SPECIAL IMPORT MEASURES ACT

Drill pipe — Decision

On March 25, 2022, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping and subsidizing of certain drill pipe from China.

The Canadian International Trade Tribunal (CITT) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The CITT will make a decision within 60 days of the date of initiation. If the CITT concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

The Statement of Reasons regarding the decision will be issued within 15 days following the decision and will be available on the CBSA’s website or by contacting the SIMA Registry and Disclosure Unit at 613‑948‑4605 or by email at simaregistry@cbsa-asfc.gc.ca.

Representations

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping and subsidizing. During the COVID-19 pandemic, written submissions must be sent electronically to simaregistry@cbsa-asfc.gc.ca. To be given consideration in these investigations, the CBSA should receive this information by August 2, 2022.

Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission also must be provided.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

INQUIRY

Engineering (R&D)

The Canadian International Trade Tribunal has received a complaint (File PR-2021-081) from Properate (Lambda Science Inc.) [Properate], of Vancouver, British Columbia, concerning a procurement (Solicitation 23240-220001/A) made by the Department of Public Works and Government Services on behalf of the Department of Natural Resources. The solicitation was for expertise related to housing and buildings. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on March 18, 2022, to conduct an inquiry into the complaint.

Properate alleges that the reviewers did not give adequate consideration to its bid, that the bid was rejected based on missing information that was not requested, and that the reviewers’ interpretation of the mandatory criterion M3 was not merit-based and, therefore, was not within the intent of the request for standing offer.

Informatics professional services

The Canadian International Trade Tribunal has received a complaint (File PR-2021-082) from S.i. Systems, of Ottawa, Ontario, concerning a procurement (Solicitation G9292-248331/A) made by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Employment and Social Development. The solicitation was for the provision of professional services in support of the Task-Based Informatics and Professional Services myEMS (SAP) Solution system. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on March 15, 2022, to conduct an inquiry into the complaint.

S.i. Systems alleges that PWGSC’s cancellation of the solicitation is unfair, discriminatory and contrary to PWGSC’s obligations under the World Trade Organization Agreement on Government Procurement, the Canada-European Union Comprehensive Economic and Trade Agreement, the Comprehensive and Progressive Agreement for Trans-Pacific Partnership, the Canadian Free Trade Agreement, the Canada-Chile Free Trade Agreement, the Canada-Peru Free Trade Agreement, the Canada-Colombia Free Trade Agreement, the Canada-Panama Free Trade Agreement, the Canada-Ukraine Free Trade Agreement, the Canada-Korea Free Trade Agreement, and the Canada-United Kingdom Trade Continuity Agreement.

PUBLIC SERVICE EMPLOYMENT ACT
