(E-REGISTRY SERVICE PILOT PROJECT)

Oil country tubular goods

Notice was received by the Canadian International Trade Tribunal on September 28, 2021, from the Director General of the Trade and Anti-dumping Programs Directorate at the Canada Border Services Agency (CBSA), stating that a preliminary determination had been made respecting the dumping of oil country tubular goods, which are casing, tubing and green tubes made of carbon or alloy steel, welded or seamless, heat-treated or not heat-treated, regardless of end finish, having an outside diameter from 2 ⅜ inches to 13 ⅜ inches (60.3 mm to 339.7 mm), meeting or supplied to meet American Petroleum Institute specification 5CT or equivalent and/or enhanced proprietary standards, in all grades, excluding drill pipe, pup joints, couplings, coupling stock and stainless steel casing, tubing or green tubes containing 10.5 percent or more by weight of chromium, originating in or exported from the United Mexican States.

Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry (Inquiry No. NQ-2021-004) to determine whether the dumping of the subject goods has caused injury or retardation or is threatening to cause injury, and to determine such other matters as the Tribunal is required to determine under that section.

Each person or government wishing to participate in the inquiry and at the hearing as a party must file a Form I —Notice of Participation with the Tribunal, on or before October 13, 2021. Each counsel who intends to represent a party in the inquiry and at the hearing must file a Form II — Notice of Representation and a Form III — Declaration and Undertaking with the Tribunal, on or before October 13, 2021. The forms can be found in English and French on the Tribunal’s website.

On November 17, 2021, the Tribunal will issue a list of participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined in the notice on the Tribunal’s website. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed a Form III — Declaration and Undertaking with the Tribunal. This information will be included in the list of participants. One complete electronic version of all submissions must be filed with the Tribunal.

The Tribunal will hold a hearing relating to this inquiry in late December 2021 or early January 2022. Given the current COVID-19 situation, the type and the place of hearing, as well as the exact date of the hearing, will be communicated at a later date.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential edited version or non-confidential summary of the information designated as confidential, or a statement indicating why such a version or summary cannot be made.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination on November 10, 2021, with respect to two complaints (File Nos. PR-2021-023 and PR-2021-028) filed by Rampart International Corp. (Rampart) of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. W8476-216392/B) made by the Department of Public Works and Government Services on behalf of the Department of National Defence. The solicitation was for a replacement pistol and holster system.

Rampart alleged that the solicitation required certain design types which served no legitimate operational requirement and favoured certain bidders.

Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was valid in part.

Copper pipe fittings

The Canadian International Trade Tribunal hereby gives notice that, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), it will initiate an expiry review (Expiry Review No. RR-2021-003) of its orders made on November 28, 2016, in Expiry Review No. RR-2015-003, continuing, with amendment, its orders made on February 17, 2012, in Expiry Review No. RR-2011-001, continuing, without amendment, its findings made on February 19, 2007, in Inquiry No. NQ-2006-002, concerning the dumping of certain solder joint pressure pipe fittings and solder joint drainage, waste and vent pipe fittings, made of cast copper alloy, wrought copper alloy or wrought copper, for use in heating, plumbing, air conditioning and refrigeration applications, originating in or exported from the United States of America, the Republic of Korea and the People’s Republic of China, and the subsidizing of such goods originating in or exported from the People’s Republic of China (the subject goods). The list of products covered by the Tribunal’s orders in Expiry Review No. RR-2015-003 is included in the appendix. Furthermore, the Tribunal’s orders exclude copper-iron high-pressure alloy fittings manufactured with UNS C19400 grade copper alloy and with safe working pressure up to 1740 psi.

In this expiry review, the Canada Border Services Agency (CBSA) will first determine whether the expiry of the orders in respect of the subject goods is likely to result in the continuation or resumption of dumping or subsidizing of the subject goods. If the CBSA determines that the expiry of the orders in respect of any goods is likely to result in the continuation or resumption of dumping or subsidizing, the Tribunal will then conduct an expiry review to determine if the continued or resumed dumping or subsidizing is likely to result in injury. The CBSA will provide notice of its determinations within 150 days after receiving notice of the Tribunal’s decision to initiate an expiry review, that is, no later than April 7, 2022. The Tribunal will issue its order and its statement of reasons no later than September 14, 2022.

Each person or government wishing to participate in this expiry review must file a Form I — Notice of Participation with the Tribunal, on or before April 22, 2022. Each counsel who intends to represent a party in the expiry review must file a Form II — Notice of Representation and a Form III — Declaration and Undertaking with the Tribunal, on or before April 22, 2022. The forms can be found in English and French on the Tribunal’s website.

On May 30, 2022, the Tribunal will issue a list of participants.
