Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File PR-2022-031) on December 14, 2022, with respect to a complaint filed by Higher Standard Sales (HSS), of Edmonton, Alberta, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (Solicitation W0130-21GC31/WS3390107314) by the Department of Public Works and Government Services on behalf of the Department of National Defence. The solicitation was for the acquisition of sea containers.

HSS alleged that PWGSC had incorrectly determined that its bid did not meet all technical requirements described in the solicitation and that the successful bidder had offered a price that is abnormally low.

Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was not valid.

Regulated interswitching rates for 2023

Whereas in Determination No. R-2022-164 dated December 1, 2022, the Canadian Transportation Agency (Agency) determined, pursuant to subsection 127.1(1) of the Canadian Transportation Act (CTA), S.C. 1996, c. 10, as amended, the regulated interswitching rates for 2023, according to the interswitching distance zones as defined in the Railway Interswitching Regulations, SOR/88-41, as amended;

Whereas pursuant to subsection 127.1(5) of the CTA, the Agency shall cause the interswitching rates to be published in the Canada Gazette, Part I, no later than December 31 before the beginning of the calendar year for which the rates apply,

The Agency hereby publishes the interswitching rates for the 2023 calendar year.
