Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File PR-2021-058) on May 2, 2022, with respect to a complaint filed by Gregory Kerr Limited (Gregory Kerr) of Dartmouth, Nova Scotia, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (solicitation EB144-221443/A) by the Department of Public Works and Government Services on behalf of the Department of Fisheries and Oceans. The solicitation was for the provision of services to repair the Canadian Coast Guard floating dock located in Sambro, Nova Scotia.
Gregory Kerr alleged that its bid was unfairly deemed unresponsive to the mandatory requirements of the solicitation for failing to meet bid security requirements and that its bid bond was both authentic and verifiable.
Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was not valid.
