue Whether the goods in issue, which originated in a country not covered by the Tribunal’s finding in NQ-95-002 (concerning the dumping of refined sugar, refined from sugar cane or sugar beets, in granulated, liquid and powdered form, originating in or exported from the United States of America, Denmark, the Federal Republic of Germany, the Netherlands and the United Kingdom, and the subsidizing of the aforementioned goods originating in or exported from the European Union), and were shipped through the United States prior to entering Canada, are subject to the Tribunal’s finding in NQ-95-002 and are therefore subject to anti-dumping duties.

The Canadian International Trade Tribunal will hold a public hearing to consider the appeal referenced below. This hearing will be held via videoconference.
