Order 2022-87-01-02 Amending the Non-domestic Substances List
Whereas, pursuant to subsection 87(5) of the Canadian Environmental Protection Act, 1999 footnote a, the Minister of the Environment has added the substances referred to in the annexed Order to the Domestic Substances List footnote b;
Therefore, the Minister of the Environment, pursuant to subsection 87(5) of the Canadian Environmental Protection Act, 1999 footnote a, makes the annexed Order 2022-87-01-02 Amending the Non-domestic Substances List.

Coming into Force
2 This Order comes into force on the day on which Order 2022-87-01-01 Amending the Domestic Substances List comes into force.

Public consultation process for the development of recycled content for certain plastic manufactured items regulations under the Canadian Environmental Protection Act, 1999
Purpose
This notice of intent is to inform, and seek early feedback from, interested parties regarding the development of regulations under the Canadian Environmental Protection Act, 1999 (CEPA) to require minimum recycled content in certain plastic manufactured items.
A technical issues paper outlining details of the proposed regulations is available on the Government of Canada website.
Background
In an October 2020 discussion paper published by the Department of the Environment, the Government of Canada announced its intent to develop regulations under CEPA to require minimum recycled content in certain plastic manufactured items.
In May 2021, “plastic manufactured items” were added to Schedule 1 to CEPA. This listing allows the Government to enact regulations under CEPA to manage plastic manufactured items at key stages in the lifecycle of plastic products, such as manufacture, use, disposal, and recovery. Such management would reduce pollution and create the conditions to achieve a circular economy for plastics.
Public comment period
Any person may, within 30 days of publication of this notice, file with the Minister of Environment and Climate Change comments with respect to this proposal. All comments must be addressed to Tracey Spack, Director, Plastic Regulatory Affairs Division, Department of the Environment, ContenuRecycleRecycledContent@ec.gc.ca (email).
In accordance with section 313 of the Canadian Environmental Protection Act, 1999, any person who provides information in response to this notice may submit a request that it be treated as confidential.
Next steps
The Department of the Environment will be consulting stakeholders and interested parties on this proposal through early 2022, including through virtual engagement sessions. Parties interested in attending these sessions are asked to contact the Department at the following address: ContenuRecycleRecycledContent@ec.gc.ca.
The Department intends to publish the proposed regulations be in the Canada Gazette, Part I, as early as the end of 2022. There will be a comment period following the publication during which interested parties will have an opportunity to provide feedback.
