CANADA ENERGY REGULATOR

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES

CP Energy Marketing Inc., on behalf of CP Energy Marketing L.P.

By an application dated January 17, 2022, CP Energy Marketing Inc., on behalf of CP Energy Marketing L.P. (the Applicant), has applied to the Canada Energy Regulator (the CER) under Division 2 of Part 7 of the Canadian Energy Regulator Act (the Act) for authorization to export up to 2 000 000 MWh of firm energy annually and up to 5 000 000 MWh of interruptible energy annually, for a period of 10 years. The Applicant, or its affiliates, has an interest in the following generation or transmission facilities in Canada:

The Commission of the Canada Energy Regulator (the Commission) wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The Directions on Procedure that follow explain in detail the procedure that will be used.

  1. The Applicant shall provide a copy of the application by email to any person who requests one by emailing legal counsel, Mr. Zoltan Nagy-Kovacs at znagykovacs@capitalpower.com. The application is also publicly available on the CER website.
  2. Written submissions that any interested party wishes to present shall be filed online with the CER in care of the Secretary of the Commission, and emailed to the Applicant by February 21, 2022.
  3. Pursuant to subsection 359(2) of the Act, the Commission is interested in the views of submitters with respect to
    • (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported; and
    • (b) whether the Applicant has
      • (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
      • (ii) given an opportunity to buy electricity on conditions as favourable as the conditions specified in the application to those who, within a reasonable time after being so informed, demonstrate an intention to buy electricity for consumption in Canada.
  4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this Notice of Application and Directions on Procedure shall be filed with the CER in care of the Secretary of the Commission and emailed to the party that filed the submission by February 28, 2022.

Armament training devices

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File PR-2021-040) on January 7, 2022, with respect to a complaint filed by Cadex Inc. (Cadex), of Saint-Jean-sur-Richelieu, Quebec, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation W8476-196090/B) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the provision of multi-calibre sniper weapon systems.

Cadex alleged that PWGSC did not conduct testing in accordance with the evaluation procedures of the solicitation, ignored vital information provided by Cadex, and conducted the procurement in a procedurally unfair manner with insufficient transparency.

Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was not valid.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File PR-2021-042) on January 14, 2022, with respect to a complaint filed by Enveloppe Concept Inc. (ECI) of LaSalle, Quebec, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation EN893-220033/A) by the Department of Public Works and Government Services. The solicitation was for envelopes for the Receiver General for Canada.

ECI alleged that the successful bidder’s proposal was non-compliant with respect to certain certifications and requirements of the solicitation.

Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was not valid.

The Canadian International Trade Tribunal has received a complaint (File PR-2021-062) from ProSpect Scientific Incorporated (ProSpect) of Mono, Ontario, concerning a procurement (Solicitation 23240-220522/A) made by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Natural Resources. The solicitation was for a confocal Raman microscope. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on January 6, 2022, to conduct an inquiry into the complaint.

ProSpect alleges that PWGSC awarded the contract to a bidder that did not meet the mandatory criteria.

Permission and leave granted (Bourdon, Gabriel)

The Public Service Commission of Canada, pursuant to section 116 of the Public Service Employment Act, hereby gives notice that it has granted permission, pursuant to subsection 114(4) of the said Act, to Gabriel Bourdon, Acting HR Project Officer, Canada Revenue Agency, to seek nomination as a candidate before and during the election period, and to be a candidate before the election period in the provincial election in the electoral district of Orléans, Ontario. The election is expected to be held on or before June 2, 2022.

The Public Service Commission of Canada, pursuant to subsection 114(5) of the said Act, has also granted a leave of absence without pay during the election period, effective the first day the employee is a candidate during the election period.
