Mattresses — Decisions

On October 5, 2022, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) terminated the dumping investigation in respect of mattresses from China by Jiaxing Taien Springs Co., Ltd. and Xianghe Kaneman Furniture Ltd. as they have not been dumped. Pursuant to paragraph 41(1)(b) of SIMA, the CBSA has made a final determination of dumping concerning mattresses for all other exporters from China, for which the investigation has not been terminated.

On the same day, pursuant to paragraph 41(1)(a) of SIMA, the CBSA terminated the subsidizing investigation in respect of mattresses from China by Dongguan Sinohome Ltd., Gold Lion Furniture (Shanghai) Co., Ltd., Guangdong Eonjoy Technology Ltd., Jinlongheng Furniture Co., Ltd., Xianghe Kaneman Furniture Ltd., Zinus Xiamen Inc. and Zinus Zhangzhou Inc. due to no subsidy or insignificant amounts of subsidy. Pursuant to paragraph 41(1)(b) of SIMA, the CBSA has made a final determination of subsidizing concerning mattresses for all other exporters from China, for which the investigation has not been terminated.

The subject goods are usually classified under the following tariff classification numbers:

The Canadian International Trade Tribunal (CITT) inquiry into the question of injury to the Canadian industry is continuing, and it will issue its decision by November 4, 2022. Provisional duty will continue to be imposed on the subject goods from China until the CITT renders its decision. However, provisional countervailing duty will no longer be imposed on imports of goods of the same description as the goods in respect of which the dumping and/or subsidizing investigations have been terminated. Any provisional duty paid or security posted will be refunded, as appropriate.

If the CITT finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, antidumping duty and/or countervailing duty will be applied to future importations of the subject goods. In that event, the importer in Canada shall pay such duties.

The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of antidumping and countervailing duties.

Information

The Statement of Reasons regarding these decisions will be issued within 15 days following the decisions and will be available on the CBSA’s website.

Professional services under ProServices Stream 9.15

The Canadian International Trade Tribunal has received a complaint (File PR-2022-035) from Star-Ting Incorporated, of Calgary, Alberta, concerning a procurement (Solicitation 30001823) made by the Department of Fisheries and Oceans (DFO). The solicitation was for the provision of professional services of one senior facilitator consultant under ProServices Stream 9.15. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on August 12, 2022, to conduct an inquiry into the complaint.

Star-Ting Incorporated alleges that DFO improperly evaluated its bid.
